Brazil has a federal presidential republic. This type of government Brazil uses is almost the same as America’s. This is also known as a representative democracy. A representative democracy is a democracy which means that the government is ruled by the people. Along with the government, Brazil has a civil law system. The government works by giving power to individual parts of Brazil and let them self govern. In a federal presidential republic, citizens of part of the country can vote for their representatives. Then the representatives vote for the laws that the people want.

The purpose of this research is to investigate the possibility of secession within Brazilian legal order. The Brazilian Constitution ensures, explicitly, self-determination of people and, implicitly, territorial integrity. The guarantee of both principles generates an antinomy in Brazilian legal system since each rule implies in an opposite approach.
