Women for years have been automatically given the role of the domestic housewife, where their only job is to cook, clean, and take care of the children. Men have usually taken the primary responsibility for economic support and contact with the rest of society, while women have traditionally taken the role of providing love, nurturing, emotional support, and maintenance of the home. However, in today’s society women over the age of sixteen work outside of the home, and there are more single parent households that are headed by women than at any other time in the history of the United States (Thompson 301.)

Put another way, in 2017 one can imagine very few gender-based distinctions in a statute that would not be intended to be discriminatory. Any valid gender distinction would surely pass the test of strict scrutiny. Simply stated, any statute or government action that draws a sharp distinction between the two sexes entirely should be presumptively unconstitutional unless there is sufficient reasoning as to why the distinction should exist. To understand why gender should be a suspect class, it is useful to examine the Supreme Court precedent regarding gender discrimination cases.

The Indian Act is still considered to be an extremely invasive and historically paternalistic piece of legislation in that it gives the Canadian federal government the authority to regulate important aspects of aboriginal life that were once governed by the aboriginal people. Throughout our world’s history we have seen many grievous instances where discrimination caused severely negative repercussions on how our society functions. The inequity demonstrated by our nation in the past has estranged its residents based on their religion, the color of their skin, their beliefs, and even their gender. With time, our community has become more accepting which has led to the abolishment of most, if not all, bigotry and racist beliefs. However, there is still an issue today that we have been facing for almost a century. This conflict has led to the prohibition of certain people obtaining a particular job in some cases, and the penalty of being paid less than her male colleagues if she were to obtain that job.
