The Relationship With The Legislative Branch

It’s been argued ever since the constitution was made how in touch the congress members where with the people who elect them and this argument still goes on today. With the 425 members of the House each has a district which averages nearly 650,000 people, this is a vast number with many arguing that there is little chance that congress can be in touch with the people when they have to represent such vast numbers. However, the other side of the argument displays evidence that in fact the members of congress are able to stay in touch and represent the people who elect them.

The legislative branch is the most powerful branch in government. The legislative branch is in charge of making and passing laws. They have the power to override a president’s decision, stop laws from being passed, and basically control all decisions the governments makes. The legislative branch, also called the congress, consists of the House of Representatives and the senate. The reason for two houses of congress is to balance out the concerns of smaller but more populated states against states that are larger but with less population (www.Usgovinfo.com).

Today, career politicians are constantly looking for what will aid them in getting reelected. They become more loyal to their campaign fund contributers than to the people whom they represent. This increases the likelihood of having corrupted politicians in office, as they use the government as a vehicle to further their own career (Kurfirst, 1996, p. 123, 129). George Will, a well-known political journalist, was quoted as saying “[The] worst feature of professionalism in politics is that it obliterates the proper distance between the representatives and the represented” (Kurfirst, 1996, p. 125). Even James Madison agreed that legislators were meant to represent the people, not hold office as a career. In The Federalist No. 57 (1788), he wrote, “From this change of men must proceed a change of opinions; and from a change of opinions, a change of measures.” The lack of new faces in Congress today symbolizes that the American legislative branch is straying from its intended purpose.

I believe the legislative branch has more power according to the constitution. One reason why i believe this is the legislative branch has more power The legislative branch makes the laws for the country. The power includes passing laws, spending bills, and approving treaties. If the President vetoes the law, then the House and Senate can vote again on it. If 2/3rds of both approve, it can become a law anyway. Judges confirmed by the Senate.

The inter workings of Congress have been studied extensively by Richard Fenno and David R. Mayhew. Mayhew’s study of Congress took place in Washington, while Richard Fenno conducted his research by following politicians within their congressional district. Mayhew attributes three primary goals to congressmen- getting reelected, achieving influence within Congress and making “good Policy”. Fenno also attributes three basic goals, having influence inside the House than other congressmen. Second, helping their constituents and thereby insuring their reelection, and lastly helping make good policy. The purpose of this paper is to research a member of Congress and to make a direct connection between his activity in Washington and his home district. The paper will answer whether the congressmen is a delegate or trustee. Are the actions a pursuit for reelection? Are the committee assignments a path for movement within the House or outside? What legislation has he/she sponsored or co-sponsored and does it directly reflect his/her districts political view. And finally, do major industries and interest groups within his/she district affect the way he/she votes.

In the past century, people continued to express an increasingly discontent view of Congress especially true when one looks back before the Clinton Impeachment debacle As the size of the nation and the number of congressman have grown, the congress has come under attack by both public influences and congressman themselves. Yet looking at one congressman's relationship with his or her constituents, it would be hard to believe that this is the branch of government that has come under suspect. The United States Congress is more than likely the most significant representative institution in the United States government. Each member of Congress has a primary obligation to the district, to his or her constituency. Though Congress is divided into two parts, called the House of Representatives and the Senate, they both play different roles in the legislature process. Senate is more deliberative and the House is the more centralized and organized. Congress is supposed to represent the American people but they will not always make the “right” decisions, according to some individuals. Obviously it is impossible to please everybody, but surely the laws that are being passed are because Congress views some sort of usefulness from it. There are two different types of representation that was spoken about in the chapter including sociological and agency representation. Sociological is based off of the idea that if two individuals have similar background, character, interests, and perspectives, then they can correctly represent others’ views. Agency is when a representative is held accountable to a constituency for when that constituency is represented poorly. The constituents have the power to hire and fire their representatives.

American politics is often defined by a continuing power conflict between the executive and the legislative branches of the government. This struggle for political power between the two stronger branches of the three is inherent in the Constitution, itself. The concepts of separation of powers and checks and balances ensure that the branches of government will remain in conflict and provide a balance that keeps the entire government under control. As it was first established, the executive branch was much smaller and weaker than as we know it today. Consequently, the legislative branch was unquestionably dominant. When people think about who represents them, who comes to mind first? The Senator? The Representative? The mayor? Stephen Medvic, In Defense of Politicians, discusses why Americans feel that politicians are dishonest. In 2007, a Gallup poll about honesty and ethical standards for occupations, showed that only 12 and 9 percent of people felt that Congressmen and State office holders held high standards, (Medvic p. 2). In addition, Americans tend to like their representatives more than the members of Congress because they view them as actual people. Americans view Congress as a group of politicians who are greedy and not representing their interests, (Medvic p. 4).
