Overview: On June 7th 2008, Sarah May Ward was arrested for the murder of Eli Westlake after she ran him over in a motor vehicle in St. Leonards. Prior to the incident the offender had been driving the wrong way down Christine Lane which was a one way street. Whilst this was occurring she was intoxicated, under the influence of marijuana, valium, and ecstasy and was unlicensed to drive. The victim and his brother who were also intoxicated, where walking down the lane and where nearly hit by the offender. This prompted the victim to throw cheese balls at the car and make a few sarcastic remarks regarding her driving ability. The offender later acknowledged that under the influence of alcohol she becomes more impulsive and irritable. Causation: Had the offender not hit the victim whilst he was walking across the driveway there is no chance he could have died. His death was a direct result of the offender’s actions, as the wounds sustained from the attack killed him shortly after an ambulance arrived on scene. Factors Affecting Criminal Behaviour: For the offender the only factor that affected her criminal behaviour was self-interest. Whether she followed the victim to murder or not, to some extent she wanted to extract some form of revenge. This was confirmed during the trial when the passenger who was in the car with the offender said “She was sick of them” and followed them as a means of teaching them a lesson. The offender’s defence relied on proving that at the time of the incident the factors affecting her were psychological and that her actions were uncontrollable due to her consumption of alcohol and her use of cannabis, heroin and valium in combination with her bipolar disorder. However this was dismissed upon the testimony of Susan Pullman, a neuropsychologist who proved that the offender was not experiencing mania at the time of the incident.
