On the evening of July 26th, 2013, 18-year old Sammy Yatim boarded a street car threatening passengers on board with a 4-inch knife. Constable James Forcillo and his partner first arrived at the scene trying to detain the suspect. The stand-off between Yatim and the officers did not last long. Within several minutes of trying to detain Yatim, Constable Forcillo shot three initial shot at Yatim fatally wounding him and another six shots. Eight of the nine bullets discharged at Yatim fatally wounded the teenager, however the three initial shots were enough to immobilize Yatim. Yatim refused and provoked the officer, in a non-violent act, to shoot him (Rogan, 2014). In a threatening manner, Forcillo warned Yatim that if he proceeded to move towards the exit of the street car he will regret the decision (Rogan, 2014). Yatim contemplated and took another step towards the exit; that is when Forcillo shot Yatim, fatally wounding the teenage boy. The actions that Forcillo took to prevent Yatim from exiting the street car was in an extreme case of police force. There was no signs were indicated that Yatim a threat to the public as he was seen behaving in an erratic and somewhat violent manner; Yatim displayed no intensions of harming the passengers. Crown prosecutor Milan Rupic represented The Crown in the trial against Forcillo (charged with second-degree murder) stated that witnesses in the case will testify that although being vulnerable to being harmed while fleeing the street car occupied by Yatim, he did not attack a single passenger while they fled (Hasham, 2015). However, upon analyzing the incident involving the force of police and mentally ill, have flaws in which is why the altercation resulted in the victim’s death. In the case of Forcillo discharging the nine shots at Yatim fatally killing him, it projected his thoughts a misjudgement. In belief and through misjudgement it may be Forcillo was unaware that Yatim was under the influence of drugs, therefore his belief was that Yatim was mentally insane. By training the police force to detect the usage of drugs within the person by body language instead of finding or smelling the evidence, it will eliminate the assumption that the suspect has the intentions of their actions. Policies issuing on the topic of mental health during criminal acts are not an unlikely occurrence. Nevertheless, careful considerations should be made towards cases involving intoxication or high levels of drugs. In cases that the individual is aggressive or unresponsive to demands of the correcting officers, violent actions to detain the individual must be limited to not harm or have the individual harm themselves at any cost. Officer Derick Wiley was first to arrive on the scene, around 7pm; when he ordered Lyndo out of his the truck, Lyndo Jones tyred voluntarily removing himself from his truck, When the officer shot Mr. Jones in the lower abdomen. After the first shot was fired and injured Lyndo Jones took off running attempting to protect himself when more police (backup) arrived to the location.
Sammy Yatim was an 18 years old boy who got on a streetcar late during the night of July 26, 2013. Mark Rogan from Toronto Life describes what happened that night; four girls boarded and sat at the back of the car near Yatim. He proceeded to unzip his pants and expose himself, and a switchblade to the girls, causing them to scream. This caused a panic in all the other passengers, and they began to exit the streetcar despite Yatim’s demands to remain where they were. Once exiting the streetcar many people began to call 911, and the police arrived on scene shortly after, this is when the conflicting issue began. When Constable James Forcillo arrived Yatim was near the front exit of the streetcar, he immediately drew his weapon and shouted for Yatim to “Drop the knife”, resulting in Yatim insulting Forcillo. Once Forcillo realized that Yatim would now calm down, he asked for his partner to call for an officer who had a Taser, since not all police officers in Toronto are allowed to carry them. This is the first issue in this case. If Forcillo had a Taser the situation could have resulted in a better ending. When Yatim disobeyed orders by stepping towards the exit of the streetcar, Forcillo shot his gun 3 times causing Yatim to fall to the ground. At this point other police officers entered the streetcar and Forcillo shot 6 more times. Many people tried to stand up for the transgressions that were being made against the Japanese Americans. Most of the Japanese-Americans that were interned were too fearful to stand up to the government, but there were some courageous people who "stepped up to the plate". These people went to court to protest the relocation order. Their argument was that it wasn't constitutional, but in the end, nothing was done in favor of these cases. Some of those people who stood up were Fred T. Korematsu, Mitsuye Endo, Minoru Yasui, and Gordon K. Hirabayashi (Hay 19-20). The recommendation that would have most greatly affected the interaction between police and Yatim would be found on page 90, #34. This recommends that police offices should be trained to recognize and deal with situations regarding people with mental health issues ages 16 and up. I believe that this could have helped the situation end in a non-violent manner. If this recommendation had been in place, the police would have most likely been able to calm Yatim, and with him, the situation. Being able to recognize when one is not mentally sound can enable you to work with their mind frame, find out why they are acting how they are, and then, hopefully, calm them down. By calming Yatim down, Yatim would have been more likely to put away his knife.
Kym’s case is unique in that she is currently still in rehab however she is participating in family therapy. According to Klostermann & O’Farrell (2013) the use of partner and family involved treatment for substance abuse presents unique and ethical consideration. Those factors to be considered is using marital or family intervention with individual who abuse substances. Although Kym indicated she was currently clean, she reported using drugs on and off for number of years. In addition the definition of family must be establish, determination of progress and the risk and benefit for each family member (Klostermann & O’Farrell, 2013). More research is also needed in reference to citizens experiencing mental health and substance abuse issues. It appears that more force might be considered necessary when dealing with citizens who are under the influence of drugs and alcohol. The fact is that some people who are under the influence of drugs are harmless and tend to put up little resistance. Individuals with mental health concerns also vary in terms of resistance ; thus, it is very difficult to conduct research in reference to this population. Perhaps it is the perception of police officers that might be correlated to use of force pertaining to dealing with these types of individuals. From Adolf Hitler to BTK, wrong doings have happened throughout the world, and they continuously happen. Robbery, murder, mass shootings, and violent assaults are some crimes that criminals commit. When these wrong doings are committed psychologists ask a series of questions involving the criminal’s childhood, drug and alcohol abuse, as well as their empathy for others ("Dangerous Minds: The Mental Illnesses of Infamous Criminals”). Through these questions, psychologists and social workers can determine if the criminals have any mental illnesses. Throughout criminal history, mental illnesses have been found in killers but not all. It is important to discover these illnesses and problems in individuals before they become violent criminals through correct treatment of counseling and support. That is the reason I am going into the field of psychology; to have a stable life, to help others who need the help and support, and to be able to love my job.
Police officers are clearly interacting extensive range of situations and dealing with a range of different and difficult types of citizens, including people with mental illnesses whether they are witnesses of crime, perpetrators, or victims. In the difficult situations police face with complex conditions that involve to having violent, and sometimes deadly interactions with people who has a mental illness. Criminal justice professionals face several challenges when it comes to dealing with offenders with mental illness. Some of the problems encountered by criminal justice professionals are; maintaining personal safety for both offender and law enforcement, training, funding for programs for mentally ill offenders, and having a plan for continued care for both during their time in the criminal justice system as well as when they get released, thus; hoping to reduce recidivism (Blough, 2009). Mental Illness has been prevalent all throughout our history from Isaac Newton to Abraham Lincoln to Sylvia Plath and so on. These illnesses can be as minor as a slight bipolar disorder or as severe as schizophrenia. In recent years, mental illnesses are becoming more prevalent in our criminal justice systems than anywhere else. Mental illness is becoming an association with crime and based on the information that has been found, this paper will attempt to further define the problem of mental illness within our criminal justice system and offer alternatives or insights as to how to possibly help with this problem.
The Force of use should be the last resort within the agency. The agency needs to be trained more in depth situations in controlling the sign of these behaviors containing mental health illness with in. They can learn techniques in controlling the matter they use by offering them classes and hands on training to become aware of what they can look or feel like on the inside. The minorities with mental illness can become harmful and cannot control the situation which, is why the juveniles receive force of use against them. The knowledge of learning these signs of behavior within the agency as a whole will help them as an individual controlling any incident they have.
