The judiciary is independent of the executive and the legislature, though the executive maintains a certain level of influence in the appointment of judges to the courts.
The Constitution of Malaysia is codified and the system of government is based on the Westminster system. The hierarchy of authority in Malaysia, in accordance to the

In early September 1998, Prime Minister Mahathir bin Mohamad dismissed Deputy Prime Minister Anwar Ibrahim and accused Anwar of immoral and corrupt conduct. Anwar said his ouster actually owed to political differences and led a series of demonstrations advocating political reforms. Later in September, Anwar was arrested, beaten while in prison (by among others, the chief of police at the time), and charged with corrupt practices, in both legal and moral contexts, charges including obstruction of justice and sodomy. In April 1999, he was convicted of four counts of corruption and sentenced to six years in prison. In August 2000, Anwar was convicted of one count of sodomy and sentenced to nine years to run consecutively after his earlier six-year sentence. Both trials were viewed by domestic and international observers as unfair. Anwar's conviction on sodomy has since been overturned, and having completed his six-year sentence for corruption, he has since been released from prison. In the November 1999 general election, the Barisan Nasional was returned to power with three-fourths of the parliamentary seats, but UMNO's seats dropped from 94 to 72. The opposition Barisan Alternatif coalition, led by the Islamic Party of Malaysia (PAS), increased its seats to 42. PAS retained control of the state of Kelantan and won the additional state of Terengganu.

Every country differs in their preference of political system to govern their countries. For democratic countries, two possible choices of governing are the presidential system and the parliamentary system. Since both the presidential and the parliamentary systems have their own strengths and weaknesses, many scholars have examined these two forms of government, and debate on which political system is more successful in governance. In this paper, I will first provide a detailed analysis of both the parliamentary and the presidential system. I will also evaluate each system’s strengths and weaknesses, addressing any differences as well as any commonalities. Finally, I will conclude by using historical examples to analyze and support the
The best government is a Republic government. A Republic government is also known as a direct democracy. It is very effective and works smoothly. The people are big part of the government, because they vote on a leader to represent them and make decisions for them. This way of democracy is amazing because of how the people are such a big part of it. Another interesting fact is that the first Republic was the Roman Republic. The Roman Republic was an impressive system that lasted for 500 years. It was impressive because it had three branches, the Magistrates, the Senate, and the Assemblies and Tribunes. The Magistrates were elected officials who enforced laws and judged cases. The Senate are wealthy citizens who helped pass laws and controlled
There are numerous ways to improve the Malaysian electoral system both in fairness and efficiency. Currently, there is a lack in confidence in the validity or neutrality of the Electoral Commissions (EC). Members of the EC are elected by the Yang di- Pertuan Agong (YDPA) after discussing with the Conference of Rulers (Legal Research Board, 2013). However, according to Article 40 the YDPA can only act after receiving advice from the Cabinet or a Minister representing the Cabinet (Legal Research Board, 2013); in most cases it would mean the Prime Minister. Hence, it may seem that the politically neutral EC were to be pro-government. A solution to this problem would be to amend the Constitution so that the House of Representatives can debate on the nomination of the EC members, then their decision would be passed on to the YDPA. By doing so, the EC would comprise of members that have the approval of both the government and opposition, thus making the committee fairer. Aside from that, the EC should manage its own budget, and should be reviewed by the Auditor-General and not be dissected by the Parliament.

The parliamentary system is a system of democratic governance wherein the executive and legislative branches of the government are intertwined and are lead collectively by a Prime Minister who must have been proven to be competent and capable, as chosen among his party members. However, the Philippines is currently under the presidential system, also a system of democratic but republican governance, which is led this time by a president, and wherein there is a separation of powers between the executive and the legislative. In the presidential system, people have the collective power to vote for the president.
Parliament - Parliament is pretty much the identical to the legislative branch here in the US. The prime minister is accountable in his actions to the parliament. The parliament consists of the house of lords, house of commons and monarch.
The parliamentary system, unlike the American presidential system, is recognizable by a fusion of powers between the legislative and executive branches. The Prime Minister, who is the chief executive, may be elected to the legislature in the same way that all other members are elected. The Prime Minister is the leader of the party that wins the majority of votes to the legislature-either de facto, or in some cases through an election held by the legislature. The Prime Minister appoints Cabinet Ministers. However, unlike in the presidential system, these members are typically themselves legislature
