Disproportionate minority confinement (DMC) of youth: An analysis of state and federal efforts to address the issue is a journal that discusses the effects of the deinstitutionalization of young offenders that are from an incarceration institutions that are for adults. It also examines the amount of money that is used to fund these institutions. In reading the journal, it gives the reader a different view toward methods that are used by the states and the outcomes that happen as a result. The programs that are used are generally African American and Hispanic decent. In the programs the application of the disproportionate minority confinement is to identification and assessment of the states involved. The program that determines whether DMC exists in secure facilities, it also identifies the causes and development of corrective strategies.
The examination of compliance with the identification and assessment stages is the objective of the research in DMC. The program focuses on the overrepresentation of minorities in the juvenile justice system of each state. There is a conclusion of practical as well as ethical limitations that affect the implementation of the DMC requirements. In use of the DMC, the states are measured against each other. The programs are used for minorities and each state is analyzed to determine the identity of the different racial groups in each state for the programs.
After reading the journal, it is determined about the interpretations of minorities
The criminal justice system is a set of organizations and procedures set up by governments to control wrongdoing and force punishments on the individuals who disregard the laws. The main frameworks are state and federal. The state criminal justice systems handle wrongdoings perpetrated inside their state limits and government, the federal criminal system handles violations carried out on federal property or in more than one state. This system is supposed to be equal yet the nature of offenses, differential policing policies and practices, sentencing laws and biases are possible contributors to disparities in the system. The severity of the offense, prior record, age and education level are also taking into account when a decision is being made. Our prison system today varies immensely with ascending numbers of minority groups jailed within the system. Racial and ethnic imbalances continue in the United States and no disparity is more evident than that found in the criminal justice system. Disparity usually refers to a difference that is unfair, disparity in the criminal justice system stems from racial disparity which concludes that the proportion of a racial ethnic group within the control of the system is greater than the population of that group outside that control.
The data for this project was collected by administering an anonymous survey to incarcerated juveniles at (name of facility), the (name) receiving center and at the NAACP office in Sacramento, California. The survey asked for gender and parental status (incarcerated versus not incarcerated). Participants were given a paper survey and a pencil to complete the survey. See Appendix for a copy of the survey.
In today’s society, discrimination is an issue that is considered to be a thing of the past. In a country with such diversity it is hard to believe that people living in the “land of the free” face issues of racism. This paper will focus specifically on the social problem of mass incarceration of minority groups and how the criminal justice system targets these groups. Although this social problem can be linked to specifically African Americans, the impacts of mass incarceration can be felt by almost everyone. I have chosen three articles that focus on how the criminal justice system is masking mass imprisonment a major problem in minority communities.
Evidence-based studies imply that youth of color are being placed in detention at a higher rate all throughout juvenile justice system not only in Kentucky but, nationwide. Disproportionate minority contact (DMC) in juvenile justice alludes to youth of color being place into the system at a greater rate than their Caucasian counterparts. All races break the law at about the same rate; however, youth of color are arrested, charged and institutionalized at a higher percentage than Caucasians for similar offenses. African-Americans made up 16 percent of all youth in the United States, but constituted 28 percent of youth arrests, 30 percent of referrals to juvenile court, 37 percent of detained youth, 34 percent of youth formally processed by juvenile court, 30 percent of youth adjudicated delinquent, 35 percent of youth judicially waived to criminal court, 38 percent of youth in residential placement, and 58 percent of youth sent to state adult prisons. (Grieshop et al 2009)
Although we would like to believe the world is not as racially charged in 2013 as it was in the 1960s, a look in our penal system would show that minorities are still arrested and incarcerated at a higher rate than whites. The United States has experienced a rise in its prison population over the last 40 years and our incarceration rate is nearly 5 times higher than any other country. Even though 13% of the US population are African American males, they make up 38% of the prison population. Contributing factors to these numbers are mandatory minimum sentences, high crime and poverty areas, and lack of rehabilitative resources within our system (p.77-78).

The trend of African American males between the ages of 25 and 29 has seen a dramatic increase of incarceration. Attention has been focusing on areas of housing, education, and healthcare but the most prominent problem for African American males is the increase in the incarceration rate. African American males between the ages of 25 and 29 incarceration rate has been thought, by many, to be caused by economic factors such as under employment or unemployment, poor housing, lack of education, and lack of healthcare. Yet, others believe it is due to the imbalance of minorities within the criminal justice system, such as judges, lawyers, and lawmakers.
Mass Incarceration in the United States has been a large topic of choice because rapid growth in the prison and jail populations, the long sentences the inmates face, and the inability for some inmates to incorporate themselves back into society. Since the 1970’s the U.S. prison population quadrupled from 158 to 635 people per 100,000, causing the U.S. to gain the title of country with the highest incarceration rate. (Massoglia, Firebaugh, & Warner, 2013, p. 142; Muller, 2012) As the growth of the U.S prison and jail population rapidly increased, so did the growth of the three major contributors to that population – African Americans, Hispanics, and whites – with African American and
Congress would also like to strengthen the Disproportionate Minority Contact (DMC) core protection by requiring States to take concrete steps to reduce racial and ethnic disparities in the juvenile justice system and provide safe and humane conditions of confinement for youth in State or local custody by prohibiting use of JJDPA funds for dangerous practices and encouraging States to adopt best practices and standards to eliminate dangerous practices and unnecessary isolation. Not to mention, provide a research‐based continuum of mental health and substance abuse services to meet unmet needs of court‐involved youth and their families, including diversion and re‐entry services and assist States in compliance with the JJDPA by establishing incentive grants to encourage States to adopt evidence‐based and/or promising practices that improve outcomes for youth and their communities. For States that are deemed to be out of compliance with any of the core protections, Congress should require any JJDPA funds withheld for non‐compliance to be set aside and made available to those States as improvement grants to help them with those particular protections.
Racial disparity in the correctional population refers to the difference in the number of minorities versus whites represented inside institutions. “The American Correctional Association acknowledges that racial disparity exists within adult and juvenile detention and correctional systems. In the prison system today, there has been an explosion of minorities being incarcerated for offenses that may not have gotten jail time if they had not been of a certain race. One major problem of prison overcrowding is the effect it has on prison organizational stability. The more prisoners and people put in jail have made it harder for prison guards and staff to monitor and control them. The entire prison system must make enormous changes in order to accommodate for the number of inmates versus the number of prison guards (O’Leary). This often results in a misclassification of offenders. Many who come through the system are classified based on the amount of space available instead of on the security level and programs that would be most suitable for them (Howard). “It is not uncommon to find inmates, classified as medium security, incarcerated in maximum security institutions, while other inmates are in medium security who were previously considered candidates for maximum security” (Howard). Misclassifying offenders often leads to “slow progress through the corrections system as well as a slow exit” (Howard). This in turn only prolongs and increases the overcrowding problem (Howard). The corrections programs should be reformed to meet the needs of the inmates rather than the inmates having to adjust to meet the requirements of the system. Offenders need to be on specific rehabilitation programs that are customized to fit their needs, such as alcohol and drug abuse programs and so forth.
Minority youth are disproportionately represented throughout juvenile justice systems in nearly every state in the nation. Disproportionate minority contact (DMC) in juvenile justice occurs when minority youth come into contact with the system at a higher rate than their white counterparts. African-Americans, Hispanics, Asians, Pacific Islanders and Native Americans comprise a combined one-third of the nation's youth population. Yet they account for over two-thirds of the youth in secure juvenile facilities (Armour & Hammond, 2009).
The Mass Incarceration in the United States is a major topic of discussion in our society and has raised many questions about our criminal justice system. There are few topics disputed as much in criminal justice as the relationship between race, ethnicity, and criminal outcomes. Specifically, the large disparities that minorities face regarding incarceration in our country. Minorities such as Hispanics and African Americans are sentenced at far higher rates than their white counterparts. There are multiple factors that influence this such as the judicial system, racial profiling by law enforcement, and historical biases (Kamula, Clark-Coulson, Kamula, 2010). Additionally, the defendants race was found to be highly associated with either a jail or prison sentence; with the “odds increasing 29 percent for black defendants, and 44 percent for Hispanic defendants” (King, Johnson, McGeever, 2010).
It may seem that incarceration rates are high for minorities at the federal level, but the rates are even higher at the state levels. African Americans are 5.6 times, and Hispanics are 1.8 times more likely to be incarcerated than whites. Young African American and Hispanic males are leading incarceration rates for robbery, drug offenses, followed by murder and nonnegligent manslaughter. Whites show a significant lower number than of the Hispanics and blacks for the violent crimes, but lead incarceration rates for rape and sexual abuse. Whites also exceeded minorities in property crime (108,560), compared to blacks (78,197) and Hispanics (38,264) (E. Ann Carson and Daniela Golinelli, 2013).
