The New York State Secure Ammunition and Firearms Enforcement Act of 2013 or SAFE Act was signed into law January 15, 2013. The law was written in reaction to the Sandy Hook Elementary School shooting in Newtown, Connecticut. This Bill passed the New York State Senate on January 14th, and the State Assembly January 15th. Not long after, the bill was signed by Governor Andrew Cuomo. With this new bill in place, New York State has climbed to the top with the toughest gun control law in the United States. Throughout this paper I will discuss facts and figures along with my own personal thoughts and views. Topics to be discussed will be; what is our Second Amendment rights and how is it perceived, the facts on NYS crime rate and gun violence, who has the SAFE Act affected, how the SAFE Act has affected those affected, what the citizens of New York are doing about the SAFE Act, and whether the SAFE Act has made New York a safer state.
First, let’s take a minute and discuss the Second Amendment. The Second Amendment to the United States Constitution is the part of the United States Bill of Rights that protects the right of the people to keep and bear arms. It was implemented on December 15, 1791, along with the rest of the Bill of Rights. Now ask yourself what does the Second Amendment do? The Second Amendment, in order for the role it plays in our to society to be fully understood, must be contemplated in the same way that the Founding Fathers contemplated its creation so many years ago. The need for the Second Amendment rose from the need of the American people to feel safe and secure in the country they had built on the idea of independence, and to have the means to defend themselves, their families, and their rights against all who might try to stand in the way of their freedom – including National Security. When it was written, we had been oppressed by British rule. This law was a good way to prevent the senseless killing in the event that our young republic didn’t make it. However, laws wouldn’t necessarily matter in that instance.

This theory, which claims that the second amendment was written for the military, is incorrect. The collective rights theory infringes and undermines the rights of the militia. Thinking back to how this country was founded, the colonists fought a revolution against the Crown in order to gain independence. A shadow revolutionary government was formed and Militias were trained to prepare for armed conflict. Furthermore, the second amendment is a failsafe for the citizenry to take back power from their own government, should it ever become tyrannical. Therefore the citizenry also needs to be able to

Imagine being shaken awake by the shatter of broken glass in the dead of night. A break-in is a occurring, so you reach for your gun, but find nothing but air beneath your palm as your door creaks open. This is a nightmare that all Americans could face. The 2nd amendment is one of the most controversial amendments in the Bill of Rights and has been a frequently discussed topic in the media. The 2nd amendment is extremely important in modern American society because it allows us to own guns for self defense, to use firearms for hunting , and it gives us a way to fight back against a tyrannical government.
