Controversy surrounds many of the United States’ foreign policy decisions. Regardless of the results of the policy, politics takes over. One of the most important political issues that Democrats and Republicans argue over today regards national security. The biggest controversial national security interest today is located in Cuba. Guantanamo Bay is located inside the United States Naval base and imprisons suspected terrorists. The Guantanamo Bay Detention Center in Cuba should be closed due to the fact that the standards for evidence in hearings are poor, the United States has proved that it can hold prisoners on its own soil or in other countries, the sheer amount of money spent to keep the detention center open is extremely wasteful, and the human rights violations that occur in the prison alone are enough to justify its closure. Guantanamo Bay perpetuates torture and coercion to produce desired confessions from inmates, which lowers the threshold for …show more content…
The government can put an end to the controversy and spectacle surrounding what Guantanamo Bay is and does; yet it is still unable to officially close down the prison. There are many positive impacts that closing the prison will have on the United States and the global community collectively. Setting the precedent for being on the forefront of human rights for other countries to follow is one major plus. Human rights violations occur across the globe, in the United States and elsewhere, and establishing a standard for everyone to follow will be a huge step for improving the quality of life for all of Earth’s inhabitants. The Guantanamo Bay Detention Center desperately needs to be closed in an effort to prevent other countries from aiding and abetting horrific violations to society’s civil
Through the social contract theory comes, The Guantanamo Bay. This prison was established in 1898 when the United States took control of Cuba during the Spanish-American War. After September 11, 2001, the government knew that the “war on terror” between the United States and terrorists would not be good. Therefore, they took a new measures. Since early 2002, a part of the prison has imprisoned a small group of detainment camps for the Al Qaeda and the Taliban combatants who were captured by the AMerican military post-9/11 wars in Afghanistan and
Hamdi et al. v. Rumsfeld, Secretary of Defense, et al. could prove the undoing of the Bush administration’s legal defense of the abuses at Guantanamo Bay. In this case, four British citizens are suing Secretary of Defense Donald Rumsfeld as well as a host of Army and Air Force Generals and policy apparatchiks for allegedly authorizing the use of torture in Afghanistan and Guantanamo Bay. The four were captured in Afghanistan, either by Americans or America’s ally, the Northern Alliance, and transported to Guantanamo Bay in Cuba where they were held for over two years. Their status there was not as enemy combatant, which guaranteed them certain protections under the Geneva Convention, but rather as
Did you know, as American taxpayers, maintaining the prison at Guantánamo has costed $4.8 billion since it had opened in 2002? Well this al back to “ The Global War on Terror” under the Bush administration that,. response to the 9/11 attacks, targeted middle eastern regions of the world;, collecting men from left to right by heavily armed American soldiers. Unfortunately, some of them are destined to pay for another man’s crime by serving time in Guantanamo Bay. Guantanamo Bay, located within a naval base in Cuba, became a facility purposed to hold alleged enemy combatants and terrorists alike. Because of later documented injustices reported against detainees, it gained negative spotlight by both citizens and world leaders. When Obama succeeded in presidency, closing the facility became one of his priorities for a number of reasons.
There is a controversy involving Guantanamo bay which is should it still be kept open or should it be closed there are many reasons. Why people want to keep it open and many reasons why the people want to close it.Is Guantanamo as important as it use to be are we still in as much of a risk as we were during the era of 911 to need Guantanamo bay well here are some of the issues explaining if Guantanamo should or should not stay open.
The United States military base in Guantanamo Bay, Cuba, has been occupied by over 700 Middle Eastern men suspected of terrorism since 2002. It has been home to some of the most heinous suspected terrorist to ever walk on this Earth. What to do with this military base, has been a major source of conflict within our nation and with other nations for over a decade, with no real reasoning substantial enough to close the base. Although our government has come forward and declared that interrogation methods used on some of the detainees has been unethical and has broken some United States laws. But closing Guantanamo Bay is a task that should not be pursued, because it causes more problems to our countries people, our diplomatic and
Guantanamo Bay hasn't always been a jail like facility, with the ability to torture terrorists. Cuba is located in southern east point in cuba(“Cuba”). After the Spanish-american war ended (1898) we got a piece of land in cuba as a trophy for winning the war.(“Guantanamo”). The U.S. military controlled cuba in 1899(“Cuba”). Before terrorism the main purpose of Guantanamo
A Writ of Habeas Corpus is an authoritative order forcing governments to provide the “body” of the detainee in which the legality of their detention and individual liberties will be challenged. Historically associated with civil liberty violation and the injustice of illegally detaining potentially enemies of the state, jurisdictional issues regarding their detaining location have made justice difficult to administer and deliver. Detaining enemies for their participation, involvement, and/or ties to threats of terror towards the United States will result the confinement of combatants, as solidified by the US Constitution, however, to what extent will they be forced to stay?. Residents of Guantanamo Bay are just; enemies of the
The Supreme Court ruled that if someone is detained by the American government, then they are entitled to basic constitutional rights, which does not allow the detainment of a person before bringing them before a court or a judge. Since this injustice is taking place in Guantanamo, innocent men are being placed there. Everyone being taken to GTMO is also protected from cruel and unusual punishment regardless of what they have been accused of. Therefore, the CIA’s use of various torture methods and brutal interrogations are not acceptable by law. Lakhdar Boumediene was one of many men who were taken away from their family and punished for a crime they did not commit. He will forever be affected by the seven years of mental and physical abuse that he endured at Guantanamo Bay Detention Camp. After 14 years, why is the U.S. still forcing faultless men to go to a place that makes them want to end their
Guantanamo Bay a prison for terrorist located in Guantanamo Bay, Cuba in the United States Navy base. It has been open for hundred and thirteen years as a naval base since 1903 after the Spanish-American war. While the detention camp came into being in 2002 as a result of the September 11th terrorist attacks in the United States. There are two sides to argument those that wants it closed and those that want it to remain open to house the terrorist or enemy combatants that belong to no nation that will claim them, but some nations may or may not support them. I am going to talk about some of the points brought up in the CQ researcher article I read written by Patrick Marshall, gathered from a multitude of sources.
Keeping Guantanamo Bay open there would be less psychological assaults in this world. A few people may believe that by shutting Guantanamo Bay jail there would be less dangers in this world. The Washington Post expresses says that "considered, the detainment office at Guantanamo Bay has assumed a part in the war against fear mongers by keeping them off the front line and taking into consideration cross examinations." However, there are accusations of abusive treatment at Guantanamo Bay Detention Center, this individuals are dangerous, and yet, still are permitted recreational services and facilities. Americans need to realize the situation and the danger that these individuals could put harm on the nation.
The US continues to hold close to 400 detainees in Guantanamo Bay, many of whom have been held for five years without charge and without access to court to challenge the legality of their detention. Congress should hold oversight hearings about the future of Guantanamo, and push the administration to put forth a plan for its closure.
Continuing the practice of “enhanced interrogation” only increases the animosity foreign countries feel towards our own soldiers and provides justification for brutality against our own nation. Imprisonment camps such as Abu Ghraib were not caused by a handful of sinful, sleep deprived, ignorant soldiers. It was due to the result of lack of leadership and national security. The government lost the focus and end goal of their measures. Guantanamo Bay and Abu Ghraib is nothing but a national disgrace. It demonstrated that torture is frequently ineffective, but always harmful. The latent functions of torture prove too far outweigh the manifest. In response to the tragedy, the government must do more than verbally condemn torture. For a commitment to change, it must be demonstrated in actions and to calm the animosity built from the United States actions. Only if we truly understand the lessons from our mistakes and take leaps of faith into the right direction will any good emerge from the sinful nature we
In 2007, the U.S. Supreme Court decided, again, to review whether or not the prisoners at Guantanamo Bay, Cuba may file a writ of habeas corpus giving those prisoners the power to challenge the lawfulness of their confinement. It is highly unusual for the Supreme Court to revisit such a decision once a case is rejected so the move created quite a buzz in the world of politics. In the article Primer: Guantanamo Detainees’ Rights, Ann Hawke explains the history behind this issue and provides clarity about its intentions.
Guantanamo Bay, also known as Gitmo, is a United States Detention Camp located in the Guantanamo Naval Base in South Eastern Cuba. The United States gained control of the Guantanamo Bay area in the 1903 Cuban-American treaty in which the United States gained the right to control the Cuban territory while at the same time recognizing the Cuban state sovereignty (Nofi, 112). In the year 1970, the United States began to use part of the Guantanamo Naval Base as a detention camp for Cubans and Haitians that were caught in the high sea trying to get into the United States illegally (Gott, 78). However, the detention camp later became a political tool, which politicians used for their selfish
Through Langbein’s discussion of the history of torture, it is evident that throughout history we have made grave mistakes but thought that in that moment they were correct. His essay shows that with time and growth, those choices once made may not have been the best possible choice at that time. This could be applied to the issues surrounding Guantanamo Bay and the torture of suspected terrorist detainees. Most Americans may not mind the idea of torturing someone who has killed so many citizens if it means saving many lives. While this utilitarian approach has its benefits, it is not a decision that should be made so hastily. The use of torture to gain information may have had its moments of effectiveness, but with the few who have been tortured for years and have yet to talk, it begs the question, is this really
