My client, John Smith was arrested on January 1st 2016 on charges of allegedly assaulting his wife, Sherry. John and Sherry have two kids, Robert and Alexa. Both kids have been living with their mother while their father was in jail. John posted bail on February 2nd 2016. However, the judge issued a temporary restraining order for the remainder of the case. The restraining order stated that John could not go within 6,000 feet of his wife's house. On March 7th 2016, Robert (John’s son) called his father to inform him that his mother (Sherry) was going on a business trip and would not return until late that night. John went to spend the day with his son at his wife's house, at around 9 o’clock Robert received a call from his mother, letting him know she was on her way home. John panicked and made Robert promise he wouldn't tell anyone, not even his sister. He did not want to risk passing his wife on the street so John called me to pick him up, after I questioned why he was there in the first place he responded “Whose side are you on?” because I did not want him questioning my loyalty I hurried over and picked him up.
