What do you think of the Court 's decision in this case? Does it make sense to you? Why or why not?
In this case the court ruled in favor of the transportation agency. Due to Affirmative Action the agency had a plan to “achieve a statistically measureable yearly improvement in hiring minorities and women throughout the agency in all major job classifications where they are underrepresented” (Bennett-Alexander, D., & Hartman, L. P.). During the time of a promotion a woman was promoted with a score of 73, which was lower than Johnsons score of 75. In turn the promotion was given to the female. I do not agree with the court’s decision regarding this case. The ruling did not make sense to me because I felt that the court missed out on comprehending key facts. As an example, the Director of the agency stated that he did not the significant fact that Johnson scored 75 while the woman applicant scored 73 (Bennett-Alexander, D., & Hartman, L. P.). This stuck out to me because it seems as though the Director did not thoroughly view the qualifications of each applicant. I feel as though the female applicant was favored, because of Affirmative Action and her sex. The decision of the agency was also influenced by the promotion position of a Road Dispatcher, a dispatcher role is usually done by women.
