Checks and Balances, put simply, is the process by which the federal government maintains equal power throughout the three branches (Legislative, Judicial, Executive.) The branches can keep themselves in check in several ways, such as: presidential veto, impeachment, overridden vetoes, judicial review of local, state, and federal laws and regulations. Checks and Balances just keeps any branch from maintaining too much power within the federal government. February 24 1868, Andrew Johnson is impeached. His impeachment was a direct consequence of his ‘high crimes and misdemeanors.’ Andrew Johnson fired and appointed a new secretary of war without first getting the legislature’s approval. After firing Edwin M. Stanton, Johnson had violated the
The American government has many powers that are given to, and checked by each branch. This is done by a system of Checks and Balances. The system of Checks and Balances states that the different branches have powers but the other branches have methods to stop each branches powers. But there are many argument that the system is broken or it isn’t. The system is broken because of many reasons involving the President, Congress and the Supreme Court.
“Congress met in 1868 and refused to agree in the removal of Edwin Stanton by vote. However, President Andrew Johnson refused to accept the Senate’s decision. He believed The Tenure of Office Act was unconstitutional. Hopeful in gaining judicial review of the Act’s constitutionality, President Johnson appointed General Lorenzo Thomas, General of the Army, to the post of secretary of war. Shortly thereafter, impeachment proceedings began.” (THE TENURE OF OFFICE ACT OF 1867)
Have you ever wondered how the government keeps each other from being too powerful? Well, that's what checks and balances are for. Checks and balances are made to limit the powers of the president. It stops presidents from choosing cabinet members and supreme court judges, this is important because if he could then he can pick his supporters to take that job and if that happens then all the members would always agree with him. He also can’t make laws, declare war, decide how federal money is spent, and interpret laws.
The checks and balances was the separation between three branches, it prevented any one branch from having too much power by checking on each other. Doc C is an excerpt from Federalist Paper #47, written by James Madison. This excerpt is about how the three branches should be divided and arranged into several offices, so that they have the opportunity to check on each other’s powers. According to Doc C, “...(The three branches) should not be so far separated as to have no Constitutional control over each other.” James Madison, provides an explanation that if all citizens wanted liberty in this country, the three branches would need to be separated: the Legislative, Executive, and Judicial branches. The Legislative branch can impeach the president and the judges from the Judicial Branch. The Executive Branch can nominate judges and veto Congressional legislation. Lastly, the Judicial Branch checks the Executive and Legislative Branch by declaring acts and laws
According to James Madison, “…the constant aim is to divide and arrange the several offices in such a manner as that they may be a check on the other … the three branches should not be so far separated as to have no constitutional control over each other.” (Doc. C). This means that the three branches can check on each other and keep each other balanced and that the powers among each branch is equal. In the constitution it states, “that court can declare laws unconstitutional.” (Doc. C). This is an example of how the judicial branch can check the legislative branch so each branch has a way to check the other branches. The system of check and balances guards against tyranny because without a system of checks and balances, one branch of government may become overpowered and there may be a
As you may know, our Founding Fathers created our government and the Constitution. They had put together a system of government where it was split into three branches: the Executive, Legislative, and Judicial. This was so not just one person or one specific group of people would have all of the power. Now, that’s where checks and balances comes into the picture because it’s when each branch checks the other two for unconstitutionality or any wrongdoing Checks and balances have created a limited form of government by taking control of the President’s war powers and and term limits. Also, it has separated certain powers to certain branches, for example, the Legislative branch doesn’t have the powers the Judicial branch has, and the Executive branch doesn’t have the same powers the Legislative branch has.
Checks and balances is a system that prevents one branch from having too much power, and giving each branch some power over the others. Doc C is an excerpt from Federalist #51, that was written by James Madison in 1788. The federalist papers were written by John Jay, James Madison, and Alexander Hamilton, to convince the states to ratify the constitution. According to Doc C, “... the constant aim is to divide and arrange the several officers in such a manner as that they may be a check on the other…. (The three branches) should not be so far separated as to have no constitutional control over each other.” The quote from Doc C shows that each branch should have some power over one another to ensure that not one branch becomes a tyrant. The constitution guards against tyranny through checks and balances, which lets each branch check each other on their actions, and stop them if they are abusing their
Some examples of checks and balances in the Constitution occur in situations; such as when Congress has the authority to provide justice to the federal courts. The president has a discussion with federal judges about the information gathered from the Senate and their recommendation. Therefore, the three branches of government all have an opportunity to provide their viewpoint on how justice should be served in each federal court case. Checks and balances occur when the executive branch is in charge of foreign affairs, but treaties that deal with foreign governments need to be discussed with the Senate. Thus, the executive branch and the legislative branch have to communicate about decisions that relate to foreign treaties and come to an agreement.
To prevent from one branch of government having all power, and therefore having tyranny, (Madison FP # 47) Checks and Balances was added to the defenses of the constitution. There are three branches of government: Legislative Branch (Congress), Executive Branch (President), and Judicial Branch (The Courts). These three branches work together to check one another to make sure the power is evenly distributed and balanced, hence the name Checks and Balances. The way it works is that the Legislative Branch (Congress) can check the Executive Branch (President) by approving Presidential nominations, being able to override a President’s veto, and can impeach the President, him or her, from office. The Legislative Branch can check the Judicial Branch by having Senate confirm Presidential nominations and by being able to impeach judges and remove them from office. The President can check the Legislative Branch by vetoing Congressional legislation, and can check the Judicial Branch by nominating judges. The Judicial Branch can check the Legislative Branch by declaring laws unconstitutional, and can check the Executive Branch by declaring presidential acts unconstitutional. (Madison FP # 51) All three branches of government work together to make sure no branch is abusing their limited power, by using the system Checks and

Tyranny, a cruel and oppressive government or rule. This could have been our government’s reality as it was slowly drifting towards becoming a tyrannical country. However, only thing that prevented our government from becoming a tyranny was the Constitution. In 1787, the Founding Fathers met and established the Constitution, because the Articles of Confederation wasn’t working out. The Constitution was created and used to prevent tyranny throughout the government by trying many solutions, which worked well.
Checks and balances is a system that helps balance out the three branches so that there won't be too much power among just one system but distributed and can also work together to support each other the

The system of checks and balances is important because it is used to make sure that one branch of the government does not have too much power over the other branches. The system of checks and balances allows one branch to check, or limit, the power of another branch. The three main branches of government are the Executive, Legislative, and Judicial. Each branch of government is balances and has its own set of roles and responsibilities. The legislative branch creates laws. The executive branch enforces laws. Lastly, the judicial branch interprets laws.
The checks and balances were mostly about how each branch of government can limit the power of the others. In other word it stops the branches from getting too powerful then the others. On document B I learned that the why the Judicial branch is the court.the legislative branch is the congress and the executive branch is the president. One why the congress checks on the president is by approving nomination. One why the congress checks on the court is by impeaching the court. One way the president checks on the congress is by vetoing a legislation. One why the president checks on the court is by nominating judges. Also one why the court checks on the president is by declaring acts of unconstitutional. One why the court checks on the congress is by declaring laws unconstitutional. Check and balances is a reason why the constitution should be ratified because it stops the branches of government to become too
