Segregation is the enforced separation of different racial groups in a country, community, or establishment. During segregation people of different races had to ride in different rail cars and attended separate schools. In two cases, Plessy V. Ferguson and Brown V. Bored of Education, the Fourteenth Amendment was argued. The outcome of these two court cases effected African Americans and their fight against segregation. These two court case are similar in their fight for a cause because they challenged the meaning of the same law, but different in their outcome. These statements are talking about how no rights were taken away from the Separate Cars Act so the act of segregation was legal. In order to show how the “separate but equal” doctrine came to be, as a class we created a mock trial of the Plessy v. Ferguson case. The idea of separate but equal allowed states to segregate black and white people through public services and accommodations for over 60 years. Despite this idea of equality in the doctrine, many people took advantage of it, as it gave both black and white people an influence on whether they were inferior or superior.
There was no clarification on what race would be considered white or what would be considered black. During this incident, “Homer Plessy, who was seven-eighths white and one-eighth African American, purchased a rail ticket for travel within Louisiana and took a seat in a car reserved for white passengers. (The state Supreme Court had ruled earlier that the law could not be applied to interstate travel.) After refusing to move to a car for African Americans, he was arrested and charged with violating the Separate Car Act.”(Duignan 2017). Judge Ferguson ruled that the separation was fair and did not violate the fourteenth amendment. The state Supreme Court also backed up this decision. The case was brought to the Supreme Court and "The law was challenged in the Supreme Court on grounds that it conflicted with the 13th and 14th Amendments. By a 7-1 vote, the Court said that a state law that “implies merely a legal distinction” between the two races did not conflict with the 13th Amendment forbidding involuntary servitude, nor did it tend to reestablish such a condition." At the time of the ruling, segregation between blacks and whites already existed in most schools, restaurants, and other public facilities in the American South. In the Plessy decision, the Supreme Court ruled that such segregation did not violate the 14th Amendment of the Constitution of the United States. This amendment provides equal protection of the law to all U.S. citizens, regardless of race. The Supreme Court case Plessy v. Ferguson is known for having established the precedent of “separate but equal.” The case originated in Louisiana and was specifically made to the separate passenger cars that were for the black and white races. The Supreme Court, in this case, upheld the right of Louisiana to separate the races and “this decision provided the legal foundation to justify many other actions by state and local governments to socially separate blacks and whites” (Zimmerman, 1997). In 1951 schools were separated by skin color, or segregated. The Brown v. Board of Education trial was brought to court because a third-grader, Linda Brown, was not allowed to attend the elementary school that was closest to her house. She wa required to take the bus to school across town instead. In the trial the point that “Education for Negroes is almost nonexistent(13).” This is an example of how there were old problems in the Fourteenth Amendment that needed to be changed. In 1890, Homer Plessy broke the law in Louisiana, by sitting in the white people car and he was 1/8 black and 7/8 white. The state of Louisiana passed the Separate Car Act, which required railway companies to have "separate but equal." Furthermore, there was a young girl named Linda Brown who attended a school very far away from her house. On the other hand, there is a school not to far from her ,but it’s an all white school. So Linda Brown and her family took it to court saying that blacks not being able to go to any school is a violation of the 14th amendment. Ferguson an African American man in Louisiana named Homer Plessy refused to follow the mandated Jim Crow laws which enforced that African Americans have to sit in a designated area when riding on a train. In the late 1800s to the early 1900s segregation was one of the biggest issues in the court of law. After slavery was finally abolished African Americans were able to have more freedom, but they were still treated different than any other race. The Jim Crow laws are an example of the law that affected everyday life in the African American community in the beginning of the 1890s. This law segregated schools, parks, libraries, drinking fountains, restrooms, buses, trains, and restaurants. The struggle to achieve equality was made even more difficult by the legislation of racism in the Plessy v Ferguson case.
This was court case was basically saying that the treatment of blacks separated from whites in places was equal in its own way. “The lower court ruled in this case Plessy Vs.
