Proposition 62, also known as "The Justice That Works Act of 2016" is an initiative statute, proposed by the California Secretary of State. If passed, it would amend parts of the Penal Code regarding the death penalty. Overall, it's proposing to abolish the death penalty as the highest punishment for first degree murder and replace it with life imprisonment with no parole. In addition to that, it would require the persons guilty of first degree murder to work while imprisoned and give payment towards victim restitution.
In my opinion, the United States Constitution when it was first written was not just, however, after ratifying the Constitution throughout the years it has become a just document. When the Constitution was first written, it did have good points but, it still allowed slavery and did not allow women the right to vote. The 13th amendment which abolished slavery in the United States was not ratified until 74 years after the Bill of Rights was ratified. African American slaves were also not considered a whole person because of the ⅗ Compromise. Women were not granted the right to vote until the 19th amendment which gave all United States citizens the right to vote was ratified in 1920 which was 129 years after the original Constitution was ratified.
Slavery is the act of owning people and giving them nothing but restricted freedom and exhausting laborious jobs. Most of the slave states were in the South, including Texas, Louisiana, Alabama, Mississippi, Georgia, Florida, Tennessee, South Carolina, North Carolina, Virginia, Arkansas, Kentucky, Missouri, Maryland, and Delaware. By keeping detainees in these conditions does not go against the Eight Amendment because the storm was not meant to be a punishment, it was something uncontrollable. California Proposition 62, the Repeal of the Death Penalty Initiative, is on the November 8, 2016, ballot in California as an initiated state statute. California is one of the 30 states in which death penalty is legal. This referendum plays a vital role in deciding the criminal system justice system. There exist many arguments from the people in support and in opposition of this proposition. People in favor of the Proposition 62 are mostly former death penalty advocates, while the people in opposition are the ones who have been the indirect victims of some worst criminals. The Missouri Compromise has impacted America today greatly for many reasons. One of the few reasons include, “It marked the beginning of the … conflict over the extension of slavery that led to the American Civil War.” (Encyclopædia Britannica, Missouri Compromise) Currently territories south of the Ohio River and the Mason Dixon Line were considered pro-slave states.
