The main issues that have to be addressed in this answer are what are mine and the other party’s obligations towards the contract and what are my possible rights of action against entertainment Imports Ltd. The first thing to consider is when was the contract formed and what were the terms of the contract. A) Entertainment Imports Ltd Advertisement I knew about these headsets from the advertisement in the trade magazine. Also, I was influenced by the article on ‘Modern Electronics’ in that magazine. Whether what was stated in the article and the advertisement have a legal obligation on my dealing would depend upon the advertisement being an offer or an invitation to treat and the article/journalist being a party to the contract. As they are not the party, they have no liability towards me. Also the information provided won’t become a part of collateral contract as there was 15 days lapse of time after which I ordered the headsets. The article was general information about some manufacturers whose name was not specified and did not have any correlation with the company with which I dealt. Thus I cannot sue them. B) Website Material The next event that compelled me to buy the headsets was the material on the Entertainment imports limited website which described them as “The latest technology from overseas, a whole new experience in sound reproduction and as like nothing you have ever experienced before”. These statements, though convincing, were inconsistent in their comparison and were farfetched. They were mere puff and lacked promissory intent. For instance, the statement ‘like nothing you have experienced before and a whole new experience”. To whom does it compare to? As every individual, who sees that ad, may have got different good/bad experience with different products. Thus it’s an advertising puff and would not form part of any resulting contractual obligation and therefore cannot be sued. C) Pre-contractual Negotiation My first dealing with the company was through its sales person whom I talked to in mid-March 2014.
