As with any kind of business formation, there will always be, to some extent, negative aspects associated with the creation. To this date there is no perfect form of business entity. When deciding on which entity is best suited for a business, there are many things to be considered. Prior to deciding on a business structure, some major points to be thought about are both the legal and tax ramifications associated with the entity chosen. Another criteria that should be considered are the costs connected with the entity type. These cost include the cost of formation as well as any continuing administrative cost that may be incurred. The social security taxes, which are currently at a rate of 10.4% and Medicare taxes which is currently at a rate 2.9%, total 13.9% down 2 percent from the previous year. This decrease in the self-employment tax rate is due to the 2010 tax relief act past by Congress. (Internal Revenue Service, 2011)

A Social Security tax is paid on the first $106,800 of income that is earned but anything thereafter is not exposed to this tax. Taxes that are paid in for Social Security are most commonly known as going towards old-age benefits that are received when retirement age is met. It also goes towards survivors, such as the spouse or young children of someone who has passed, and disability insurance. The taxes paid in for Medicare go towards the medical insurance of those who are over the age of 65 or those who meet other decisive factor. The Medicare portion of the self-employment taxes is not subject to any restriction on earnings and as a result all earning will be accountable for this tax. (Internal Revenue Service, 2011)

Breaking down self-employment tax can be classified into two realms. First being in the form of an individual’s income derived by their trade or business and the second being the income or loss by the individual’s partnership of said trade or business.
