Marriage, by definition, is the legally or formally recognized union of a man and a Woman (or, in some jurisdictions, two people of the same sex) as partners in a relationship. In some cases, marriage between two people of the same sex is more commonly known as gay marriage. Here in the United States of America, it is believed that every citizen should have inalienable rights, yet LGBTQ communities are constantly denied of their human rights as an American. Due to their sexual orientation, they are discriminated and gay marriage is viewed as inhumane. Whether a person is Caucasian, Negro, gay, straight, transgender or queer, they need to be given all equal rights as citizens of the United States. In fact, as of October 21, 2014, same-sex marriage has been legalized in thirty-two states in the United States: Massachusetts, Connecticut, Iowa, Vermont, New Hampshire, New York, Washington, Maine, Maryland, California, Delaware, Rhode Island, Minnesota, New Jersey, Hawaii, New Mexico, Oregon, Pennsylvania, Illinois, Indiana, Oklahoma, Utah, Virginia, Wisconsin, Colorado, Nevada, West Virginia, North Carolina, Idaho, Alaska, Arizona and Wyoming (“Gay Marriage Pros and Cons” (2014). There are several reasons as to why people are against the legalization of same-sex marriage, yet the three most prominent are the possibility in the rise of divorce rates, the possible legalization of all marriage, and the development of a child in a same-sex partnership household (“Gay Marriage Pros
“We’re here, we’re queer, get over it.” In 1990, these words, shouted and displayed proudly on signs waved by the activist group, Queer Nation, were revolutionary. Never, not since the Stonewall Riots, had non-straight, non-cis people been so vocal about their existence and demanded acceptance – something that straight people take for granted on a daily basis. However, in the years since the Riots, LGBT activism has become much more mainstream, no longer whispered about behind closet doors or something to be wholly ashamed of. Gay marriage is legal in all 50 United States, something that has been fought for since the conception of the LGBT movement. In fact, gay couples are routinely being featured on popular television and other forms of media. Some might say that in 2016, the dreams of the rioters in Stonewall have been realized. Marriage rights and the spotlight on nighttime television; equality seems to truly be right on the horizon.
The United States Supreme Court has recognized that multiple rights related to family that fall within the right to privacy and are granted significant constitutional protection. It is a matter of some dispute, however, which rights do or should fall within the contours of the right to privacy and, further, how narrowly those rights should be defined - most specifically, the topic of same sex marriage. While a copious amount of people agree that same sex marriage is no different than heterosexual marriage and should be awarded the same protection, others argue that it is an infringement upon family values, tradition, and religious sensibilities.
Same sex marriage became legal on June 26th, 2015. So, why is there still discrimination? It’s legal, right? The discrimination against homosexual athletes in American sports is out of control and needs to be changed immediately. How would people feel being looked down upon being one of the only openly gay athletes in the United States? Before 2014 there was not any openly gay athletes currently playing professional sports in the United States. This shows the fear humans have when it comes to being honest about their sexuality because they know what the general public thinks about it. Discrimination is inhumane, especially when it comes to peoples beliefs. Sixty-five percent of females in the WNBA are homosexual, but are not discriminated against compared to the way male athletes are. Many gay athletes do not come out about their sexuality until after retirement because they fear what others will think.
Same-sex marriage; why is it even an issue in this era? To put it into perspective, almost 9 million Americans are identified as a homosexual, meaning this is not just a minor issue. Also, with our society making significant movements toward equality in recent decades both in gender and racial issues, one has to think about sexual equality in the United States. I will explain to the reader why we should legalize same-sex marriage, especially in terms of justice and the benefits our society receives from same-sex marriage. Also, the consequences of the legalization of same-sex marriage, both for homosexuals and our society, will be examined. Finally, I will debate arguments against same-sex marriage.
In 2015, same-sex marriage has been ruled legal in all 50 states but that wasn’t always the case. Gay Marriage has been a conflict since the Roman Empire. In 342 AD Christian emperors Constantius and Constans issued a law in the Theodosian Code prohibiting same-sex marriage in Rome and ordering execution for those who married. Marriage existed between a male Roman and female Roman citizen, so that marriage between two Roman males (or with a slave) would have no legal standing in Roman law.
The focus of Homosexuality has been over all sorts of media, specifically starting in 2012. Finally, in 2015 same sex marriage was legalized in all fifty states. Many arguments have come around about if homosexuality is genetic or if its chosen. Many people think either way and there aren’t many people who are in between thinking that homosexuality is chosen or not. The song “Same Love” by Macklemore was released in 2015 when all of the media slowed down about homosexuality and after same sex marriage was legalized. So when Macklemore released this song more attention came to same sex marriage. This song makes a lot of points about how everyone should be okay with same sex marriage but there are bigger arguments present. Macklemore uses the lyrics in this song to talk about how homosexuality is genetic by pulling in personal experiences and how being gay is not the social normality.
“No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.” The fourteenth amendment tells us that we have a right to our privileges and there can’t be a law that takes those away. If a state requires a license to be married, but also is able to deny people their license, isn’t that making a law that deprives a denies a person their right to be married?

The first state to legalize same-sex marriage was Massachusetts in 2004. There was not a last state to legalize gay marriage. The supreme court realized how many states were now legalizing it, so they just had all of the states left legalize it as well. Some positive outcomes now that it is legal to marry the same sex is that the adoption process will be easier, and gay suicides will lower. Now that same sex marriage is legal, discrimination rates should decrease.
For years individuals in same-sex relationships have been the thing of ridicule and discrimination. However, this started to change in December 2000, when the Netherlands became the first country to legalize same-sex marriage (Gay Marriage Around the World, 2015). Many are rejoicing over the freedom to marry whoever they desire, proclaiming a recently popular phrase, “love wins.” However, there are some who strongly oppose the ruling; many disagree due to opinion and religious beliefs. Some are reluctant to accept this change because they do not like the idea of a sterile marriage where biologically producing children on their own is not an option. Just because they were born with a different preference, they were insulted, discriminated, beaten and isolated from society. They were the ones being shamed for what they were, and made to believe that what they felt towards another individual was morally wrong and against humanity. Today we begin to embrace the lifestyle of homosexuals, and acknowledge the struggles of these individuals. This journey of understanding is built upon different standpoints of society. One of which, projects same-sex marriage as a possible advantage that brings commitment in the relationships and the benefits of being a guardian. In contrary, others believe this subject has created great change, confusion and nothing but a trail of thoughts, such as, what are effects of such companionship? Will our society suffer due to the redefinement of marriage and homosexual rights? Same-sex marriage still seems to be speculated by such groups, although, no negative effects were ever imposed, both on adopted children and their marriage.
Imagine you have been with your better half for years and you have now decided that you want to marry that person and spend the rest of your life with them, but you can’t because you’re the same sex. For years this has been the struggle for many same sex couples. The same basic right to share your bond with your loved one for the rest of the world to see through paper and ring has been denied by law and church, until June of 2015. Some argue that they had the opportunity to combine in what is known as a civil union. But this type of marriage union only gives them legal protections as a couple but only on the state level. Which means no federal protections and move to another state and those same protections no longer imply to you. In this paper I want to show you the facts of why I feel same-sex marriage is the right thing to do. I believe that same sex marriage should be legal because couples should be able to show their commitment to each other regardless of gender, couples that are committed and have families should be legally allowed to claim each other, and religion should not be able to state who has the right to love whom.
