The current method to heal mentally ill patients in the United States is mostly done through forced medication. Elyn Saks believes there may be a better way to help the men and women suffering with a mental illness than forced medication. “The Consent Dilemma” shows how the current method of forced medication is outdated and how there is a more effective method to help people that have a mental illness. All the rhetoric devices are used in “The Consent Dilemma” by Elyn Saks in the magazine Politico. The rhetoric devices are used to show that the current system used to help the mentally ill is in need of an update.
The rhetoric device that is most prominently used is Pathos. She speaks of her self’s experiences as a person diagnosed with

The author speaks of her experiences as a person that suffered from schizophrenia. The statement by Saks that says, “I fell ill with schizophrenia”, proves that she should know what is best for someone that may suffer from a mental illness. It is used to change how the audience feels in the sense that she should know the experiences a mental illness went through and what could better themselves. She speaks of how the forced medication was difficult for her to go through, and how hard she had to fight just to get off of the medication when she says, “I made multiple attempts to get off the medication”. The audience feels a sense of sadness as they feel that she went through a hard time that could have been made much easier if the system used by hospitals was finally updated to be much better than it currently is. It would also bring about a feeling of sympathy and it may even bring about a small sense of empathy towards some. The audience would be feeling sorry for here because of how the difficult time she spent trying to get off the medication could have been much easier if only the system treated the patients they are trying to heal better.
There are not many uses of logos in this article, it can clearly be seen that this was the rhetoric device with the least amount of time spent one. Although it is not really used in the article, it can still be seen when she speaks of the MacArthur test that is currently used, and the
Logos refers to logic, in other words logos is used for reasoning to persuade in an argument. Feine says, even though people demonize McDonalds, It has its upsides to them. Throughout the article, Feine gives example of this like when he
Quindlen uses logos in her speech to give it structure and to help the audience understand her points. Logos is a statement, sentence or argument used to convince or persuade the audience by using logic or reason. In the introduction, the author explains how throughout her whole college career, she strived to be perfect, but it soon turned into a burden. In the body, the author focuses on
People’s rights are important, just as peoples’ safety, but what if the two contradict each other, especially when discussing people who suffer from mental illness. When we talk about severely mentally ill people, should we be more concerned about the particular person, or what the mental illness is capable of doing to the person. Debates and serious conversation have been sparked by the simple question that most people are yearning for an answer to: should the mentally ill be forced to take medication. Both sides of the argument makes points that make you think about ethics, and decent human rights.
Consent by dissent means to give consent to something by not standing up against it and dissenting. Being a part of a group that is breaking the law and not saying anything to stop them is giving them consent in a silent way. For example, in a tyrannical dictatorship like North Korea, the citizens do not consent by dissent. The people in this country are controlled a lot and do not have freedoms like free speech or press. They do not have the ability to dissent without the very real possibility of being killed or captured by their government. When someone in a country such as the United States does not agree morally with something that is going on they have the ability to dissent. On page 88, it says “dissent implies consent, and is the hallmark
A number of psychological theories have been used to explore the factors associated with the behaviors of healthcare practitioners, the theory of planned behavior, social cognitive theory, psychological egoism, and etc., These theoretical domains offer a comprehensive list of potentially relevant constructs for the behavior of transfusing (Haack, 2012). They include factors such as local protocols, management policies, resources, and etc,. Blood transfusion is an essential part of healthcare and can improve patient outcomes, however, like most therapies, it is also associated with significant clinical risks. According to scholarly article, “The Ethics of Consent: Theory and Practice,” written by Franking Miller and Alan Wertheimer, it states
In Ethics and Clinical Research, Beecher highlights the problem of consent. In the problem of consent part of the reading Beecher says, “Consent in any fully informed sense may not be obtainable. Nevertheless, except, possibly, in the most trivial situations” (Beecher, 506). When we mention consent we are talking about the morality of human beings choice of action but not in all cases does the person or patient is notified of all risk factors of a procedure or process. An example of this is from a book I read back in Senior year of High-school in Ap Biology class and it’s called The Immortal Life of Henrietta Lacks by Rebecca Skloot. In this story Scientist and Doctors took Lacks cells without her consent and used it for research. Than the
Tidy (2012) stated a few general principles of consent that need to be met. It is important to obtain consent from the patients first before starting any examination, treatment or care on them. Besides that, the consent also must be given voluntarily by the patients and not associated with any form of duress or influence from any healthcare professionals, their family members or friends. At the same time, patients also need to understand that the signature given on a consent form does not itself prove the consent is valid. At this point, the role of consent form is to record all the discussions that have taken place between them and the doctor as well as to record their
In the on-going debate over the right of consenting adults to marry, many state legislatures have over-turned the federal decisions in support of this constitutional privilege. In this essay, I assert that the will of free adults and the conduct of their personal lives is not a domain that can be controlled by the judicial system or religious zealots, but shall be protected as the inalienable liberty deserved of all mankind. I will demonstrate that the preservation of this right not only ensures human prosperity through such acts of benevolence, but strengthens the concept of traditional marriage held most by those who oppose the extension of this civil right to our fellow Americans.
Informed consent is the basis for all legal and moral aspects of a patient’s autonomy. Implied consent is when you and your physician interact in which the consent is assumed, such as in a physical exam by your doctor. Written consent is a more extensive form in which it mostly applies when there is testing or experiments involved over a period of time. The long process is making sure the patient properly understands the risk and benefits that could possible happen during and after the treatment. As a physician, he must respect the patient’s autonomy. For a patient to be an autonomous agent, he must have legitimate moral values. The patient has all the rights to his medical health and conditions that arise. When considering

Consent is an intricate and delicate concept, and should not be taken lightly. Consent sexually or otherwise between partners is important, just as consent should be an important part of our economy. Using West’s theory on consent, we will look into consent in relationships as well as economically, but concentrated in the payday loan area. West argues a morally based consent, looking into the reasoning behind the initial consent which will play nicely into the payday loan issue. West looks into the harms of consensual happenings, but looks deeper into the reasoning behind yes or no, and the factors leading to the consent or no consent. After looking into the payday loan factors, we can apply the West theory of consent on an economic standpoint
Western medicine values individual autonomy, to an extent. That extent is measured by an individual’s ability to think rationally. But, what does rationality mean in the face of complex medical decision-making? What does autonomy mean when a doctor deems an individual with a mental illness lacks capacity and needs treatment? The purpose of this essay is not to persuade readers that individuals with mental illness do not need support at times. Rather, the purpose is to make readers question the criteria for involuntary hospitalization. Through defining capacity and exploring what capacity means for individuals who are mentally ill, I argue that it is not ethically justifiable for mental illness to be a criterion for involuntary hospitalization.
Vices of consent represent a distinct juridical institution, because they are placed between the lack of will and a free, conscious consent, which is able to produce exactly that juridical effects perused through the conclusion of the act. Otherwise, the intervention of the vices will affect the internal will and, finally, the consent, but not so powerful that makes it non–existent, but it will harm the consent in its conscious and free dimension. Understanding the manners in which these vices affect the human wills it is realized, also, through comparative analysis. Thus, the common points of the vices of consent are the moment of intervention, their effects and sanction. But in the context of their structure, all these vices are different
According to the book from the perspective of the Sociologist Humphrey he did an experiment on me without my consent, i honestly would be mad because it's my personal life and if I don't give permission I wouldn't want someone to even write about it even if I did have my consent. I would probably feel a violated, and invaded in my personal space but if I am doing things that I should not be doing in public and I wouldn’t want my parents to see it then why do it in public. I was raised better and with morals but now people usually do anything they want in front of everyone and cameras. The scientist may feel he has the right to observe me but what if I have a bad temper and I don't like people seeing me I would find this uncomfortable. If I am
or respecting every partner. Many students said that the norm is to discuss assault in a “preventative manner” and there is too much “emphasis on teaching women to defend themselves,” rather than teaching men to respect women. The most important aspect is to bring consent education in curriculum for younger student which means” NO” means “NO”. Teaching young adults about healthy relationship and consent should not be controversial. Universities should offer programs and safe spaces to discuss consent, sex, and rape, as they are not taking enough measures, according to their students. Many students suggest a training program on the concepts of consent, safer sex, bystander education etc. They also emphasized more information and awareness given
