Humorists: The First Amendment Of The United States

No, the constitution states that only our legislative branch is prevented from abridging free speech. In fact the further we move from government the less free we are. For example an employee disagree and cusses in a workplace he or she has no constitutional protection and will be fired. This is because the First Amendment has no control over limits on speech you set where you or others make the rules. This does apply at a state level for schools and even at a district level.

A very popular constitutional issue in America is the First Amendment. The First Amendment is meant to protect, but in today’s society it is being questioned that the argument is being overly used. The First Amendment of the United States Constitution protects the right to freedom of religion and freedom of expression from government interference (Esmaili). Freedom of religion created the separation of church and state. It prohibits the government from interfering with a person's practice of their religion. The right to freedom of speech allows individuals to express themselves without government interference or regulation. The right of freedom of expression gives the right to assemble and gather for peaceful and lawful purposes. It was adopted into the Bill of Rights in 1791. The Court later interpreted the Due Process Clause of the Fourteenth Amendment as protecting the rights in the First Amendment from interference by state governments. Putting this is layman’s term, you can pretty much say what you want without being penalized.

Modern society allows humorists to touch upon offensive topics without receiving much criticism. As Alain de Botton claimed in his 2004 book, Status Anxiety, humorists’ role is not merely to entertain but “to convey with impunity messages that might be dangerous or impossible to state directly.” De Botton’s argument proves legitimate. Many humorists, such as cartoonists and television hosts, decide to use their humor as a tool to prove an idea or express a belief that cannot be voiced candidly in public.

The First Amendment one that is watered down, serves as example of the freedom we as Americans have. It is best known as the amendment that lets us say what we want when we want. There is more to it that gets overlooked. It blocks government from establishing a theocracy, grants the people the right to peacefully assemble and protest the government for a redress of grievances. Our press is independent and is given freedom to publish at will. Our freedoms embolden us to speak out and organize for progress and against society's wrongs. Sometimes groups will organize to speak out but will sink to extreme measures as a means of expression. The first amendment has seen challenges in recent months. “Donald Trump referred to the press, and I'm quoting his exact words, as "dishonest, disgusting, and scum."Just ten days ago, you might have heard in a press conference, President Donald Trump said that the "press is out of control."(Chemerinsky, 553). To clashes between different ideologies on college campuses with some initiating riots. The first amendment grants many freedoms, however it does not grant protection from consequence.

The First Amendment, in substance, does not provide absolute protection for all forms of speech, press, assembly, petition and association. It is not absolute. As a balance for interest of speech against competing government interest, an evolution of balancing tests were created and modified by the Supreme Court hence the Free Speech Clause.

Free speech shall not incite evil and hatred in this country. The First Amendment prevents the government from infringing upon our freedom of assembly and speech. “The disability is so complete that Congress is expressly forbidden to enact laws respecting an establishment of religion, or laws abridging the free exercise of religion, freedom of speech and press, and the right to petition the government” (Bybee). As a whole, our founding fathers only had good intentions with regards to First Amendment rights in America.

This is the text of the first amendment to the U.S. Constitution, and in forty-five short words it has protected, will protect, and protects the basic freedoms of American citizens for years. They represent everything the American Revolution was fought for. Even if the founders were a bunch of petty, hypocritical white men who had the wrong ideas about most things (read: slavery, women's rights, LGBTQ rights, fashion, and more) , they did something right when they wrote this. The first amendment guarantees a true government by the people. If the citizens believe the government to be wrong, we have the right to change it, the right to speak out against it, and the right to use the press in favor or against the cause. People always say that laughter alleviates tension. If this is the case, then it makes sense that the use of humor when discussing uncomfortable topics can make the conversation easier and more light-hearted. One of Mark Twain’s most frequently used devices in works such as “Advice to Youth”, “To the Person Sitting in Darkness”, and The Adventures of Huckleberry Finn is satire, which can provide society a method to bond over uncomfortable topics, and facilitate the ability to sustain that bond through an easier way to create discussion.

The First Amendment states Congress will have no right to prohibit or create laws against free speech, press, or religion. This documents in written word that all forms of speech and press are legal in the United States. Therefore,

The First Amendment states that “Congress shall not create laws that abridges the freedom of speech and the freedom of press (Cite).” The freedom of press is a constitutional protected right that allows individuals or media outlets the right to publish information without the government censoring the information or fear of being punished. This protected right is applicable to all forms of printed and broadcasted information, such as newspapers films, or television broadcasting.

The first Amendment of The United States Constitution gives everyone the opportunity for freedom of religion, speech, press, assembly, and petition. Despite, the United America living by the the value that everyone has freedom of speech and equal opportunities, the first Amendment should be limited because it can uphold national security and general hostility. As this already occurred in our nation’s past, with the Red Scare which led to Schneck vs United States in 1919, and the second Red Scare that led to the McCarthy era and Dennis vs the United States in the 1950s. Our nation already had a history of the first amendment causing scrutiny in a stressful time. History cannot repeat itself, as it is a must that freedom of speech and press must be limited , while our nation goes through a drastic time for the sake of the American people and the United States of America.

However, the first amendment is what protects the right to freedom of expression. The first amendment

The founders of the United States wrote protections into the Constitution and established the government in such a way as to prevent tyrannical leaders from censoring others’ viewpoints. The First Amendment states, “Congress shall make no law…abridging the freedom of speech, or of the press”. This amendment guarantees free speech, and censorship is a direct violation of the First Amendment rights promised in the Constitution. There will inevitably be issues of controversy among people and stances that the majority finds incorrect. However, the purpose of the First Amendment is to give everyone the opportunity to speak his or her ideas and opinions, no matter how controversial.

Justified by the Supreme Court, not all speech is allowed by the First Amendment due to the risk of interrupting peace and causing violence. [3]

As humans, laughing and joking is something that comes natural. This is something that we have been doing even before we knew how to walk or talk. As we start to grow up, we all develop personality traits and our humor styles follow. Before taking this course, I have never consider identifying what my humor styles are until now. I took the Humor Style Questionnaire (Martin et al. 2003) and calculated that my top humor style is self-enhancing and closely following is affiliative. Throughout this paper I am going to reflect on my top humor styles with personal examples, and how it relates to my mental health, with several methods I can use to make myself healthier and happier. I will also be considering the other two styles and how then do not relate to my humor style and mental health.
