Exemplification Essay: Mixing of Religion and the State

Religion is one of the most controversial issues in society today. The concern of allowing prayer in schools is an on-going debate and has resulted in numerous lawsuits. Religious school clubs, after school activities, curriculums, and moments of silence during school are just a few of the court cases that judges have administered. People in favor of prayer in schools believe that their children can only learn certain values through religious practice. On the other hand, an individual against religious practice in schools views this issue as an infringement on his or her children’s rights as Americans.

Constitution's First Amendment requirement that the District neither establish religion in the schools nor prohibit students’ free exercise of religion according to pertinent interpretation and application of those constitutional provisions by the courts. Any religious characters need to conform to policy 8800” (Markesan District School, 2013). “Decisions of the United States Supreme Court have made it clear that it is not the province of a public school to advance or inhibit religious beliefs or practices” (Markesan District School, 2015). Under the First and Fourteenth Amendments to the Constitution, this remains the “inviolate province of the individual and the church of his/her choice. The rights of any minority, no matter how small, must be protected. District staff members shall not use prayer, religious readings, or religious symbols as a devotional exercise or in an act of worship or celebration” (20 U.S.C. 4071 et seq.) (Markesan District School, 2015). Having examined the Markesan District School First Amendment related to this topic the next step is to conclude my research on this topic.

The First Amendment is designed to protect all citizens by giving them the right to express themselves in different ways. In doing so, we still have to be careful on how we do it. Students have the right to express themselves as long as it does not cause any disruption. In my school district, we abides by the First Amendment by not forbidding all mention of religion in the school system (Pamlico County Board of Education, 2015). The only part that is prohibited is the advancement or inhibition of religion (Pamlico County Board of Education, 2015). My school district feels that there’s nothing unconstitutional about using religious subjects or materials as long as it is in compliance to the neutrality of the education program (Pamlico County Board of Education, 2015).

Freedom of Religion means that the government can’t force you to accept only one set of religious beliefs or the way you worship. You can worship your own way and have your own religious beliefs as long as they don’t violate other people's rights. Today this is a very big debate when it comes to prayer and schools. Several cases have been brought to the Supreme Court about this and whether students have the right to pray in class or if the prayer would interfere with another student’s rights.

Since before the United States was founded, the ideals of Christianity have been integrated into the government in some way, shape, or form. In the early days of the Colonies, Christianity was the centerfold for all government affairs; however, after the constitution was ratified and deemed effective in the United States, the First Amendment was born. The first amendment states that, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances” (source). As religion becomes less a part of American life, the court develops new laws to accommodate our new society. Look to the communities we live in presently and ask yourself if the American people are facing oppression of religious freedom, a freedom listed in our Constitution under the First Amendment. Although “God” is mentioned in the Constitution, this country was built upon the principle of separation of church and state. Despite this ideal, those elected into office: propose, pass, and deny laws based on their religious beliefs, completely disregarding the previously mentioned principle. The problem with that is that the country is so ethnically and culturally diverse that one religion representing an entire nation of hundreds of religions is selfish and unfair, not to mention un-American.

Even when the Constitution establishes a separation between church and state, traces of religion can still be found in public and government environments, such as the Pledge of Allegiance containing the words ‘under God’, American currency having ‘In God we trust’ and other such events and places. Consequently, this prevalence of Christian ideology violates all Americans’ first amendment right to freedom of and from religion and has a negative impact all citizens as it conflicts with their individual beliefs, religious or not.

The American education system is one of the main places of controversy for the Separation of Church and State. Almost every child in the United States attends some type of school, many of them public systems. In such a school setting, these children are often exposed to the beliefs of their teachers and administrators, as well as their own classmates. In Greece, New York, ever since 1999, the town board has begun their monthly gatherings with prayer. Rev. Lou Sirianni begins his gathering by stating: "Be thou present, O God of wisdom, and direct the councils of this honorable assembly," the prayer ended, "All this we ask in the name and through the merits of Jesus Christ, Thy Son and our Savior" (Wolf 1). Recently in 2007, two residents who regularly attended board meetings, Susan Galloway and Linda Stephens, complained that the prayers were promoting more of a Christian community than any other religion (Masci 3). Although separation of church and state is stated briefly in the First Amendment, these two ladies had the right to go after the town for not allowing a freedom of religion and for most importantly throwing religion into a government owned school function. The case was brought to the Supreme Court in 2007 and is still under debate, with a result hopefully by the end of June 2014. The First Amendment ensures that there is separation between Church and State. However, this disjunction is not absolute. As the United States has become a more multi-cultural society, certain rituals have become problematic. Some issues were traditions that put one religion at the forefront, violating of the Establishment Clause; other issues affected peoples’ right to free expression of their religion. Many times people do not realize the Judeo-Christian bias in our culture because it is so integrated into our way of life. This country needs to recognize these biases and address them as the United States become a more diverse population.

The United States of America has the most diverse religious population in the world. In places like Iraq, Syria, Israel, Afghanistan, Yemen, and other countries too numerous to mention, countless lives are lost over religious differences. In America, a Protestant can live happily next door to a Jew, who might live across the street from a Muslim, or a Catholic, or a Sikh, or even a Humanist! Separation of church and state is a defined as, the understanding of the intent, and function of the Establishment Clause, and Free Exercise Clause. The Combination of church and state has been a topic that, many generations have struggled with for centuries. The first amendment of the constitution states that “Congress shall make no law about our religious beliefs, or prohibiting our free exercise of religion” If we put our faith in the constitution to define the founding father’s standpoint of separation of church and state, then we have definitely misinterpreted their stance on religion. Many people believe the reference to separation of church and state is in the original constitution, but the truth is, the references, often conceptualized and misinterpreted as intertwining with our religious freedom, but that is not the truth.

Religion in Schools has proven to be a very controversial matter as of lately. Even though teaching about religion is allowed in public schools, there are still many questions that are being asked in order to provide a basis of what is appropriate for school, and what is inappropriate. America wastes a lot of time trying to create a democracy completely absent of the moral expectations that our ancestors have put into place. Our founding fathers’ dream of establishing a country in which all people would be accepted has begun to fall. In our attempt to rid our country of a democracy contaminated with any belief in a supreme power, we have rid ourselves of many of our values and morals. Perhaps it is impossible for religion to dominate our political country, but we have misinterpreted the original intent of “separation of church and state” and taken this concept too far.
