In many criminal cases, there is some type of surveillance used on suspects, whether it be of their phone calls, location, or their online activity. Phone calls and text messages, specifically, are collected at all times by phone carriers, and the NSA has the ability to query this data for specific records under the USA Freedom Act, which came into effect after the end of Section 215 of the Patriot Act; the primary difference is that, before, the NSA collected this data themselves and stored it within their own database while the data is now stored by phone companies, though the NSA can still access it. This is done with the goal of giving a constant means of tracking terrorist and similar threats, but this data can also be used in court cases. Similar provisions allow them to collect other data such as e-mails, though data is only supposed to be collected on communications
The NSA program, uncovered by the former CIA agent and former NSA contractor Edward Snowden, is called Prism. Snowden, while working for the NSA disclosed this information by leaking this classified information to a web site called The Guardian. The fact that the information was classified means that the NSA had no intention of telling the citizens of the USA about its ability to monitor and record this great amount of data. This program while legally not able to record the conversation in the of a phone call can detect and record the number who is making the call, the number being called, the duration of the call, and, if necessary, the cellular tower used to send the call. However state and federal judges across the country have made conflicting rulings on what standards are required for the government to obtain tracking information from cell phone companies. Then there should a be law that the government should need a warrant to access your cellphones records and obtain data from the cell phone proproviders.The federal government's position is that it should be able to get most of this data if it decides it is relevant to an investigation, with no need for a search warrant. Farkhunda Malikzada, an innocent 27 year old woman was accused of burning Islam’s Holy Book, and with no evidence she was viciously beaten, stoned, run over by a car, and then set on fire. Farkhunda is a prime representation that women are treated viciously for no apparent reason. She is just one of many who face these types of realities every day.
When there is little privacy caused by the fourth amendment it should be looked at seriously. The 4th amendment allows law enforcement to use collect evidence from phone calls for using in court as evidence. Though they need permission from a judge to go through and use your calls they could use your conversations as evidence, as they can use it to catch terrorist and thieves. The intelligence agency can not only use phone calls, but they can also search your home and even your vehicle, obviously they need a warrant but there are a few cases where they do not need a warrant. An example of a case that they do not need a warrant is when a weapon or evidence that is needed is in plane sight, but anything not in plane sight you must have a warrant.

Classified organizations, such as, the NSA secretly collect information that includes, details of phone calls, e-mails, and personal Internet activity, although, in 2013 the NSA’s secret was revealed to the public, since it was not publicly known that the NSA had been collecting bulk phone data. The NSA later tried to defend itself and state that it doesn’t mean that they collect all personal records, such as, medical records and library records.
