In the current political situation in Kenya and in the wake of the ongoing national wide protests following the annulment of October 8, 2017 elections the police organisation has been faced with the need of application of moral choice and or discretion following allegations of use of extreme force against protesters and recorded deaths and injuries experienced from such extreme measures. Section 49 of the National Police Service Act is very clear on the general powers of police officers including the circumstances under which police are allowed to use force. It also stipulates in Section 49 (13) that a police officer who abuses any powers conferred by this Act commits an offence and is liable to disciplinary or criminal action and a person …show more content…

3. A police officer shall make every effort to avoid the use of firearms, especially against children.

Life is all about choices. Every situation is a choice. Individuals and organisations alike make choices each waking day. It is widely expected that police officers will always conduct themselves within the confines in executing their mandate, it is imperative that they do so however it is also very important that they exercise moral discretion. Discretion in this context would refer to ‘power or right to decide or act according to one's own judgment; freedom of judgment or choice’. From the basic decisions on whether or not to use lethal force, make an arrest to even pardoning offenders depending on the situation at hand including the gravity of the offences, police officers always make choices in their line of work.

The function of police mainly among others revolves around maintenance of law and order and protection of life and property. It is therefore important for police to recognize that the preservation of human life is extremely paramount. Their moral obligation stretches beyond legal compliance. While they may
