Annotated Bibliography Of Mass Incarceration Of African Americans

This paper discusses three critical issues in the criminal justice system. It touches on the general issues of punishment philosophies, sentence decision making, and prison overcrowding and focused more specifically on the negative effects of each. Highlighted in this informational paper is the interrelated nature of the issues; each issue affects and is affected by the others. For generations in the United Stated, ethnic minorities have been discriminated against and denied fair opportunity and equal rights. In the beginning there was slavery, and thereafter came an era of racism which directly impacted millions of minorities lives. This period called Jim Crow was the name of the racial caste system up in till mid 1960s. Jim Crow was more than just a series of severe anti-Black laws, it became a way of life. Under Jim Crow, African Americans were positioned to the status of second class citizens. What Jim Crow

African Americans now constitute nearly 1 million of the total 2.3 million incarcerated; that is 60% of 30% of the African American population. African Americas are incarcerated at nearly six times the rate of whites. “Between 6.6% and 7.5% of all black males ages 25 to 39 were imprisoned in 2011, which were the highest imprisonment rates among the measured sex, race, Hispanic origin, and age groups." (Carson, E. Ann, and Sabol, William J. 2011.) Stated on Americanprogram.org “ The Sentencing Project reports that African Americans are 21 percent more likely to receive mandatory-minimum sentences than white defendants and are 20 percent more likely to be sentenced to prison.” Hispanics and African Americans make up 58% of all prisoners in 2008, even though African Americans and Hispanics make up approximately one quarter of the US population. (Henderson 2000). Slightly 15% of the inmate population is made up of 283,000 Hispanic prisoners.

The purpose of this study is to expose the process of mass incarceration of poor black males, and females increasingly, within the context of a fabricated war on drugs which really is serving to keep the prison population booming by exploiting traditionally disadvantaged minorities in society. Alexander rightfully calls this a ?redesign? of the old racial caste system in America which was supposed to have been destroyed by the civil rights movement. The war on drugs in the 80s merely became the newest vehicle by which to exploit the black community in this country. The War on Drugs is really the rationale for racial control, which targets black men and women and relegates millions of citizens to what Alexander calls a ?second class status (Alexander, 2012).?

Many Americans falsely believe the criminal justice processes are too relaxed. This is illustrated through the conduction of a Gallup poll in which Americans were asked if the United States’ criminal justice system is currently "too tough, not tough enough, or about right" in handling crime. Many jail cells and prisons hold more African Americans than colleges and universities. This is a major problem for younger men and women that have to witness this because if this is all they are exposed to then this will be all they know. It does not only affect younger children or teenagers but close family members, wives, and parents. The mass incarceration of African Americans is becoming the norm for our men and women because the ¨white man¨ or the government is subliminally fighting to oppress African Americans and hold them back from any chance of prosperity that they have.

America has the highest prevalence of jailing its citizens. Nearly 2.3 million Americans are behind bars or nearly one percent of the adult population at any given time (Campbell, Vogel, & Williams, 2015). As of 2014, African Americans make up 34% of the incarcerated population. As a result, a disproportionate amount of African American youth will experience a parent’s incarceration. Research has shown that children of incarcerated parents experience emotional problems, socioeconomic problems, and cognitive disturbances (Miller, 2007). In this paper, I will discuss the impact of mass incarceration in the African American community and its effect on African American children.

Racism effects the the high incarceration rates according to Michelle Alexander, the author of “The New Jim Crow: Mass Incarceration in the Age of Colorblindness. This scholar writes about how the civil rights movement has been taken back by the mass incarceration of black Americans in the war on drugs. Alexander also explains how the severe consequences that these black men carry on after being incarcerated, for example not being able to get school grants or housing. The author continues to argues that all it takes is a major social movement to end americas new caste system and that it is inhumane to treat any race less then the other. Agreeing with Alexander, I believe that every race deserves equal opportunity and that high mass incarceration rates are the way they are because of racism by the criminal justice system.

Recent sociological studies have focused on pressing social issues such as urban crime and mass incarceration, and examining the invisible link between urban crime, poverty and race. Research indicates that mass incarceration has always worked to the detriment of African Americans, especially the low-income earners (Western, 2006). The aftermath of this trend is that the employment prospects of former felons are significantly diminished (Pager, 2007). Felon disfranchisement in turn distorts the local and national politics of the county (Uggen, 2006). This paper focuses on addressing the contemporary trends and ramifications of mass incarceration of African Americans, and elucidating on the criminal justice policy and the factors contributing to the intangible but real racial divide.

In today’s society, discrimination continues to affect millions of minorities from inappropriate name calling to being shot by a law enforcement officer because you were perceived to be dangerous. The underlying effects of racial discrimination are seen in all aspects of our society, especially in our social institutions. These social institutions range from the educational system to our government, yet racial discrimination is more evident in the criminal justice system. When analyzing how the criminal justice system discriminates against minorities we are able to do so through the visible disparities within the system. Unfortunately, these disparities display African Americans having the highest population rates in the criminal justice system, therefore, we can immediately conclude this disparity in population is due to the injustices conducted by the system. Thus, there is a need for urgent change not just within the criminal justice system but within all social institutions beginning with our government. This change should create greater opportunities for minorities to enter the political field in our government as well as promoting higher participating in voting. Yet, the criminal justice system within all its aspects practices discrimination due to its deeply interwoven prejudice, institutional racism, and socioeconomic status.

African Americans are targeted by law enforcement more often than any other race (Toth, Crews & Burton, 2008). Because of this the term racial profiling was created to explain the process of targeting people for criminal activity because of race not evidence (Toth et al, 2008). African Americans are over represented in the criminal justice system based on their population amount compared to whites (Toth et al, 2008). African American males are incarcerated at a rate 9 times that of white males in most states, in others that number may be as high as 12 to 26 times more (Toth et al, 2008). Nationwide statistics show in most states 1 in 20 over the age of 18 are in prison, while 5 other states report 1 in 13 or 14 compared to the 1 in 180

The United States has the highest number of prisoners compared to any country in the world according to Denis J.Madden published in the America Magazine. Imprisoning hundreds of thousands African Americans has been significantly effective in society for several years. The criminal justice system enforces the law strictly in the African American society with brutal prosecution. In Washington, D.C., our nation’s capitol, it is estimated that three out of four young black men (and nearly all those in the poorest neighborhoods) can expect to serve time in prison” (Alexander, 2012). The numbers tell the story better than words can: black people are more likely to go to prison than any other race in the United States, shown by the fact that more than 60% of the prison population is composed of people of color (The Sentencing Project, 2016). These statistics can be traced back to several different cause, including the Era of Jim Crow and the War on Drugs, both of which led to higher policing in minority areas.
