It was reported to Ghere that Winbourn, Lonnie had been sending threatening texts to his ex-wife and daughter’s cellular phones. L. Winbourn had also left several threatening messages on the his ex-wifes phone. L. Winbourn’s ex-wife’s name is Winbourn, Terri (DOB 07-26-1971) had a protection order served on him February 28, 2017 and he began the harassing texts and voicmails. Deputy Ghere showed a text message to me that indicated L. Winbourn would shoot T. Winbourn and several other ways of harming her. L. Winbourne also indicated he would not go back to prison and would “shoot it out with the cops”.

While at the Boyer 's getting fuel, two juvenile females came to me to report a suspicious male. The females identified themselves as Patricia Moncrief and Hayley Stachowski. The juvenile females stated there is a male that had been parked outside the Domino 's for a while stalking a female worker. The juvenile females stated the worker was told to call the police but she did not. The females stated a male Domino 's worker came outside to confront the male and the male moved his vehicle to the Boyer 's side parking lot and remained there. On August 26, 2015, you responded to 41 Olsen Rd. Cocoa in reference to a violation of a "no contact" order. During your investigation you developed probable cause to arrest Alicia Balderston for violating a "no contact" order that was issued on August 20, 2015 due to a domestic violence arrest. During this call you took written statements from the victim and two witnesses.
Pre-offense information related to this case includes the relationship the victims had with the offender. If the offender was Brent Smith as is believed then Tracy Smith’s relationship to the offender is that she was Brent Smith’s soon to be ex-wife and the mother of his two children Reagan and Eion. Keeping with the suspected offender Brent Smith, Karen Green’s relationship with the offender was through Tracy’s relationship with him as Karen was Tracy’s former mother-in-law. Karen Green also cared for Tracy and Brent’s children while Tracy was at work as they were living with Karen during the time of the offense. Victim selection occurred based on the interactions the victims had with the offender.
Gutierrez. He was 814 at the time so he was the main beat car. The first quarter of the day was spent doing premise checks around the city. When doing so P.O. Gutierrez was checking plates and one came up as wanted for not appearing in court, the owner of the vehicle. P.O. Gutierrez proceeded to pull over the subject. The subject in the car was not the owner of the vehicle but he was driving without a license. P.O. Gutierrez arrested the subject, then was later released with an Ibond. Later that day, we drove to a call of a domestic disturbance, between a couple. Both parties appeared that they wanted a divorce and was given advice on what to do. Another Domestic disturbance was given to us and this one was about neighbors fighting about property.

Mr. Matthews said the male then got out of the truck and then began to walk down his driveway and fell and face first on the driveway. The male then got up and stumbled all the way down the street and disappeared in the darkness. While Officer Seachris was speaking with Mr. Matthews, neighbors advised there was moaning coming from down the street. Officer Seachris went to 628 S Vassar and located a light-skinned, bald, Hispanic male with no shirt lying face down on the cement porch. This subject was later identified as Javier Ramirez-Zarate. Officer Seachris could immediately smell a very strong odor of an alcoholic beverage on Mr. Ramirez-Zarate. Officer Seachris attempted to get information about the accident but Mr. Ramirez-Zarate kept repeating that he was at his house. Officer Seachris had Mr. Ramirez-Zarate walk down the street and observe that Mr. Ramirez-Zarate was having difficulty maintaining his balance. Officer Seachris instructed Mr. Ramirez-Zarate that he was going to administer sobriety tests and attempted to do so. Mr. Ramirez-Zarate could not perform the test and Officer Seachris took him into custody. During this time Officer Wheeler made contact with Mr. Ramirez-Zarate’s girlfriend who advised that Mr. Ramirez-Zarate had been driving the truck earlier and as far as she knew he
