Law enforcement has a standard that they are required to maintain at all test no mater the circumstances. It is completely unconstitutional for law enforcement to violate the rights of anyone. The job of law enforcement is to enforce laws that are set by the constitution and the state they are employed with. Once law enforcement begins to violate the civil liberty of citizens, it creates a wedge between law enforcement and the communities they serve. In our society law enforcement is the pillar that enforces law and if they started operating on their own accord, and interpret law as they deem fit, it will destroy our democratic process. We are a country that believes in our constitutional liberties and there is nothing that makes it ethically
After reading all the material regarding Jeffery Bell, Darryl Forrest and Dustin Sillings all 3 whom were members of the Kansas City Police special unit known as (SCORE) Selective, Crime, Occurrence, Reduction Enforcement unit. I came up with several unethical behaviors throughout the course of the year from January 2010 to January 2011. One, all 3 officers violated the victims constitutional rights. Rights that were taken away were the freedom from unreasonable searches and seizures and not to have their property taken without due process under the law. (The Criminal Indictment: United States of America v. Jeffrey M. Bell, Darryl M. Forrest, and Dustin Sillings) Each officer took it upon themselves to steal various items including money from
Are police ever justified in committing illegal acts that violate others rights are they ever justified especially when there is no personal gain but for reasons that may seem to be about a higher purpose. This is the argument for noble cause corruption. This idea brings it to the end justifies the means thinking. If we start down this line where can it lead us? The idea that we can justify any action that would violate civil rights and other laws because we feel that our cause is noble and it is not being done for personal gain but the good of others can lead us into some dark places. The noble cause thinking is
The act violates citizens civil rights by violating the Fourth Amendment of the US Constitution. The Fourth Amendment states that government agents or law enforcement officers may only carry out searches and arrest after obtaining search or arrest warrants from the courts. The act also violates the Fifth Amendment of the US Constitution. The Fifth Amendment states that all US citizens have the right to “due process” of law, meaning that no one can be deprived of their life, liberty, or property without a fair trial.
There has been many situations in which police officers have abused their power. In these cases police officers have brutally beaten or killed innocent civilians. Everyone has heard about a story about how police officers have abused their power by utilising their personal beliefs rather than the reason their profession requires. Some officers cannot disunify their professional life from their personal life. Their identity is distinguished by their uniform. Any struggles in their exclusive life are seen as a threat to their dominance, jurisdiction, or power over the other person and the situation. It is either ethical or unethical. There is no accommodation for the victim to voice their opinion or position. Situations like these are known as Ferguson trails, Floyd Dent, Najee Rivera, and etc. These people have either lost their life or been physically abused. Police officers should wear body cameras because with body cameras it protects others, protects officers, and proves the reality of the actual situation.
Police are violating the 4th amendment which is protection from unreasonable searches and seizes. Police officers are stopping and frisking black and latino people just because of the color of their skin or what they are wearing. The police officers are harassing them and stopping them in public and leaving them with little to no explanation. Donnel Baird a community organizer in Brownsville, New York believes that real criminals are too advanced to be out in the public's eye and out for police officers to stop and search them to actually find something on them that could help them. When it comes to the topic of policing, most of us will readily agree that they are necessary to help keep peace in the community. Where this agreement usually
When thinking in The Police, as responsible for law and order, people often expect respect to the standards and protection. But, when law enforcement goes beyond the boundaries of civil rights and becomes abusive, the relationship between those involved just breaks out.
I understand police officers everywhere have their own lives on the line, every time they suit up to protect and enforce the law amongst the population. I do appreciate the risk they do to keep us safe from absolute chaos. However the authority these policemen have is mostly abused in one way or another, John Cassidy’s report in the NY Times article “ The Statistical Debate Behind The Stop-and-Frisk Verdict” provides statistical evidence that Black and Latino citizens are stopped a lot more frequently than White citizens. This is because racial profiling, this practice of racism should be ceased completely, especially with law enforcement. They are clearly directed towards minorities, which is a violation of the fourteenth amendment, which guarantees equal protection under the law.
Racial profiling violates civil rights by targeting people based on their race. As stated in an article written by Kurtis Lee, “he ordered his officers to stop drivers simply on the suspicion that they were in the country illegally, sometimes leading to the detention of Latinos who were citizens.” This is stating that Joe Arpaio a man that Donald Trump, the president of the United States Pardoned for openly disregarding a court order to stop racially profiling Latinos while he was sheriff. Joe Arpaio chose to continuously racially profile Latinos after being ordered to stop by the court. Which lead to the detention of Latinos who were citizens, the definition of civil rights is the rights of citizens to political and social freedom and equality. The equality of Latino citizens was clearly violated and disrespected because they were suspected to be in the United States illegally. When in fact, they were not. Also stated in the article “A year later the Justice Department sued Arpaio, alleging a pattern of illegal discrimination against
In my personal opinion, I think that the use of police discretion is very effective when enforcing laws. Sometimes when there is an emergency, it can look like a violation of some sort, but not until all the information is acquired by the officer is when he makes his decision based upon the facts in the situation. Police discretion is controversial, but the power granted to police officers makes the system and job more efficient. As long as police discretion is used adequately, it will be a proper form of enforcing the law.
without consequences. This practice is corrupt and police officers who act in these ways should be reprimanded and potentially fired for these actions. Some officers go beyond the law in ways they should be incarcerated as well. America’s governmental practice of excluding these police officers is only promoting these behaviors, and a stop should be put to them. By implementing stricter consequences, officers would be more conscious in their actions but now, it affects them as well.
Many racial profiled victims walk away with minor traffic tickets, too often are unlucky and their outcome is death. Some law enforcers seem to have the stereotypical idea that all african americans are ignorant and poor. In relations to that if seen differently then that will arouse suspcion to the law enforcer because it is so called unheard to see a blcak man with a nice car. Theres even an actual story where that has happened "On Oct 12, 1995, Johnny Grammage , a 31 yr old african american male was shot and killed after being pulled over while driving the jaguar of his cousins". That is just despicable an officer is only allowed to use a weapon if his life was in danger or if he had weapon but in this case neither was true. Racial profiling does not only affect race but it also affects religion. In most recent research " In South Dakota there is a widespread reports of racial profiling led to hearings before the state legislature, where indians testified about being stopped and searched not only based on race but religion" the constitution does foucs on that too whereas where we a free right to practice and not be judged. A suspect should not be searched or even stopped because of their race, religion, ethnicity, nationality, and orgin. They should be detained because of a logical and ethical reason if not then their only making them another victim of racial profiling. Bringing back up this term again
It is often said that no one is above the law not even the police, although it seems that they appear to be at times. The United States Constitution and the Bill of Rights protect the people from police brutality. “Police use of force is defined as the use of physical restraint by a police officer when dealing with a member of the public. Law enforcement officers are authorized to use the amount of force that is reasonable and necessary given the circumstances. Most officers are trained in the use of force and typically encounter numerous situations during their careers when the use of force is appropriate-for example, when making some arrests, restraining unruly combatants, or controlling a disruptive demonstration. Force may involve hitting: holding or restraining, pushing, choking threatening with a flashlight, baton, or chemical or pepper spray; restraining with a police dog, or threatening with a gun and some police use of force include handcuffing ”, according to Schmalleger, (2008).
The Criminal Justice System is just like every other agency or corporation ever. Police integrity and ethics are fundamental to effective policing and helps with building trust within communities. Sound conduct by police improves the community interactions, enhances communication, and promotes shared responsibility for addressing crime and disorder. (USDOJ, 2014) Restoring ethics starts from the beginning, and that is too look harder into the employees or officers that you are going to hire. The thing is that it is much harder than it sounds. People can change or lie on their interviews. So you will never be able to fully prevent every person who might break ethical codes from entering into law enforcement. What you need to do first is let all new officers be aware of what they are getting themselves into.
Police officers should not be able to break the law in order to arrest those who harm society. Laws are meant for everyone to follow therefore, no one is more or above anyone to the point where they are exempt from following them. For example citizens are not allowed to use their phones while driving, neither do police officers, they are humans as well and can also get distracted and create an accident.
Police officers take an oath to protect and serve the community. The community looks to police as a leader. I believe leaders set the standards, so police officers should be held to higher standards than the general public. Police officers are considered to be at the top of the organization chart. A wise saying states, “If the head (brain) is not working correctly the other parts of the body is lost.” The police are considered to be the head and the community is the other part. How could they enforce the laws that have been set by the government if they had no ethics and morals? There would be complete turmoil through the country.
