The second section of this report describes the formal protection of human rights in the Brazilian criminal justice system, but also explains why these guarantees remain largely on paper. An understanding of why the Brazilian state appears to violate so many of the human rights that its own laws and Constitution guarantee requires some description of the historical political context in which the relationship between them developed. Since the 90’s Brazil population in prison has risen enormously making it the fourth largest prison population in the world. Brazil has been the fertile ground of studying the daily effects of violence and crime. Increasing in violent crime over the last decade and the involving young offenders seem to be the most effects of involvement in the drug trade. Drugs in Brazil was not very critical problem but as in the 70’s the start of it which has risen during the 80’s has became the new consumer markets in Rio de Janeiro and Sao Paulo for drugs to be sent to countries like Europe and the United States. Marijuana being that it was an illicit drug that was in the market has made its way underground making it a great economic importance for consequences. Then right after cocaine was available which was sold in drug stores and for medical use. Cocaine which became one of the enormous sources for profit which lead to violence and consumerism in Brazil has created an international business organization. The conditions that have led many lower income youths to involve themselves into crime have been overwhelming due to the deaths causing an increasingly great numbers due to firearms conflicts. Data on violent crimes in the past are irrefutable but focuses on the crimes that mostly closely concerns homicides. By March 1928 the great depression started in Brazil. When the great depression started, I was 23 years old. I just turned 23 yesterday, and today I woke up to see this happening. I didn’t believe that it was happening to my country. At that moment I didn’t know what to do or what to expect happening next. So, I went outside to see what was going on and I saw people yelling and the women crying and more that can’t be explained. By December 1928 I thought about doing something to at least help. I thought talking to the people and telling them to let’s find a way to solve this problem, but this didn’t work. Crime rates and violence in Latin America has become ever more prevalent. Such crimes and acts of violence can be attributed to the drug organizations and their illegal activities. Currently in Latin America there is a debate about the legalization of certain drugs/substances in order to lower crime rates and acts of violence as well as combat the drug organizations that consistently perform such illegal acts. Such policies could in turn reduce the number of people in jail resulting in less overcrowded prisons as wells as providing a method for combating corruption. The people of a country have a right to inquire about the actions of their countries leaders. Issues found in a political leaders exploits creates political unrest and directly affect the economy of these countries. South Africa and Brazil exemplify the repercussions in an economy when an examination of a leaders’ ethics occurred. Most notable comparisons between the two countries involve what the leaders accomplished in their position of power to excite such a negative reaction, the unfavorable impacts in these countries’ economies, and the people’s reactions to the allegations made against their president.

Through changes of economy such as trade, social structures conflict between the different classes and political aspects of Brazil were unique as opposed to Spanish America. There has been speculation that the decriminalization of all drugs in Portugal has caused a rapid increase in the number of crimes and homicides in Portugal. Between 2001- 2006, the number of homicides increased by 40% from 105 to 148 per year (Murkin, 1). This may be attributed to the fact that now that drugs are legal, drug availability is more prevalent making it much harder for dealers to compete for customers and eventually resulting in turf battles ending in homicides. This could also be a product of directly drug related murders since getting high, causing the person be have less judgment over his or her self, may lead to reckless actions.
