Discrimination is against the law and it comes in many different forms. It could include race, color, sex, religion, age, gender, disability, and national origin. “A company’s policies and employee handbook can make or break your efforts to comply with the law and can help limit your company’s legal exposure” (Guerin, L & DelPo, A., 2016). Although company’s put policies, rules, and regulations in place for the protection of the company and its employee’s, it still doesn’t prevent lawsuits from happening. In this assignment, we’re going to take a look at a case that involved a company called by the name of “10th Circuit” and one of their employees. General Order 600-42, establishes the department’s policy against the practice of racial profiling as set out in state and federal laws, concerning racial profiling and discriminatory practices in general. Discrimination in any form, including racial profiling, is strictly prohibited and the department shall take immediate and appropriate action to investigate allegations of discrimination (Houston Police Department General Order, 2012).

In this case the Plaintiff alleged reverse discrimination when she was not hired for a job at Saginaw Valley State University. The position in which the plaintiff applied was for the Coordinator of Campus Recreation position. According to Pilon v. SVSU & Thompson (2003) the primary job functions for this position are as follows, “Plan, develop, promote, direct and supervise all facets of the Campus Recreation Program and the SVSU Athletic Summer Camp Program.” Other essential roles and responsibilities were, according to Pilon v. SVSU & Thompson (2003), “Plan and implement a program of team and individual intramural sports and indoor/outdoor recreational activities for the entire university community.” The applicant would coordinate all aspects of the SVSU Athletic Summer Camps. They would also be in charge of hiring, training, and assisting all student employees within the recreation facility. They also have the responsibilities of setting up and meet regularly with advisory committee, and also assist with administration of the recreation budget, and inventories.
Racial discrimination has become a hot issue in the United States. Protests against the inequality of the court system and the young lives of black youths has sparked a racial divide. This problem has been occurring even before the establishment of this century. Racial tensions between blacks and whites goes far back to when slavery was still legal. African men, women, and children arrived to the free lands only to work their way out of slavery early on. Until the slave system became more strict, many young african american men and women could pay off their debt to their owners and marry. As the slave system became more strict, the possibility of buying your own freedom was erased. After the Civil War, many issues arose for the former slaves. The political leaders wanted to provide rights to protect the freed slaves, yet the States found loopholes to deny a free black man from being ‘free.’

In this essay, I will discuss how policies were put into act to help promote, prevent, and address problems related to institutional discrimination. Racism is experienced when minority groups are discriminated against and also when minorities experience some form of prejudicial acts. For instance, one might not be able to obtain a certain job because of their race. Institutional discrimination has caused for social justice because people deserve to be treated equally.

In fact, it’s not just small business, major corporations have problems with racial discrimination as well. Leons in Nova Scotia, Canada have had complaints of racial discrimination. An employee, Elsworth Bottomley made complaints about racial slurs; discrimination because of the colour of his skin; and a 45cm black statue hung by its neck by tape in an effort to scare him.
