Listed at the very end of the document are the people’s rights and freedoms, also known as the Bill of Rights. This set-up is the opposite of the Italian Republic. The set-up of the constitutions is where the two have differences. The legislative branches also stray from each other. The U.S. legislature is made up of two groups, the Senate and the House of Representatives. To be elected into the Senate, a person must be 30 years of age and nine years as a citizen. Each term lasts for six years (every two years one third of the Senate is replaced) and there are two senators elected from each state. This branch is made up of the president and vice president. To be president, a candidate must be 35 years of age and 14 years a citizen. Each president can run for two four-year terms. The president and vice president run together as a pair; they are not individually elected. Unlike Italy, the citizens of the United States vote on who they want to be president. When elected into office, the president must take an oath of allegiance to the country. As president, there are specific duties listed in the constitution such as: being commander and chief of the army and navy, making treaties with foreign countries (given that two thirds of the senate agrees), and appointing judges and ambassadors. If the president fails to uphold these duties or commits forgery, a misdemeanor, or a felony, the legislative branch can impeach him/her. In the case of impeachment or death, the vice president would then take over. This differs from the process Italy uses in this situation. The last branch discussed in the American Constitution is the Judicial, which slightly differs for the Italian Judicial branch. This branch is made up of the Supreme Court and other courts below it. These courts are responsible for all cases except an impeachment. Unlike the Italian Republic, the U.S. allows the president to appoint the judges of the Supreme Court, provided that the Senate approves. The Congress selects the other court’s judges.
