With all the new regulations taking effect in the trucking industry, some believe that smaller carriers will be driven out. They cite the cost of implementing things such as ELDs and compliance with the GHG rules. However, others are saying that small carriers actually won't be exiting the semi-truck industry anytime soon. This contrary view is due, in part, to three unique factors, namely, that they are the majority of trucking companies, median age of drivers, and increased need for capacity and drivers.
Majority Rules
According to Fleet Owner, the vast majority of trucking companies are, by definition, small carriers. In fact, they say that 90 percent of all fleets operate 6 or less trucks and over 97 percent operate less than 20 trucks. When you take those figures into consideration, it is difficult to believe that most, or all, of them will leave the industry permanently. In the past, it was easy to skirt around the hours of service regulations by simply putting erroneous information on the manual log sheet. ELDs will eliminate this, ensuring that every driver is in full compliance. In some cases, this behavior was ignored, if not encouraged, by carriers. Now, companies that once overlooked logbook manipulation will, instead, have to hire new drivers and put more trucks on the road to log the same number of miles.

In the late 1990s, two of the Branson brothers wanted to bring their children and their spouses into the business. The role that these new family members would play in the business created discussions and some altercations. Dave James in particular was opposed to bringing in family members. Dave threatened to leave, and some of the Bransons thought that was a good idea. Owner Operators Independent Drivers Association (OOIDA) filed a lawsuit stating that the ELD mandate violates the drivers 4th Amendment rights. OOIDA argued that “the ELD mandate that requiring electronic monitoring devices on commercial vehicles does not advance safety, is arbitrary and capricious and violates Fourth Amendment protections against unreasonable searches and seizures.” (Dills, 2016) The reasons being that the ELD will automatically flag every violation that the driver has and will show every violation on command to the Department of Transportation enforcement official. Rivalry among established companies: This industry is highly consolidated with only 3 major players - somewhat an oligopoly. The industry is also characterized by numerous price wars between the 2 giants, namely, UPS and FedEx. Rest of the companies generally follow the trends set by these two firms or fall out. The exit barriers to this industry are high. This is due to the investments in hubs, vans, jets and other capital extensive infrastructure.

AM Trucking is a trucking company that provides a range of hauling services specializing in rock and production water hauling. The main service provided by this trucking company will be hauling foundation rock for a rock crushing company and delivering it to oilfield production pads and roads. Additional services will include occasionally providing a heavy equipment towing from multiple Oil companies land leases.
In conclusion, to have a healthy economy, goods must be moved to be bought. The trucking industry has been a leading factor in moving goods since the 1900's. Without it, the United States will die in a minimum of 3 days. As for my thoughts on the matter, I believe the government needs to start deregulating this industry. Many veteran drivers are in their retirement years and we will need an influx of new drivers to take the helm. But unfortunately, many of these new drivers are leaving the industry because they cannot handle the pressure put on them by the government. The American highways are the safest they have ever been, so we need to stop thinking about how safe we can make the roads, and start thinking about how we can keep these guys in the industry.
