The Weaknesses Of The Judicial Branch Of Government In The United States

The Articles of Confederation was the first system of government that the united states ever put into force, and is the only one they ever wrote besides the constitution. The articles was created due to a need for the United States to unite during the american revolution, and was basically a loosely bound union of states, so it was obvious that this was essentially just to semi-unite the states in order to fight the british, and they would form a more stable form of government after the fact, which they did when they wrote the constitution. I will now list the provisions of the Articles of Confederation.

The Constitution that was created had a strong central government and weaker state governments. Under the Constitution, Congress was given the power to levy taxes, regulate trade between the states, raise an army, control interstate commerce, and more. A three-branch government was established in which a judicial branch handled disputes in a federal court system, a President headed an executive branch, and a legislative branch. Conversely, the anti-federalists believed in weak central and strong state governments, as the way it was in The Articles of Confederation and believed in strict adherence to the writings of the constitution.

The Founding fathers did not want to create a government with too much power so they created the Articles of Confederation. This government turned out to be a failure. In 1787, the founding fathers met again to create a new framework of government. Most people feared creating a government that was too strong. To create a new government there had to be many compromises, the U.S. Constitution is the result of these compromises reached in Philadelphia in 1787. The Constitution created a bicameral legislature, and each state had equal representation in the Senate (Doc 5). Unlike the Articles where no votes were needed to enact a major legislation, the Constitution required a small amount of authority to proceed with a major legislation. The Constitution created national court system that could sort out the affairs between states and citizens. the different states had a changing population of Federalists and Antifederalists. The Articles of Confederation served as the written document that established the functions of the national government of the United States after it declared independence from Great Britain. Although, it established a weak central government, it contributed to U.S principles because The Articles of Confederation were the basis of the first government of the United States of America. The Articles were essentially the “training wheels” of the government; it was a learning point to create something much greater which became the Constitution. The problems that this weak document created, combined with the Confederation government’s ineffectual response to Shays’ Rebellion, convinced national leaders that a more powerful central government was necessary.

After fighting for our country against Great Britain in the American Revolution, the United States gained independence. We had to figure out how to govern ourselves since we would no longer be under the power of the monarch. The Articles of Confederation was the answer to our problems; even though it established a very weak central government and had many problems, it was our first constitution and our first step towards a solid government. Some of the problems with the Articles included that the Congress had no power to tax, no power to regulate commerce, no power to regulate domestic affairs, no power to enforce laws, and many more. The problems lead to troubles with the States which convinced the Continental Congress to create a convention of delegated people to revise them; this convention was called the Constitutional Convention. The Convention fixed these problems by throwing the Articles out altogether and creating a new Constitution.

In "Address to the People of the United States," Benjamin Rush states, "The confederation...[was] formed under very unfavorable circumstances. We had just emerged from a corrupted monarchy...most of us were ignorant of...republics..." During this time, the government had too much power and Congress did want to make the citizens feel oppressed. The Articles of Confederation gave the government the power to make decisions and pass laws. However, the states could reject the laws because the government had no way to enforce them. The delegates amended this conflict in the Constitution by creating federalism, therefore balancing the power between the states and the federal government. The single branch of government was divided into the executive, judicial, and legislative branches to ensure that the power would be distributed evenly and there would be no corruption.

The articles granted certain limited powers to Congress. The Congress could not raise money through taxes, therefore it relied on contributions from the states, which was not reliable. Passing laws required approval of at least nine of the thirteen states, and amending a document required approval of all thirteen states. Congress had no power to regulate trade between the states or internationally. There was no national army, so the government relied on the individual states to establish a military.

After many years of fighting for independence, America needed a break from any type of government. Well you see in order to have a functioning country you need some type of functioning government. When the idea of a government came up many were fearful of what could happen. What if they resorted back to the old ways? What if all those years of fighting for independence were for nothing? However there Articles did not deal very well with state things. Such as dealing with foreign relations and economic conditions. When accepted the Articles were only to work under certain conditions. Conditions being those such as not interfering with other states and their commerce. Or states that had not paid if war debts.
