On Thursday, July 14, 2016, at approximately 0847 hours, Patrolman David Stamets had a vehicle stopped on the 100 block of East Oak Street. Immediately after Stamets stopped the vehicle Your Affiant positioned his vehicle on the 100 block of South White Street near the Oak Street intersection facing southbound. When exiting my vehicle your Affiant observed a gold Pontiac sedan accelerating northbound on South White Street at an unsafe speed towards Stamets and your Affiant's location.

On 05/30/2015, at approximately 1816 hours, your affiant observed a silver Chevrolet Classic occupied by two males. The vehicle circled the block in a counterclockwise manner, repeating a portion of their route. During this time I located the owner of the vehicle utilizing a search through the Pennsylvania Department of Transportation. The registration indicated the plate belonged to another vehicle and registered to Brittney Fisher, who was not an occupant in the vehicle. I activated my emergency lights initiating a vehicle stop in the 100 block of West Washington Street and while stopping the vehicle I observed the passenger making furtive movements towards the center console.

On Sunday, 04/29/2018, at approximately 1024 hours, I was in full police uniform, driving a marked Daly City Police patrol vehicle. I was driving south on Sullivan Avenue, north of the interstate 280 south on ramp. At that time my attention was drawn to a gray, 2015, Volkswagen, Passat bearing California license #5TUF434. I saw the vehicle was occupied by a male driver and female passenger. I conducted a records check on the computer in my patrol vehicle and it revealed it was a stolen vehicle out of Oakland.

I made contact with the driver (Stanciel, Conswella N. DOB 06/19/86), who related that she did not possess a driver's license. Conswella was checked through LEADS via dispatch, which revealed a no valid driver's license and she was clear with no wants or warrants. She was unable to provide insurance for the vehicle. There was a passenger in the vehicle, who was identified as (Edwards, Shekida D. DOB 07/24/86), she was checked through LEADS, which revealed that she was valid with no wants or warrants. The vehicle was released to Shekida.

On 07/15/2015, at approximately 2305 hours, your Affiant was on routine patrol on Main Street (SR924) when I observed a silver Chrysler sedan parked in the One Hundred Block of South Main Street (westside of the street) near the intersection of Oak Street. The vehicle displayed a Pennsylvania registration of JRJ-5342. The registration was checked utilizing the Pennsylvania Department of Transportation vehicle record abstract which revealed that the license plate was assigned by the department to KYLE ROBERT & SARAH LYNN FOGARTY for a 1998 Chevrolet. I then verified the status of KYLE and SARAH FOGARTY'S driving licenses both of which were suspended by the Department of Transportation.

I approached the vehicle and made contacted with the driver, Jason Sweeney. I asked Jason if he was aware of why I stopped him, Jason stated yes it was because I was speeding. I advised Jason that it was because he cross over the center line, Jason stated “oh”. I asked Jason if he had Identification and proof of insurance. SUMMARY OF THE FACTS: An officer from the Vista Lago Police Department pulled over a pickup truck belonging to Mrs. Atwater. The reason for the stop was because the officer witnessed Mrs. Atwater to be conducting her vehicle without her seatbelt on. During the stop, the officer also discovered that not only was she not wearing her seatbelt, but her two children were also not restrained with a seatbelt which is required by the State of Texas. The officer also discovered that Mrs. Atwater was not driving with a valid driver’s license, and failed to produce any type of valid insurance.

On August 27, 2015 at approximately 2154 hrs, I observed a gray 2005 Acura TL bearing NJ Reg# J61FHA was driving 69 mph on 55 mph zone on Route 1 north, made a passing on the right lane and change lane again to the middle lane. When the traffic light turned red on intersection between North Oaks Blvd and Route 1 north, I pull my patrol vehicle 558 next to the vehicle as a the vehicle was slowing for the traffic light and I observed interior light on with a driver who had his hand upon his ear and moving his mouth which made me believed that the driver was talking on his cell phone while driving. I relocated, with other officers, to Georgia I-20 (east) and made contact with the vehicle in question. The vehicle was a gold Toyota Camry, Georgia Tag number PZC 8572. On 02/11/2016 at 1436 hours, I was dispatched to Wawa (1060 Delsea Drive) for a report of an intoxicated male fumbling to unlock his blue Ford F-150 that was parked in the parking lot. In summary, on 03/29/16 at 1855 hours I was patrolling the area of 1200 S 54th Ave., at which time I observed a vehicle (red 07' Lexus IL Z161188) traveling northbound in the wrong lane to pass a vehicle at a high rate of speed. Yesterday 12/19/2015 around 11:25AM Amazon associate Aris Mordan came to S/O Frank Grieco on her lunch break to report one of her headlight from the back of her White Cadillac came out in B Lot. S/O Frank Grieco went outside with Ms. Mordan to take pictures and more information on how this could have happened. The assumption by Ms. Mordan was that someone must have hit her car or had been messing with it to take it out purposely. S/O Grieco then came to the control desk to notify S/S Brendaly Sepulveda about this incident that occurred. S/S Sepulveda then began to investigate and discovered from the wind being so strong it blew the headlights right off the vehicle. ON 09-03-2016 at 0930 hours, I was notified by Sgt Kelley of an aggravated battery which occurred at 2111 Roanoke Springs Drive. It is human nature to make mistakes; however, mistakes that cause harm to someone else could be considered negligence. In the case with Mr. Benson in the Neighborhood Newspaper article, a mistake was made that was irreversible. He went into the hospital to have his leg amputated, and the doctor amputated the wrong leg. The question is was the doctor negligent in his practice? Is the amputation of the wrong leg considered to be malpractice on the doctor’s part? This paper will differentiate between negligence, gross negligence, and malpractice. After differentiating between these terms, it will be determined if the doctor operating on Mr. Benson was considered to be negligent, gross negligent or was this mistake malpractice.
