Good Grocer’s, Inc. is a large corporation that has expanded its retail locations from seven to twelve (7 to 12) over the last three (3) years. This is an example of the chain’s attention to quality, safety and service to its consumers. As the Assistant Human Resources Manager, it has been brought to my attention that a slip and fall incident occurred in one of our stores and we are being sued by an employee of “NEWSNOW”. The incident notes that a lady and her husband has alleged that she slipped and fell on a banana peel in our produce section and they are suing for bodily injury, medical expenses, loss of time on her job, pain and suffering. Good Grocer’s, Inc. currently has a policy in place that addressed the issues of safety for their employees and customers, (a copy of this policy is attached). In compliance with this policy, Good Grocer’s Inc., has implemented several procedures and forms that enforces and documents the daily setup, preparations and cleanliness of all areas of the store to ensure that it is a safe place of work and patron ready at all times. Good Grocer’s will attempt to show that the banana peel had not been on the floor prior to the plaintiffs coming into the produce area, and that because of the freshness of the banana peel, it could not have been there for any length of time, and could have been peeled and inconspicuously place on the floor by the plaintiffs to fake the fall. We also believe that any reasonable patron, exercising due diligence for his or her own safety, especially wearing five inch high heels, would see a banana peel on the floor, in front of them and take those steps necessary to avoid slipping on
In your report you mentioned there was smashed banana on the plaintiffs foot, did you also notice banana on the floor or on the mats? Furthermore, why did the banana display not have mats or carpet completely around it? The answer to this question would establish if there was banana on the floor and why the store only put slip mats in front and carpet behind the display. In addition, this question establishes the store did not safe guard the sides of the display.
I arrived on scene and made contact with Ms. Starla Cullison (Complainant), the Publix (Victim) manager, who stated the following in substance:

Dale also failed to follow company rules; Dale was supposed to watch a video that explained how to catch and deal with thieves but decided not to watch the video. The second defendant would be Dale’s supervisor. The supervisor recorded a pass on an exam that dale did not take. The exam Dale failed to write was based on the video that Dale did not watch. After reading this it makes me want to be a manager for Trader Joe's. There making a lot of money. But with the workers that work for them there given a lot of benefits with all the health, dental, vision and etc. Also they're given promotions from within philosophy because they're privately own. Also they tell there employees to try the produce so when someone has a question about something they can take them to something that is something there thinking about or better. Trader Joe’s has designed jobs to increase job satisfaction by showing appreciation in providing more benefits to their employees than other chain grocers.
