Kimbrough Case Study

On 010/05/2016, I, Chad Agnew, was working as a patrol officer for the Wichita State University Police Department, in Wichita, Sedgwick County, Kansas. At approximately1415 hours, officers were dispatched to the Rhatigan Student Center for a suspicious character. Dispatch notified all officers that they were still gathering more information at the time but the suspicious character was a black male with crutches. They also said the subject was yelling someone had a gun.

On 11/6/2017 at 1400 hours, I Officer Graves, responded to 735 E Haggard Ave Elon, NC 27244 in reference to an assist. Upon arrival Detective Turney, Lieutenant Sweat, and Officer Peters were at apartment K executing a search warrant. I was requested to remain outside of the residence at the front door. At 1426 hours Captain B. Tillotson entered the residence and left at 1441 hours. At hours Officer Peters released Jacy Loshin from the premises after issuing a citation. At 1455 hours Officer Chavis entered the residence and remained until the search warrant execution was completed at 1530 hours, when all remaining officers cleared.

On Thursday, 05/18/2017, at about 9:27 p.m., partner Officer Griffin (#3135) and I were on uniformed patrol in a marked patrol vehicle (Unit #21) as 3A21. We were dispatched to an injury traffic collision at Lake Ave. and Maple St. Upon our arrival, we saw three vehicles that appeared to be involved in a traffic collision. While we were assisting with the scene, we saw Victim Captain Konrad struggling with the suspect, later identified as Kevin Hendrix. Officers Griffin, Riehl (#7454), Spatz (#8058) and I grabbed Suspect Hendrix and took him to the ground. I placed properly adjusted, double locked handcuffs on Hendrix. Officer Griffin and I placed Hendrix in our patrol vehicle.

On Saturday, September 12, 2015, I was assigned to the 6 Northwest as the security officer. At approximately 0500 hours while breakfast trays were being distributed in pod 100, an inmate, later identified as Kimmie Hawkins became insolent and advised me to get out of the pod. I immediately asked him whom he was talking to and simultaneously walked over to him to view his armband. As I reached for Inmate Hawkins’s left wrist, he snatched away from me, got in a boxing stance, and began bouncing rhythmically on his toes. Therefore, I retrieved my T.A.S.E.R. from its holster and gave Inmate Hawkins loud verbal commands to get on the floor. However, he refused to follow my orders; therefore, I pushed him toward the wall and continued to instruct

On August 11, 2017 Police Officer Lawrence Lezewski, DSN 11428 manning vehicle 2426 and I (Probationary Police Officer James Harris III, DSN 0513) manning vehicle 2425 received a radio call for an “Assault” at North Broadway and Salisbury Street on a Bi-State Bus. Upon our arrival, we were met by victim Eddie Dickens and witness Willie Penson (Bi-State Bus Driver), who stated the following:

On Tuesday, September 29, 2015, I, Officer B. McMillon, #135, of the Mansfield ISD Police Department was on assignment at Legacy High School located at 1263 N. Main in Mansfield, Texas 76063. While leaving the 2nd floor AP’s office, I observed Smith, Taylor W/F, D.O.B. 09101999 slap Wells, Sydney W/F, D.O.B 08291999 in her face and they begin to engage in a physical altercation.

On Monday, 11/30/2015 at approximately 1755 hours, Officer Lauritzen and I responded to intersection of Holt Blvd and Plum Avenue to assist Sergeant Ortiz to subdue a suspect who was fighting him. Upon arrival, I saw other OPD officers trying to handcuff the suspect, later identified as Kevin Larry. Larry was on his stomach and he was yelling that he did not do anything. Larry was resisting arrest by turning his hip side to side and was trying to pull his hands to the front of his body. Larry was grabbing our handcuffs and he was not letting them go after being told to let go. We told Larry to not resist arrest and stop fighting. He refused and we forcefully pulled his hands from his sides and placed them behind him. We handcuffed him and he

Patrol officers arrived at 518 N. K Street and surrounded the house. Patrol officers called the victim and the suspect out of the house. The suspect was taken into custody without incident.

On Sunday November 24, 2016 at approximately 16:02 hrs. Officer L Wilkerson and I Ofc. R. Holcomb were dispatched by dispatcher B Coleman to 304 Hopkins Drive in reference to a disturbance. Upon my arrival I made contact with Ms. Shawntavia Lucky (complainant) who stated that her son Mr. Jousha Lucky (victim) got into a physical altercation with two black males.

On Thursday, July 14, 2016, at approximately 0847 hours, Patrolman David Stamets had a vehicle stopped on the 100 block of East Oak Street. Immediately after Stamets stopped the vehicle Your Affiant positioned his vehicle on the 100 block of South White Street near the Oak Street intersection facing southbound. When exiting my vehicle your Affiant observed a gold Pontiac sedan accelerating northbound on South White Street at an unsafe speed towards Stamets and your Affiant's location.

At approximately 5:28 p.m., I arrived on scene and was briefed by Officer Nicholson. I was provided with the name of the victim Amanda Holmes (white, female DOB 10/17/1982). Officer Nicholson advised me that the victim was last seen by her roommate at approximately 12:00 a.m. I then spoke to the roommate to obtain consent to process the residence.

Back on October 3, 1974 at approximately 10:45pm two Memphis police officers were on patrol and received a complaint from dispatch to respond to a burglary in progress (Tennessee v. Garner, 1986). Officers Leslie Wright and Elton Hymon took the call and responded to the location in question (Tennessee v. Garner, 1986). After arriving, a neighbor told the two officers she heard glass breaking next door and “they” were breaking into the home (Tennessee v. Garner, 1986). While officer Wright radioed back to dispatch the situation, officer Hymon proceeded to the backyard of the home (Tennessee v. Garner, 1986). Hymon then heard a door slam and seen a person running across the lawn towards a chain link fence, later identified as Edward Garner

He further stated that he initiated an incident command system. Officer Carosi, JoAnna COIII corroborated that Officer Sifuentes was left the food service area with the back door key and she was looking for the key before he found Offender Wilcox in pains and drew attention of Officer Dooh. In his statement, Officer Jaure, Roland COIII admitted that he was outside the Food service department/Kitchen with Officer Sifuentes when the incident took place. While Officer Sifuentes-Gomez, Jorge COIII concurred with Officer Jaure that they were both outside the food service/ Kitchen when the incident took place. Food service Manager (FSM) Martinez, Enrique could not provide answers on while his two officers were outside the kitchen while the incident lasted and mere stated that 3rd shift cooks usually come out on their own and insisted that he never called any 3rd shift cook out. When asked if why Offender Greer a third shift kitchen helper was found in “his” Kitchen before 1800hrs he had no answers beyond what he provided in his terse statement.

On Friday, August 12, 2016 at approximately 1000 hours, I assisted the patrol division in locating a burglary suspect that entered the residence of 1023 Barn Oak Court. The complainant/victim Nicole Smith stated to the Conyers Commutation that when she entered the front door of the residence, she heard an unidentified noise in the back bedroom. As she entered the rear bedroom the subject exited the residence through the rear window.

On 08/20/2017 at 1002 hours FTO Wheeler #4361 and I responded to St. Luke’s Hospital emergency room entrance, on 3555 Cesar Chavez St., regarding a women in a hospital gown trying to break the caller’s vehicle window with a brick. Officer Wheeler and I were in full police uniform driving a marked patrol unit when we responded.
