Part A Question 1 Step 1: Area of Law The area of law is focused on Contract Law in regards to the formation of a contract and specifically on the element of agreement for offer and acceptance. Step 2: Principles of Law A contract is a legally enforceable agreement between two or more parties. When a contract is made, parties become subject to legal obligations, whereby there is a legally binding duty to give or do something. This is known as the contractual rights and duties that parties must perform. These contractual duties will bind the parties until they are discharged. It published an advertisement offering to pay a reward of 100 pounds to anyone who purchased the smoke balls and nevertheless caught the influenza. The company refused to pay her, denying that an enforceable contract with Carlill had been created in these circumstances. The advertisement amounted to an offer that was capable of acceptance which created an enforceable contract with the company. An offer is intended to result in a contract if it is accepted. Advertisements and displays are generally not offers. They are rather an invitation to treat as it does not intend to signal a readiness to be bound. However, in the case of Carlill v Carbolic Smoke Ball Company the advertisement was held to constitute an offer capable of acceptance. An offer can expire after a reasonable time or after a period set by the offeror. It can also be withdrawn by the offeror before it is accepted. An acceptance is the agreeing to the terms offered. Acceptance must occur on the same terms of the offer. It must be made while the offer is still in existence. It must be made by the person to whom the offer was addressed to. It
