The Importance Of The Second Amendment

On December 15, 1791, the Bill of Rights was ratified effective by Congress. These first ten amendments to the Constitution of the United States of America promised the states certain rights and freedoms which could not be infringed by the government. After all, the founding fathers knew from experience that men in their weakness were often tempted by power. They had become all too familiar with this when under the control of King George in England. Therefore, in order to protect the future people of their beautiful country, they promised certain liberties which could not be taken away. The issues the federal Judge have with 2nd amendment is that it doesn't cover weapons are either military in nature or resemble military weapons. If people can't have guns and weapons to defend themselves or just to have guns to feel protceted. The judges say the military weapons or okay than the people should have military weapons since the military weapons are different from bear arms. The enlightened judge doesn't like the language of the constitution because they think it's outdated and doesn't go right with our modern life today.

The 2nd Amendment, which is often times the most controversial amendment is the "right to bear arms," but what exactly does that mean? That is one of the controversies surrounding the amendment, what does it mean that people have the right to bear arms? Who has the right to bear arms? Just the Militia? Does the public have the right to own and operate a weapon? In this blog, I will cover three topics; 1) How Does the 2nd Amendment Tie Into Human Rights? 2) Why Is the 2nd Amendment So Controversial? and 3) Why Do People Think It's So Important?

The second amendment of the United States reads, “a well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed” (Constitution). This has started a huge debate on whether or not this should be true. On one hand people believe that “the right of the people to keep and bear Arms" make an individual right in constitution. Under this theory the United States Constitution restricts legislative bodies from prohibiting firearm possession, or at the very least, the Amendment renders prohibitory and restrictive regulation presumptively unconstitutional. Most Americans of today should cling to the second amendment for their protection because that will allow citizens to hold their firearms wherever they go for their own safety. People also believe that by adhering to the second amendment, would keep them informed about the upcoming attacks so citizens would not be in fear. Many people have been harmed by legal firearms for a long time now and I truly believe that there should be gun laws in every state for them to be banned

The first Laws of the land. The foundation on which our country would stand for years to come. Drafted in 1791 by James Madison the Bill of rights which holds the 2ns Amendment was formed during the very first presidency of The Unites States, George Washington. The United States was forming the foundation of our country. In a time where the country wanted to form its Laws but also allow the citizens to feel secure they would not oppress them. Beginning with The American War of Independence the citizens wanted to feel safe. Fighting Great Britain for its Independence America wanted to be firm and strong, with its citizens on board.

“We hold these truths to be self-evident” says the often-quoted Declaration of Independence. Of course, that depends on whom you mean when you say “We”. Self-evident truths are only obvious to those that have already discovered those truths. It seems to be part of the human condition to assume that if I know something, then others must already know it, too. Clearly, this is not always the case.

As a constitutional researcher, I’ve been assigned to take a closer look at the Second Amendment of the US Constitution. The Second Constitution reads “A well-regulated militia, being necessary to the societies of a free state, the right of people to keep and to bear arms shall not be infringed.” Specifically, I am reviewing the portion of the amendment that speaks to the right to bear arms. I believe there are several constitutional issues with this part of the amendment that may not apply to today’s world.

The Second Amendment to the Constitution gave United States citizens the right to bear arms. Although, the Second Amendment stated: “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms. However, the framers could not foresee the type of violence we have in our cities today. Innocent citizens have and are being brutally killed due to this amendment. Stricter gun control laws must be enacted to receive these types of weapons.

The second amendment was likely created because while Britain had ruled America, there was a standing army in the colonies. The Americans no longer trusted standing armies. Instead, they had they had state militias that made up of volunteers. This is important because it helps insure that tyranny will not occur by spreading out the privilege of governing military forces to officials that are elected by the people. The second right protected in the second amendment is the right to bear arms. There is has been much debate over the meaning of this part of the amendment. While some people believe that owning guns protects the right to self-defense, others think that, unlike the time that this bill was passed, personal gun are not necessary to Americans’

The Second Amendment is making headlines these days. The Second Amendment states, A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. This Amendment was ratified in December of 1791. This amendment was proposed by James Madison, after the constitution was ratified. “James Madison originally proposed the Second Amendment shortly after the Constitution was officially ratified as a way to provide more power to state militias…” (Brooks, The Second Amendment and the Right to Bear Arms) The latest court case on the Second Amendment is the Peruta v. California “case”. But that was turned down the case. The Second Amendment is important because it provides self defense, enables U.S. citizens to hunt for food, and it allows for citizens of states in the U.S. to form militias.

This amendment was embraced on December 15, 1791, taking in consideration that American citizens have a natural right to self-defense and they can help to accomplish the following purposes:

The second amendment is the most important because it allows people to protect themselves as well as others, fight against government tyranny and war, and also hunt for game.

The Second Amendment of the constitution of the United States was adopted on December 15, 1791. “A well-regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed” (Gun Control Laws). There is controversy on the exact meaning of the Second Amendment. There is also a lot of controversy surrounding guns and gun laws, and what could be done to prevent gun violence and mass shootings in our country. There has to be a way to prevent gun violence, while still upholding the Second Amendment and protecting the rights of law abiding citizens who have the right to own and carry guns legally.
