Federal and State laws define child neglect and abuse is both criminal and civil. The civil definitions that determine the grounds for intervention by State child protective agencies, at the Federal level, by the Child Abuse Prevention and Treatment Act (CAPTA) January 31, 1974.By the Senate and House of Representatives of the United States of America and Congress assembled this act may be cited as, “the Child Abuse Prevention and Treatment Act. Section 3 of the Law said” For purposes of this Act the term "child abuse and neglect "means the physical or mental injury, sexual abuse, negligent treatment, or maltreatment of a child under the age of eighteen by a person who is responsible for the child 's welfare under circumstances which indicate that the child 's health or welfare is harmed or threatened thereby, as determined in accordance with regulations prescribe by the Secretary.” (
