The Cardigan family has made a name for themselves in the sweater industry. CARDWARE, Inc. is growing and has opened ten new stores nationwide under the name “The Sporty One.” The slogan the store advertises its sports ware with is “You don’t have to be an athlete to look and feel like one.” CARDWARE, Inc. wants to employ slender, young employees, so that the clothing line can keep with the sporty image. They placed an ad online advertising that they wanted to hire an experienced salesperson, in retail sales or marketing, who is energetic, youthful, athletic, and able to “sport” the clothing lines of The Sporty One with style. Petunia Rotunda, a middle aged, slightly plump woman, who has five years of retail experience working in a garden shop. Noah Dahl, a college graduate in marketing, a slender racquetball player who has not had any retail experience. Petunia and Noah …show more content…
She says that she has more qualifications than Noah and she should have been the one who was hired. CARDWARE thought that Noah was more qualified per the advertisement as well as company image and future plans for the company. A company is able to employ who they want and there is nothing wrong with that. Part 2: If Petunia brings a lawsuit based on negligence against CARDWARE and The Sporty One, will CARDWARE be responsible for Noah’s behavior? If so, under what theory? If Petunia brings a lawsuit against CARDWARE and The Sporty One, the two companies will be held responsible for Noah’s behavior, under the doctrine of respondeat superior theory. Respondeat superior is when the employer can be liable for intentional torts of the employee that are committed within the course and scope of employment, just as the employer is liable for negligence (Miller, 2013). CARDWARE should not be liable for any injuries that may happen because of Noah’s behavior. Part 2: What defenses might CARDWARE
We live in the generation of fashion and technology. Our wants fashionably override our needs in life. The Australian fashion industry has come to expect a huge splash from Sportsgirl at the Melbourne L’Oreal Fashion Festival, and 2005 set a new benchmark. Ideally, the business will come to the customer by promoting their brand through the launches
1.3. In order to estimate the peso discount rate, assume that the International Fisher Effect (IFE) holds. Groupe Ariel's Euro hurdle rate for a project of this type was 8%. Assume that inflation rates are expected to be 7% in Mexico and 3% in France.
There are two defences to an action in negligence: contributory negligence and voluntary assumption of risk. (FoBL, 2005, p83) This case only involves contributory negligence.
Cardware advertisement specifically outlined what they were looking for. They did not have an age or anything to do with physical aspect. In this case the hiring process did not use the genuine Bona fide Occupational job qualification requirements. According to (Miller,2013) bona fide occupational qualification is the criteria employers used to make decisions to hire someone based on age, race, origin or sex. This technique should be necessary if it relates to a specific type of job or duty (2013). Cardware advertisement states, “WANTED: Salesperson experienced in retail sales or marketing preferred, energetic, youthful, athletic, and able to “sport” the clothing lines of The Sporty One with style. The Sporty One is a division of CARDWARE Inc. and proud to be an Equal Opportunity Employer”. Petunia is going based on feelings, and thinking she was not hired because of her age. This was hardly the situation because both applicants were equally qualified. Petunia has five years’ retail experience while, Noah did not have the retail experience but he graduated in marketing and is also a little more fit because he played
The University of Alberta itself recommended that I apply for your field engineer position for a summer job in 2018. ABC Sample Company would be the perfect experience for a first-year undergraduate student such as myself and would provide me with the initial experience needed to be able to give back to the company itself. Engineering in the field has been my dream career for over twelve years, and my work ethic displays such desire.
In our new store “Dress 4 Less” we know that it is going to be small with a maximum occupancy of 124 persons. Everyone is welcome. But we’re only going to focus on providing great customer service, great prices, and great quality on our clothing for the
There were two main driving issues behind our analysis of this Sport Obermeyer case: the measurement and understanding of demand from uncertain and disparate forecasts, and the allocation of production between factories in Hong Kong and Mainland China (Lo Village, Guangdong). The main challenges facing the company were long lead times, little to no feedback from the market before the first production decision (the first real demand signal is at the Las Vegas trade show in March) and inaccurate forecasts along with the lost profits that can result.
Jeremy Waldron, a professor of law and society, demonstrates the institution of tort liability and the issues that arises on the desert-based system. With the example of Fate, having to pay a large amount of money to Hurt for a moment of carelessness while doing the same act as Fortune, he shows how tort liability can be unjust and unfair. Two cases present examples of how Waldron would approve and disapprove the rulings.
Before she landed this job in early January, she had an extended seven months of crazy job searches. She said “It became scary that in seven months I couldn’t find a single marketing job to hire me. I knew it was competitive but not like this.” One day she went for then interview where she was interviewed by the head of the Human Resource from Century Bank. She said this interview was more of a formal interview where they asked the typical questions such as “ Tell me about yourself.” After a week, the head of the Marketing Paul called her and wanted to do
We chose not to interview the other three individuals that applied because we believe they would not fit our criteria for the job description and job specifications. Rosa Bonita did not elaborate on any of her experiences on her resume which did not give us a good impression. We believe that her vague impression on paper reflected her work ethic, below average and not in parallel with Panera’s value of hard work. The next candidate that we did not believe was a good fit was Hannah Bestor. This individual has an outstanding list of experiences but she did not match with the assistant manager position that we posted. Her education was primarily focused around biology and chemistry, and we believe that she may be too qualified. Although we are
Mitchell Modell, the CEO of Modell's Sporting Goods which has 153-store chain, was prepared to shave his head, wear an oversized ‘walrus’ moustache and transformed into “Joey Glick,” who is a contestant on a reality show to possibly win money for his business. He will be working inside the company’s warehouse and two of the store outlets as well as driving a truck. During his week as Joey Glick, folded clothes, drove forklifts, ran a cash register, and were a stock boy, sales associate and shipping clerk. His employees were in the dark when it came to knowing the fact that he was working alongside the boss, though Modell’s fake moustache had some problems during a 100-degree day in the
In the past, the booming economy had allowed for year to year increase in their sales because people had larger discretionary incomes. But due to the recession, smaller independent retailers had to markdown their items in order to stay in business because designer outlet stores are getting more traffic; so will Harry Rosen follow in suit? Or in order to maintain the integrity of the quality products they offer, will they continue their higher pricing and settle for a lower market share?

Tanya is a 21-year-old African American female who was referred by Southern Psychiatric Unit after she called 911 as a result of beings annoyed with her family and co-workers. My decision is to find a methodology of calculating more accurate demand and supply figures to address the unpredictable world of short life cycle fashion. A good decision would result in minimizing the order cycle lead time necessary to produce the ski wear and have it delivered to retailers in time by establishing a method that would ensure each prediction as a personal decision making process and not the thoughts of a few strong-willed individuals. Another criterion would be by gathering data that would provide clear indication how end-consumers would respond to the company’s current line. A good solution would enable Obermeyer to decide on where and when to source each product (China vs. Hong Kong vs. an alternative
