Takana was violated by Jonathan sharing private information with the administration because he shared it without Max’s consent when it’s not his property, even though it was sent to him initially. Jonathan sharing the photo with the school was an encroachment of jewish law. It is stated in a text in Yoreh Deah that, “It was declared as forbidden to read a letter sent from one to another without his knowledge unless it was thrown away.” (Beer HaGolah, Yoreh Deah 334:123) Jonathan completely disregarded telling Max that he was going to pass on Max’s private conversation with his friends and shared with the school. In a text in Hilchot Ketanot, it is stated that, “it appears that it is still forbidden to seek and reveal the secrets of your fellow as you shall not go up and down as a talebearer” applied to others and to yourself.” (Responsa, Hilchot Ketanot, 1:276) Jonathan should not have shared Max’s private information with the school, Max did not share with the school but only with his closest friend which should imply that he did not want the information spread to anyone else. Although Max did not tell Jonathan not to share it further, it was still Max’s private information and it should not have been shared. In addition, Jonathan knew that the contents of the message were harmful because he had already seen them so he should have discarded them.
