Chapter 1: Introduction The United States criminal justice system have been known to be one of the most injustice system in the world. Criminal justice is known as the system of law enforcement, involving police, lawyers, courts, and corrections, used for all stages of criminal proceedings and punishment (Dictionary.com). Another reason why people are wrongly convicted for a crime they did not commit is false confession from the victim of anyone that say they say what went on during the crime, and so bad lawyering. Sometimes the lawyer over looks many things during the case or most often they are more than likely not prepared for the case at all. An innocent person is described as “free from guilt of a specific crime or charge" (Dictionary.com). Jospeh Abbitt is an African American Male that was convicted for a crime he did not commit in 1995, he was thirty-one years of age at the time. “The biggest crime in the U.S. criminal justice system is that it is a race-based institution where African-Americans are directly targeted and punished in a much more aggressive way than white people”( Bill Quigley). There is a proven fact that African Americans in the United States are easily targeted when it comes to crimes. Why is this the case? The answer is simple African Americans have always been looked down on, never looked as a human, or never looked as if they have any worth in this nation so of course it is easy to make them a target. When you ask people what freedom is they may respond that freedom is when you can do whatever you want to do at whatever time. Mostly this will be the response of kids and young adults. But this definition of freedom is incorrect. Freedom is when we are allowed to have power of right to act without violating other people's freedoms or rights. The most effective tools for establishing and preserving freedom are strong government and constitution. A quote that can help out the claim comes from the Declaration of independence “We hold these truths to be self evident: that all men are created equal: that they are endowed by their creator with unalienable rights, that among these are life, liberty and the pursuit of happiness”.
American criminal justice system is a system of practices an institution of governments directed at upholding social control, deterring, and mitigating crime, and punishing those who violated laws with criminal behavior and rehabilitation efforts. Furthermore, executing people is an effective way of crime control policy. To the best of knowledge, there are no hidden costs that undermine its effectiveness.
We the people of the United States depend on the Criminal Justice system to prevail and never fail its citizens. Criminal Justice System is the ideological institution responsible for the protection, preservation of, and adherence to the civil rights and civil liberties expressed within the Constitution of the United States. The Criminal Justice System is obligated to defend, and uphold the legal rights of citizens in the event of the suspicion of criminal activity, the investigation process, and protocols within arrest and or sentencing. Additionally, you made an excellent point though discussing Life, Liberty, and the Pursuit of Happiness because these prospects weren’t always afforded to African Americans, Native Americans, and lastly women within that era. Despite that, Jefferson had the intention to incorporate the rights of African Americans, Native Americans, and finally women; however, with each reiteration of the article through individuals like Benjamin Franklin and John Adams, it lost its true intention of equality for all. The criminal justice system is based on laws that are arbitrary and operate to the disadvantage of the poor and come across as law for the poor rather than law of the poor. It applies on the weaker sections of the community, regardless constitutional guarantees to the contrary.
Since the founding of America, ideas of freedom, liberty, and democracy have been the priorities of Americans. Many people have sought religious freedom in the colonies which led to the founding of other colonies which turned into states. The new world was supposed to be a land of freedom, but many African Americans faced hard lives here. The revolutionary war helped bring an end to slavery and it caused the many whites to challenge black slavery because of revolutionary principles of liberty and equality. Many whites grew hostile to slavery and many blacks submitted petitions for freedom and began to get opportunities for freedom. The war also helped more than 50,000 African Americans gain freedom. In dealing with slavery, the white Americans denied that their revolutionary experience should embrace black emancipation. Moses Sash and other African Americans refused to accept white authority, and kept the dream of freedom alive. In the North, most states ended slavery between 1777 and 1784. Although a majority of northern whites agreed that slavery was unable to match with the revolutions commitment to natural rights and human freedom, they refused to sanction a sudden emancipation. The laws ending slavery in the northern states only allowed children of slaves to be freed when they reached adulthood. Criminal Justice System is a system established by the government to control crime and impose law and order through various set of agencies and procedures. In the CJS governments are meant for the maintaining the order of social control, deterring the criminals and mitigating crime, or sanction those who are violating laws with criminal penalties, prevent occurrence of crimes and rehabilitation of the victims. Criminal Justice system works differently in different areas depending upon its jurisdiction. It’s an instrument of social control, in every society there are certain acts considered to be so dangerous and destructive that there always mechanisms to control or not allow them to happen.
Criminal justice is the system where criminals and crimes are discovered, detained, tried and punished (Roufa, 2017). The criminal justice system in the United States originated and came from the England jury system. The United States system was very similar to France's and England's systems and is where a lot of these ideas came from. Even though, the jury system in colonial America took after the jury system used in England, colonial juries eventually disliked the British crown for returning verdicts that appeared hostile to enforcement of British laws. Many ideas did come from England but, the United States during the 18th century, developed the classical criminological theory (Mahoney, 2015). There are many aspects to the criminal justice system but, a major component that helps make it run as smoothly as it does is the police.
The criminal justice system is the part of the judicial system that is responsible for maintains social control, reduce the crime, rehabilitating people and applying the criminal law and accusing those who violate it. It is also used to impose rules of conduct to protect the community. The criminal justice system consists of three parts; law enforcement, adjudications and corrections. These components of the criminal justice system are interrelated and necessary to achieve a common goal. A case begins when law enforcement officials begin collecting evidence to identify the person responsible for violating the law. The next step continues with the judicial system where the evidence is assessed to determine if the defendant is guilty beyond reasonable doubt. Finally we have the corrections system in which it will be decided what will be the process to follow, imprisonment or freedom. At the end of the whole purpose is to ensure respect for the rights of the accused and convicted.
