I chose this case because I have heard about the Miranda warning many times in all of my AOJ classes. I know what The Miranda rights are and there purpose but I don’t know the whole story about Miranda, what he did, what happened at trial, why it went all the way up to the U. S. Supreme Court and how the Miranda warning came to be. I would like to know the whole story behind The Miranda trial and what the Supreme Court ruling was.
On the early morning of March 3, 1963 in Phoenix, Arizona an 18-year-old girl was kidnapped and raped. She was take to the desert were she was raped then she was left near her home. About a week later she spotted the vehicle that was used in the kidnapping/rape and she wrought down the license plate number and reported it to police. The car belonged to Ernesto Miranda’s girlfriend (Twila Hoffman) and he fit the description. This made Ernesto Miranda a suspect.
Ernesto Miranda was born in Phoenix Arizona on March 9th 1941. He first started to get in trouble in about eighth grade after his mother passed away. His father remarried but Ernesto did not have a good relationship with his father. He also avoided his Stepmother and his brothers. His first conviction was when he was in eighth grade for burglary.
