The plaintiff (Southern Prestige Industries, Inc.) initiated an action against the defendant (Independence Plating Corp.) in a North Carolina state court for a breach of contract. The plaintiff alleged that defects in the defendant’s anodizing process caused the plaintiff’s machine parts to be rejected by Kidde Aerospace. The defendant being a New Jersey corporation and having its only office and all of its personnel situated in the state filed a motion to dismiss citing lack of personal jurisdiction. The trial court denied the motion and the defendant appealed arguing that there were insufficient contacts to satisfy the due process of law requirements
In 1816, the 2nd National Bank of the United States was chartered by Congress, establishing a branch in Maryland. In trying to protect local business and claiming the unconstitutional chartering of the National Bank, (?????as a direct response????), the state of Maryland passed legislation to impose a tax on all banks not chartered within the state (the Bank of the United States was the only bank that qualified). However, McCulloch, the cashier of BUS’ Baltimore branch, refused to pay this tax and was sued by the state. McCulloch lost in county court and the decision was reaffirmed by the appellate court.
Preblich, on December 13, 1984, the plaintiff was driving through an alley behind his residence when he noticed that the lights of the defendants’ car were on. Through the back door of the house, he informed the defendant, and a friend of the defendant who had borrowed the car, that the lights were on. As the defendant’s friend opened the door of the home to go turn off the lights, the defendants two year old, thirty pound spaniel ran out the door and down the footpath towards the alleyway. Unbeknownst to the plaintiff, as the plaintiff walked down the footpath towards his car, the spaniel ran behind him, bumping into the back of the plaintiff's legs, causing him to lose his balance and fall. As a result of the fall, the plaintiff broke his wrist, and allegedly sustained back injuries. Boitz v. Preblich, 405 N.W.2d 907, 909 (Minn. Ct. App. 1987). In this case, the court held that injuries inflicted by a dog outside the scope of a vicious attack are not, as a matter of law, excluded from coverage under the Minnesota dog owner's liability statute. The court reasoned that the statute does not indicate a limitation to vicious attacks, as the phrase "or injures" fully encompasses injuries other than those sustained by an attack. Id. at 910. The court also held that since the phrase “or injures” comprises injuries other than those from an attack, a dog owner may also be held liable under the Minnesota statute for injuries caused by the dog’s accidental or innocent

On 05/29/16 at 8:00pm, I was dispatched to 2142 Balford Square East on injury-possible dangers or vicious dog and owner surrender. I arrived at the house and spoke to dog owner Delane Murrell Jr. Mr. Murrell stated that his son was standing in the kitchen when their dog came in the house from the back yard and attacked his son. Mr. Murrell wrote out a statement of facts in regards to the incident. Mr. Murrell also stated that he wanted to surrender the dog. I took pictures of the injuries to Qimari Brown. Qimari has puncture wounds to his right thigh and to the right side of back. Mr. Murrell was unable to show proof of dog license. Mr. Murrell was issued violations for failure to license and failure to control a dangerous dog. Mr.
