My first thought for the charge was murder. In order for it to be a murder crime, actus rea and men reus must be joined in time. The actus rea in this incident was the confronting, shooting, and killing of the suspicious individual walking in a neighbourhood. That's the easy part to prove unlike the men reus. Constructive intent was present in this situation. The shooter may not have intended to harm the individual that he believed to be suspicious, but he should have know that approaching someone could create a high risk of harm. Last Monday in the quaint town of Park City the residents were astonished to hear the news regarding a shooting that took place early Monday morning. The victim of the shooting was Jose Fernandez. He was 37 years old and worked and lived in Park City. The shooter James Henfling, a 27-year-old, Midvale resident, is being charged with a first-degree murder and could face three years to life in prison. Unfortunately, Fernandez died at a Salt Lake hospital around 5:45 pm. Additional charges may be added to Henfling due to the Fernandez’s death.

The officer was called to assist the woman’s son but instead he was murdered. Police officers use their weapons under any circumstances. Officers need to be trained to deal with any situation, even an emergency of a mentally ill person without having to go as far as shooting someone all because he felt threatened. There needs to be new training exercise provided for the police departments to help reduce the murders and harassment against minorities based on the inability to handle someone.
The Pulse Orlando shooting was one of the deadliest shootings to happen this year. There were so many lives lost because of one man’s hatred towards a certain group of people. The shooter himself dedicated countless hours to plan his attack on the club. Hate crimes happen all the time in the United States, too many. Many people lost their lives, the shooter was well informed on how to execute his plan, and this shooting was yet another example of a hate crime.
I wouldn’t have done anything else in the incident, besides empty out my magazine from my duty issued weapon. The local citizens need to understand basic laws and commands from police officers. In order to meet the requirements of transferred intent, two questions must be asked and both questions must have a “yes” to apply transferred intent.
