Why Prostitution Should be Legalized
Nevada is the only state in America that has legalized prostitution, however, in the 19th century there were no laws against selling your body for sex. (Grant). Laws against prostitution are new, only about a hundred years old. Many of the first women that settled into the New World sold their bodies as a source of income. In order to regulate and control prostitution there were places called Red-Light Districts. There were many red-light districts across America, in which commercialized “sex is isolated, encouraged, or both” (Grant). A local Brothel in Pahrump, Nevada have their workers “pay $46 a day in rent and sleep in the rooms, nightly and then take 50% of their makings”, as described by Business Insider’s Dylan Love. If legalized, the sex workers will have the freedom to plan their work schedules that are convenient for them. In many legalized brothels employees “report that they feel safe, are free to come and go, and are bound only by their contract.” (Brents). Unlike working on the streets filled with violence, sex workers will now have a safe working environment. Sex workers will not be controlled by their pimp and have most of their earnings taken away from them. There will always be someone who is looking to buy sex and there will always be someone who is willing to rent his or her body. In America prostitution is looked at as degrading to women, however most women who are sex workers are working willingly. These women go to work everyday just like anyone else trying to make a living. If sex workers want to sell their bodies for money, who are we to dictate what a person should or should not do with their body. Two consenting adults paying for sex should not be considered a crime. Prostitution has been illegal for far too long and it’s time to legalize this part of American life, even if many people are on the fence about it. There are more important crimes that our government should be focusing on, like the selling of drugs, vandalism, robberies and many more, rather than prostitution. There have been pass laws that have ignited controversy, but by looking at the big picture legalizing prostitution would be better than keeping it illegal. VFW Post 9528 in Buckhead Ridge recently elected a new commander, and in doing so, became one of only seven posts in the state of Florida to ever elect a female commander. Patricia Yount is not only the first female commander of Post 9528, she is also the first in District 11, which includes Lake Placid, Fort Pierce, Jenson Beach, Vero Beach, Sebring, Stuart, Hobe Sound, Sebastian, and Okeechobee. The Veterans of Foreign Wars opened its membership to women in 1970, but men still outnumber women by a huge number. Commander Yount explains that her post has 313 members, and only four of those are female. She is working on ideas to attract more women, and hopes to implement them in the near future.
There are some who are opposed to the legalization of prostitution stating it’s immoral, a matter of free choice or because of religious beliefs. Well these are all personal beliefs that although valid people will never reach a concise consensus on. The only resolution is tolerance. Sex is a matter of free choice and a woman should have the right to choose whether or not to become a sex worker and not be judged harshly because of it. This article offers a lot of key information that the reader can learn from. My analysis will show the author’s position on legalized prostitution, misconceptions, problems and my analysis on legalizing prostitution, based on the information, learned from this study.
Patty Kelly’s article, “Enough already, it’s time we decriminalize prostitution”, takes the reader into a fascinating behind the scene look into one of Mexico’s legalized brothels. Although it is apparent that her research and investigation into this social experiment are well defined, it is too narrow a focus to gather all the required information to support her argument. Kelly begins with a half hazard analysis of Elliot Spitzer infidelity, then continues down the path that is far too laser like to see the overall effect on these women; failing to see these prostitutes as real people with hearts and souls. Instead, she produces an impression that the prostitutes are just commodity, bought and sold on the open market, lacking feeling
To assume that it can be removed from society is harmful and a waste of our resources. Offering a safe environment for prostitution makes the most sense by allowing the “profession” to continue legally minimizing the dangers that are currently attached. Knowing that legalization offers prostitutes equal access to health care, protection by law enforcement, and decreased risks of human sex trafficking make the argument of legalization clear. It used to be legal in Rhode Island due to a loophole, but since 2009, it has been illegal 1. Women are not the only ones who are prostitutes, about 20 to 30% of prostitutes are male 2, which means both genders are affected by laws against prostitution. Men and women should be allowed to choose how they want to use their bodies how they wish, and that includes prostitution.
The legalization of prostitution has been a compelling two sided argument for many years. When morals and reasoning combine, it is often hard to come to one solution. Prostitution is considered to be a serious issue in countries around the world. The amount of prostitution has been increasing tremendously every year and it seems to be getting more serious than the past centuries. The government has legalized prostitution in a few countries and people are wondering if this will become an all over the world thing. Many believe the illegalization of prostitution today to be an antiquated view of the trade, and want to see it legalized. However, prostitution should not see legalization due to it will promote more sexual unacceptable activities such as child prostitution, expand the sex trafficking trade, and escalate poor treatment to those in the trade.
It is safe to say that legalization would bring a safer environment for the prostitutes themselves. Second, to address the immorality concern, I have to argue that from a freedom perspective, why should two consenting adults be barred from engaging in copulation in the United States of America. Why should it be illegal to sell something that it is legal to give away? Instead of letting big government overreach dictate how people can do business and conduct their own private affairs, it seems to me the smarter and more moral option to improve general health and general safety by legalizing prostitution.
In the United States, with the exception of Nevada, prostitution and sex work is illegal. If taxed and regulated, it can bring more benefits not only to the economy but to smaller aspects as well, such as health care and crime rates as opposed to keeping it illegal and penalizing it. Therefore, prostitution and sex work should be legalized in the United States. Prostitution is viewed as bad thing within society, morally; yet the many benefits are often not spoken of, which are that prostitution would lower sexually transmitted diseases and crime rate all while improving health care and the economy. Prostitution is legal within 61 countries, 22 out of the 25 safest countries to live in prostitution is legal according to Procon.org and worldatlas.com.
Whether or not the United States should legalize prostitution is a highly debated social, political, ethical, and cultural issue. Prostitution by definition is to engage in sexual activity with someone for payment. Although many countries and even some rural counties in the U.S. have legalized prostitution, it still has dire effects on the women involved and is an immoral and exploitative act. Prostitution is an unethical and immoral act of exploitative, degrading, and abusive work that the United States should not tolerate. The abolition of prostitution is a legal approach with proven positive results that could dramatically reduce the amount of illegal prostitution and human trafficking taking place in the United States.
