Similarly to the Oakland boys, finally, I too have suffered from over/under policing. Certain negative behaviors in my elementary were overlooked, such as bullying, despite the zero-tolerance policy. Most teachers would ignore the zero-tolerance policy and choose not to police my bully's bad behavior. When it came to pushing me down stairs, calling me fat and ugly, or rubbing my possessions into the dirt to ruin them, my teachers were lackluster in their policing. However when it came to minor, easily punishable 'crimes' that I committed, like wiggling in my chair, they were over-policing machines. This led me to the same distrust in authority as it did for the Oakland boys, I despised my teachers and thought of them as incompetent, unfair, and part of the problem- not to be trusted.
Discretion is defined as “ power of free decision or latitude of choice within certain legal bounds” ( merriam-webster dictionary ).Police have discretion in most jobs they take on while out in the field. This could range from a wide variety of choices from drawing his weapon to shooting his weapon, or just issuing a traffic ticket or smaller violation. With such a wide gap between little choices to life or death a policeman’s discretion can either make or break himself, his department, and how the citizens look at policing today. Regardless discretion must be used in a lot of the police officers day, and when it's used right it gives the officer and community to have a more just society.
Policing today consists of three eras. These three eras have adapted and built off one another through history (Parr, 2014). The first era started around 1840 to 1930, and is known as the Political Era. The second Era is known as the Reform Era and lasted from 1930 to 1970. The last era is called the Community-Problem Solving Era and is still being adapted and used today. The Political Era emphasizes on meeting the needs of politicians. The police were given power through the local government and the community had very little say in what happened. The police and politicians worked together to control the city and neighborhoods (Palmiotto, 2000). This was often referred to as a ward. The ward politician controlled all the police in their neighborhood. The police officers tasks included not only crime prevention and order but a lot of social service activities that involved their neighborhoods. The officers resembled the ethnic backgrounds of the neighborhoods they lived and worked in and performed their patrols gaining trust from their community (Palmiotto, 2000). This allowed positive integration of police officers leading to more public service, and the trust of the officers to stop crime when is starts.
When it comes to the topic of police reform, many agree that our country is long overdue for it, however, the questions are how exactly do we, as a nation, go about changing one of the most powerful structures to exist in the country. While some believe that reform must come from within the individually flawed police departments, others argue that the entire criminal justice system needs an overhaul. In this Response essay about Ta-Nehisti Coastes’ essay “The Myth of Police Reform,” Coates is saying, that the criminal-justice system is not working as well as it should. They are putting people, especially African Americans in jail or killing them. Some people have a mental or physical disability or a have a drug or alcohol problem that
Eminent domain is the inherent power of the government to take over a citizen's property for public use without the owner's consent. Initially, this public policy originated in the Middle Ages throughout the world. It became part of the British common law before reaching the United States where it was then illustrated in the US Constitution in 1791 (Britannica: eminent domain). The Fifth Amendment granted the federal government the right
The taking of land refers “to government seizure, regulation, or intrusion on private property for which the owner is entitled to compensations under the Fifth Amendment to the U.S. Constitution” (Halbert, Terry, Inguilli, & Elaine, 2012). There is also regulatory takings, which is the “newly enforceable restrictions on the use of ones property, such as a newly adopted restrictions on building in certain areas of wetlands.” (Halbert, Terry, Inguilli, & Elaine, 2012). All over the world governments take private land from its owners to benefit the public. In the United States it is called emanated domain, and has been a controversial issue till this day. By evaluating the case of Lucas V South Carolina Coastal Council of 1992 and evaluating the two types of regulatory action that automatically trigger compensation as takings; the dissent object to the takings approach laid out by the majority in this case; cities ability to take private property and transfer it to private developers for the sake of economic revitalization; the ethical issues surrounding the principle of using eminent domain to take away the property ownership rights of individuals; and the feeling I would have if the government was to take my land.
In “The Myth of Police Reform” Coates is saying, That the criminal justice system is not working as well as it should. They are putting people, especially African Americans in jail or killing them. Some people have mental or physical disabilities or have drug or alcohol problems That’s been one of the reasons That they will get killed. All police departments understand that African Americans are just like other people to be treated. The police officers are sending men and women in fear that people are getting killed for reasons like having a drug or alcohol and mental problems. No matter who it is they are getting killed. “They do not urge them to make no sudden movements in the presence of police out of profound respect for the democratic
The use of eminent domain power is used to promote economic development, especially in urban area of the United States leaving this to be a very controversial topic even in present day. In most circumstances when eminent domain used for the public good projects intended for the good such as highways, bridges, schools, and even government buildings. This policy pertain to every federal, state, local governments and it does not require very much constitutional recognition and is usually considered an attribute to the sovereign law makers in power. There have been many cases that have been brought up against the government in an attempt to regulate the power of the governments use to seize private property. Such a political push to reform eminent domain laws, including the regulation of compensation, hold outs, relocation assistance to minimize the excessive taking of private land. Many cities across the United States
Another economic concept is “Private Property”. Private Property is the right of private persons and firms to own property, land and resources. This allows businesses to own land and build what they want to build in order to successfully thrive in their work. Most of the country is privately owned by businesses, not the government. The government does have some power though, for example, a company may have to follow certain laws from OSHA, and can be shut down for disobeying laws. What this concept simply says is that anyone
Today, police discretion is a very important aspect to the criminal justice field. There are different substances where discretion is not discipline enough or not monitored enough even though having discretion is not always bad. There are still ways to abuse it and today police officers have their own way of using police discretion for different situations. Discretion can be defined as someone having the power or authority to make a decision based on what they feel should be done in a certain situation. Police officers are taught how to handle certain situations according the law. But when the officer is on duty no one is there to make sure that they are making the right decisions that follow the law and according to the law, there are not set guidelines in the law for police discretion which give the police officer an advantage. Discretion is used by police officers when they are facing a decision with a bunch of results that could handle the situation but the officer has control to pick which result they would want to choose.
I believe that the government taking a person’s home and allowing another private company or individual to utilize it pushes the limits of our private property rights. In Lakewood Ohio, there is situation described in which the mayor wants to remove a couple’s home
As technology continues to advance, the people in this world tend to follow those changes to improve their quality of life. It is important for law enforcement agencies to evolve and adapt to those changes. A quasi-military structured law enforcement organization is a great way to adapt to new policies and changes. Law enforcement agencies and the military share very similar rank and command structures. A military structured police agency is often times looked at in a negative way. Policing is a dangerous occupation; one you might find yourself placed in a situation where you may legally have to take the life of another human being. Although a quasi-military law enforcement agency is more disciplined and better prepared for a crisis situation, it is not ideal for daily law enforcement operations.
Policing is a vital and visible component of our criminal justice system. To protect and serve is a basic responsibility of every police department, specifically in Canada. In Canada, citizens have a lot of faith in the police, as they look forward to police for any kind of safety concerns they may have, yet people are also very quick to judge the police. The police play an important role in minimizing threats and maximizing safety of their citizens. The role of the police in our society is shaped by social, economic and political factors.
Within our police system in America, there are gaps and loopholes that give leeway to police officials who either abuse the authority given to them or do not represent the ethical standards that they are expected to live up to. Because of the nature of police work, there is a potential for deterioration of these ethical and moral standards through deviance, misconduct, corruption, and favoritism. Although these standards are set in place, many police are not held accountable for their actions and can easily get by with the mistreatment of others. While not every police abuses his or her power, the increasingly large percentage that do present a problem that must be recognized by the public as well as those in charge of police departments
In today's society the police, play may roles. They are the peacekeepers, law enforcement and many other jobs. However, recently they have become the subject of a very heated and large debate. Many believe that the police should give up their brute type tactics for a more civilized and humanized approach, while others feel that the police should crack down on the most insignificant of offences to type and disparage crimes that are more serious. In this paper, we will be analyzing both sides of this issue, from the look of the police administration to the public's view of it. When we mention today's police force we will be using the New York City police force as are basis of comparison, because they seem to
