Why Do Gun Control Laws?

One of the most important legislation part for control violence in today's society are certainly the laws related to gun control. As with every important question, there are two opposite opinions on whether in Wisconsin we should have about gun control. My opinion is that we should have more gun control in Wisconsin. My point of view is based on the ability to better protect women from domestic abuse; the threat of people who already passed background check, and the necessity to reduce mass shooting in Wisconsin.

The right to bear and keep arms comes from the Second Amendment adopted in 1791. There has been many shootings in U.S. history. One of the most frequent being the Las Vegas shooting killing 59 people and injuring 241. The deadliest shooting in modern U.S. Before that was the Virginia Tech massacre in 2007, only 10 years ago. The second deadliest modern shooting was only a year ago being the Orlando nightclub. Which scares me for what could happen in the future. People who are mentally ill are able to get guns when they should not. The CDC states that guns are responsible for 33,000 deaths a year in the U.S. with ⅔’s being suicides. For a bigger perspective how shootings are a problem here, it is shown that the U.S. is responsible for 31% of public mass shootings. Our homicide rate is ⅙ of Canada’s. These statistics should raise our concern on what type of people own gun and push for stricter regulations.

I believe everyone should have the right to be able to keep a gun on them if they choose. If the government puts laws on guns, it's likely that less people will have a chance at protecting themselves. Also these gun laws will not prevent people from having illegal guns. The Bureau of Alcohol, Tobacco, Firearms and Explosives, otherwise known as the ATF, is one of 60 criminal justice programs under the Department of Justice. Their mission is to regulate and investigate crimes related to the above mentioned items.

The reason why our nation is allowed to bear a large quantity of firearms is due to the Second Amendment of our constitution, which specifically states, "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed." (U.S. Const. am. 2) Because of how vague this amendment is when it comes to law interpretation, it is often used by gun advocates to argue for lenient gun laws. Even though the Second Amendment prevents the federal government from completely banning guns in America, there are still restrictions on the distribution and possession of firearms. Each of the states have their own specific gun laws but generally, a person must obtain a license or permit to purchase or possess a firearm. Also, another thing to note is that all states allow some form of concealed carry, which is carrying a concealed firearm in public. Despite the laws that allow the bearing and distribution of guns, society has multiple viewpoints concerning the usage and appropriateness of the freedom of having the "right to bear arms."

The Federal Bureau of Investigation is a federally-funded agency that was founded in 1908 by Attorney General Charles Bonaparte during the presidency of Theodore Roosevelt. The FBI, formerly know as the Bureau of Investigation (1909-1935) recruited men with previous law enforcement experience to become a part of this exclusive team that aimed to solve law violations such as bankruptcy, naturalization, antitrust, peonage, and land fraud. The Mann Act of 1910, which made transporting women over state lines for “immoral” purposes a crime, led to the first major expansion of jurisdiction for the bureau. During WWI, the FBI took over the responsibility for the Espionage, Selective Service and Sabotage Acts. With it’s head quarters in Washington, D.C., the FBI today has over 56 field offices throughout the United States and Puerto Rico and an estimated 35,000 working agents.

The Bureau of Alcohol, Tobacco, and Firearms is one of the most important Federal Agencies we have. It is dedicated to reducing violent crime, collecting revenue and protecting the public. The ATF, for short, has many different programs for alcohol, firearms, arson and explosives, and tobacco.

“A well-regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.” The right of all Americans to bear arms is a right the Founding Fathers held to equal importance as the Constitution itself. Gun control laws directly violate this right and therefore should not even be under consideration. Even if that issue is overlooked, gun control advocates state that in order to reduce firearm related violence, gun control laws must be implemented to remove the violence caused by firearms. When it comes to the United States, (U.S), the majority of the American people love their seconded amendment rights. As stated in the textbook, Constitutional Law and the Criminal Justice System by J. Scott Harr, Karen M. Hess, Christine Orthmann, the second amendment of the United States Constitution, for the most part, protects the U.S. citizens rights to “keep and bear arms” (Harr, Hess, Orthmann, & Kingsbury, 2015, p. 167). That being said, each state in the U.S. will vary in their firearms laws. For instance, some states make it easier for their residence to purchase or use a firearm; other states may have stricter laws that require a more scrutinized screening process. To be more specific, most states vary in elements, such as the exceptions to the National Instant Criminal Background Check System, or NICS, the waiting period on purchasing firearms; if someone needs a license to own or purchase a gun; if registration is required; and if a record of the firearm sales is sent to the local police. Other factors that will differ from state to state would include, if some firearms are permitted or not allowed to be sold or owned by a state, the concealed carry laws, hunter protection laws; range protection laws, and finally, not all states have firearm injury lawsuit preemption.

This is only a brief description of the duties of the FBI which also consists of investigating bank robberies, white-collar crimes, and organized crime and drug syndicates. The ATF (Bureau of Alcohol, Tobacco, Firearms, and Explosives) administers the U.S. Criminal Code provisions concerning alcohol and tobacco smuggling and diversion. The ATF is also responsible for enforcing all federal laws relating to firearms, explosives, and arson.

Federal law enforcement deals with more serious crime and on a more federal level. It combined is called the Department of Justice(DOJ), which includes the Federal Bureau of Investigation, the Drug Enforcement Administration, the Bureau of Alcohol, Tobacco, Firearms and explosives, the United States Marshals Service and so on.
