Public Policy Essay : Drug Policy

For many years, drugs have been the center of crime and the criminal justice system in the United States. Due to this widespread epidemic, President Richard Nixon declared the “War on Drugs” in 1971 with a campaign that promoted the prohibition of illicit substances and implemented policies to discourage the overall production, distribution, and consumption. The War on Drugs and the U.S. drug policy has experienced the most significant and complex challenges between criminal law and the values of today’s society. With implemented drug polices becoming much harsher over the years in order to reduce the overall misuse and abuse of drugs and a expanded federal budget, it has sparked a nation wide debate whether or not they have created more harm than good. When looking at the negative consequences of these policies not only has billions of dollars gone to waste, but the United States has also seen public health issues, mass incarceration, and violent drug related crime within the black market in which feeds our global demands and economy. With this failed approach for drug prohibition, there continues to be an increase in the overall production of illicit substances, high rate of violence, and an unfavorable impact to our nation.

A public policy is the body of principles that underpin the operation of legal systems in each state. In this paper I am going to talk about federal along with state policies. I will discuss each of the policies and how they are similar and how they are different. Federal and State policies are made to help keep our Country running smoothly. If there were no policies then keeping our Country safe would be a hard task. Policies are principles that are set to help make our Country operate on a daily bases. I like to think of it as rules that are set to keep our Country safe; because if there were no rules then everyone would be doing their own thing which could cause for a very disorganized situation.

In the late 1980’s and early 1990’s, drug use became a major concern for most Americans. As the War on Drugs and “Just Say No” campaign were being thrust into the spotlight by the government and media, the public became more aware of the scope of drug use and abuse in this country. The federal and states’ governments quickly responded by creating and implementing more harsh and punitive punishments for drug offenses. Most of these laws have either remained unchanged or become stricter in the years since then.

For many years, a real push has been looming on the idea of legalizing now illegal drugs. This has become a hot debate throughout nations all over the world, from all walks of life. The dispute over the idea of decriminalizing illegal drugs is and will continue on as an ongoing conflict. In 2001, Drug decriminalization in all drugs, including cocaine and heroin, became a nationwide law in Portugal (Greenwald). Ethan Nadelman, essayist of “Think again: Drugs,” states his side of the story on the continuing criminalization of hard drugs, in which he stand to oppose. Whether it is for the good of human rights or not, decriminalizing drugs may be a good head start for a new beginning.

Ronald Reagan was not only a master of foreign policy, but was also skillful with his domestic policy as well, such as his handling of illegal drug use within the United States. Reagan began his administration’s “war on drugs” in October 1982 (Glass). On that date he declared that illegal drugs and their production and transportation were hurting America (Glass). From then on, he made it clear that his administration would act against illegal drugs, and would do what it could to stop their influence. Congress, Reagan’s Vice President George H.W. Bush, and even his wife all put forth great contributions to the fight against illegal drugs. Ronald Reagan began to take action of his own in September 1986 when he helped to put forth and effectively pass Executive Order 12564 (Drug-Free Federal Workplace). The order was intended to create a drug-free work environment for every worker in America, and made it the law to not use drugs while at a workplace (Drug-Free Federal Workplace). Also, he signed the Anti-Drug Abuse Act of 1988 into law (Anti-Drug Abuse Act). The Anti-Drug Abuse Act created different types of minor and major penalties for drug offenses, and also created the

Drugs first surfaced in the United States in the 1800s. After the Civil War opium become very popular and was used medicinally. Following opium was cocaine which was also used as a health remedy but near the end of the 19th century opium and cocaine abuse peaked and local governments began to prohibit opium dens and importation. In 1914 the first federal drug policy, the Harrison Narcotics act, is passed and drugs are no longer seen as harmless remedies. The act aggressively regulated the manufacturing of marijuana, cocaine, heroin, and morphine. During the 50’s more federal drug policies were passed and drugs began to become more criminalized. The 60’s saw a rise in counter-culture and substances such as marijuana and LSD saw widespread use. The demand for drugs skyrocketed in the 1960s. In 1971 President Nixon declared drug abuse America 's number one enemy and proclaimed that we must wave a all out offensive. After President Nixon declared the War on Drugs in 1971, the United States has spent more than a trillion dollars on this failing policy that not only has had no effect on the amount of drugs being used in the United States and has increased the number of people incarcerated on drug charges from just 50,000 to over half a million, but also has helped fuel drug cartels and foment violence and death through overdoses from uncontrolled drug potency and turf wars between street gangs.

Throughout history, campaigns against certain parts of life are frequently argued upon. Wars are in a state of flux, but a constant in America's policies is the Drug War. The government attempts to prevent the consumption of illicit and harmful substances, even shown in modern domestic policies. Yet with much effort, positive results was not usually yielded. Apart from the outcomes, prohibition has made a large impact on daily life. In the United States, prohibition of alcohol and opium was a visible and controversial debate. The prohibition of alcohol and criminalization of opium were very different but still had some similarities such as the events that happened, its immediate reaction, and the lasting significance.

Since the late 19th century, the federal and states governments of the United States have enacted laws and policies to deter the use and distribution of illegal drugs. These laws and policies have not only deemed what drugs are legal and illegal, but have also established penalties for the possession and distribution of these substances and established federal agencies to control drug use and administer drug law enforcement. This essay will not only examine the landmark drug laws and policies established by the federal and state governments, but also the enforcement of drug laws.
