While there have been many breakthroughs, in today’s society, women are still struggling to get the treatment they deserve and the equality they want in the workplace. Over the years, many women have fought for their rights and we can see how much their effort has paid off with the rights we have now. Three Acts that have revolutionized women’s workplace rights are the Family and Medical Leave Act, the Equal Pay Act, and the Pregnancy Discrimination Act.

It is no secret that women still get paid less than men in job fields, 78 cents to the dollar to be exact. The wage gap certainly varies depending on what occupation you are looking at, but an obvious trend in the wages is that women earn less than men (Lyles). In an article by Latisha Lyles, she points out the gaps and offers a few examples that shed some light on them. One example she used was women in male-dominated fields such as science, engineering, technology, and mathematics. Lyles mentions the difficulties and discrimination women face in these fields that make achieving success a hard task to conquer. This Act states that employers cannot deny a woman employment because she is pregnant, as long as she can perform the major functions of her job. In an article by Beth Scott, she writes that the Pregnancy Discrimination Act covers all aspects of a worker’s employment: hiring, firing, promotions, pay, and other benefits. Scott also states that women who are being interviewed for a certain job are not obligated, under any circumstance, to make it known to their potential employer that they are, or are planning to become pregnant. Currently, the U.S. is the only modernized country not to offer paid leave to new mothers (Hall). The one legal protection offered by the U.S government is the Family and Medical Leave Act, or the FMLA. Since it became legislation in 1993, the FMLA has guaranteed a new mother job security for twelve weeks after her child is born. It does not, however, mandate pay. The FMLA also has other downsides. Women are only secured their twelve weeks of leave if they work a minimum of 1,250 hours a year and work for a company with fifty or more employees (Hall). This means that only two out of every five women qualify for protection (Hall). If a women does not qualify, it is left to her employer’s discretion to decide how long she will get to stay with her
The most well-known limit placed upon women in a work setting is the wage gap, or the difference between a man’s salary and a woman’s salary. Authors dive into the subject of the current wage gap because of its presence in modern society, and one author who does speak out about the topic is Caroline Fredrickson. Fredrickson, president of the American Constitution Society for Law and Policy, writes in her book Under the Bus: How Working Women Are Being Run Over about how the gap between a man and woman’s salaries does exist in today’s progressive society. To argue her case, Fredrickson reveals, “In the past decade, women have not made any progress at all, with the wage gap overall remaining stubbornly at 77 percent…” (44). This gap of seventy seven percent implies that the majority of women are paid only seventy seven percent of what a man is paid in any given position.
The United States of America was built on the unfair labor of others. The United States used slaves to produce an abundant amount of cotton in the South. Many mill owners started using children to work in the factories. Later on, many mill owners employed young, unmarried women to work in the textile mills, straightening cotton threads as the cotton entered the water-powered looms. The United States has been developed on wrongful labor of others by racism being the effect of slavery, lack of education being the effect of child labor, and unfair woman rights being the effect of the labor of Lowell females.
Lawyers Maria Lewis and DeMaris Trapp from the article “She works hard for less money” argues that women are paid less because of their gender and are paid less than their male counterparts. They both focused on the need for legal action to bring the wage gap to a close. Zsuza Daczo on the other hand fuses both Perry and Lewis and Trapp’s argument in his thesis “Wage inequality and the gender wage gap: are American women swimming upstream?”. He does acknowledge that there does seem to be discrimination against women, however, mentions society as the cause of the wage gap. The Constitution was set up to all the people to be a free people, and laws were set up to establish ground rules of respect and equality. When domestic violence occurs, the rights of the victim are violated and the protection that is needed is not acknowledged. The amount of impact Domestic Violence has in Society has become more and more recognized over time. Due to my employer being a government agency, I have dealt with the Family and Medical Leave Act (FMLA) on several occasions. According to Berman (2016), “These FMLA provisions apply to private employers with at least 40 employees and all government agencies (local, state, and federal), as well as elementary and secondary schools, regardless of the number of employees” (p. 306). Typically, our officers utilize this for the birth or adoption of a child, and sometimes for personal or family medical issues.
