Ms. Fisher argued that race or ethnicity should not be a factor in the application process because it is simply unfair. The university responded that using race as a factor is only part of the admission process and is only used to ensure a large diverse group of students. The University of Texas automatically admits students in the top ten percent of high schools in the state. The school also used the affirmative action policy to admit students of other races, even with less credentials, over white students. While Ms. Fisher was not in the top ten percent of her high school, she still thought that with her GPA, performing arts, and other achievements; she would be able to attend the university.

At the time that this initial lawsuit was filed, the University of Texas at Austin accepted students in the top 10% of each Texas high school’s graduating class. According to Wermiel. these student were accepted regardless of their race; under Texas House Bill 588. The Texas House Bill 588 guarantees Texas students who graduated in the top ten percent of their class admissions to all state-funded universities.

In 1997, Texas legislature passed a law that all high school seniors were to be accepted to the University of Texas if they finish in the top ten percent of their class. The University of Texas followed this law but found that their student body was becoming less and diverse. Universities believe that having a diverse student is an important part of learning.
Given that the state was in the South, it was not surprising that the state instituted racial segregation. In the book, “Before Brown: Heman Marion Sweatt, Thurgood Marshall, and the Long Road to Justice” by Gary M. Lavergne, he discussed the entirety of the Sweatt v. Painter case. Lavergne says of Texas, “There were no provisions for what was called “Negro education” of any kind in the Constitution of 1836.” This would soon change after the Civil War. During Reconstruction, the state revised their constitution to include provisions concerning Black education. It was far from equal as the state only used African-Americans funds to support their education. More likely than not, they were poor so the funding for the school paled in comparison when compared to funding for Whites. Although, revisions in the Texas constitution made public education better for Blacks, however, it did not specify higher education. In fact, after the state gain readmission into the Union, the laws shifted again. What was different this time around was that Texas did not have any obligation to ensure their Black citizens equal education. For instance, in article VII, section 14, it discussed the formation of a Black university but it had stipulations. First, the creation of such school was at the legislature discretion, “when deemed practicable”. Next, the funding of the school was severely limited

Republicans in Texas offer free higher education to minorities that are here on work visas, which has always brought more votes for the Republican Party. More scholarships are awarded to minorities in Texas. The result of higher education allow minorities to receive more than minimum wage paying jobs. With these jobs minorities are able to get off of the welfare system. A large percentage of minorities find it easier to live off of the system that provides housing, food for the table, dental care, medical care, vision care, and care at the expense of tax payers. Without the option of higher education many minorities get involved with crime regarding gangs and drug issues statewide. When it comes to higher education, scholarships and grants are offered so more minorities get the education they deserve and/or need. According to texaseducationexcellence.org “[t]he Texas Coalition for Excellence in Higher Education is a group of concerned citizens who believe strongly in the power of higher education to transform lives, build our economy and shape Texas’ future”. With more minorities receiving a higher education it allows all citizens of Texas to be equal. Having more people that are qualified to perform jobs that corporate companies are looking for will attract more companies down to Texas thus making the state more competitive, which creates more job opportunities.
While the Texas public school system may not be segregated now it took a lot of court cases to get there due to Texas past as a highly segregated state. While this is the route that Texas takes, the United States simply takes the route of creating acts such as Race and National Origin Discrimination. Desegregation has been a troubling issue in not only the Texas public school system but also the United States as a whole. However, they have had to two totally different ways to handle this situation. Under the Texas Constitution separation of races was not wronged. This all change after a very controversial court case, Plessy vs. Ferguson and continued to reform by way of court decisions. The Plessy vs. Ferguson case decided that facilities could be segregated, but they must be “equal”. Texas being the highly racist state that it was at the time found loopholes around this judgment. Southern University A&M College welcomed Dr. J.S. Clark as the new African American leader and president in 1914 after the big move. As Dr. Clark as president, he made numerous improvements on campus and off campus. He established a Junior College, teacher-training curriculum, Agricultural Extension Program, a summer normal school, six brick buildings for instructional activities, five brick dormitories, and eleven wooden structures for the faculties. The college is known for its Football and have been in the top 20 in the rankings since the appointment of legendary Bo Pitterno in 2001 as the Head coach for the team. The coach requested to upgrade the stadium or construct a new stadium to accommodate the large fan base.
