Approximately everything that is the Bill of Rights must have some limitations to some extent, but some might be unqualified. The first amendment say freedom of speech we have seen that some states have limited from that. For example, in the school they have uniforms now back then the students could wear anything logo they wanted. The second amendment is in favor of carrying guns and in Texas students can take guns to the university. The third amendment no housing military is unqualified because we haven’t had a war in so long that has taken place here in the United States. This amendment is just way off because it was made a long time ago it does not apply to this generation. The fourth amendment search and seizure has been broken so many
The bill of rights is a popular document that was not originally in the US constitution, but anti federalists wanted a bill of rights really bad because supposedly they were afraid of a strong central government. They did not want another king so some states refused the constitution until there was a bill of rights. Along with being afraid of a central government they wanted a limited government so that government could not control them. The anti federalists also thought the government would not protect their individual rights enough so they wanted a bill of rights.
America is built on the foundation of society being run and well-flowing around the three values the Republic of the United States hold most dear to: equality, freedom, and justice. The rights of the accused is an important factor in maximizing justice. Amendments 4-8 in the Bill of Rights specifically detail how criminal law should be dealt with, and how justice can be ensured every step of the way. The Fifth and Sixth Amendments contain two systems that go hand in hand with one another, a due process and a trial by jury for all citizens. Amendments 4-8, a Due Process, and a Trial by Jury are essential for establishing the rights of the accused and their absence would be detrimental to the effectiveness of the American criminal justice system.
Through the years America has been built on freedom. Freedom to choose, freedom of religion, freedom to speak, and freedom for just about any person to complete anything they wish within that of the law. These laws have already been place in spot to keep and protect our freedom.
Created September 25,1978 and ratified December 15, 179, the Bill of Rights was imputed into society as a tool to establish law, order, and morality. James Madison, a political theorist, was known as the father of the Bill of Rights. One of the most important amendments in the Bill of Rights is the right to freedom of speech, expression and media. In the Bill of Rights, the First Amendment states, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.” The First Amendment guarantees the citizens of America that they have the right to freely express themselves about anything, including political arguments and views. This amendment also guarantees the press/media the right to overtly publish their ideas on any topic in the newspaper. The purpose of this amendment is to assure America’s people that they shouldn’t worry about being censored or punished for the expression of their feelings because they are human just as everyone else.
The Constitution of the United States was made through compromises that not everyone agreed on but they came to an agreement on what they thought it should be. Before all of the fifty states were founded there was not a Bill of Rights, it was not until the new government was up and running before the Bill of Rights was added. The reason for this was that the framers of the constitution did not realize that the Bill of Rights was necessary to have at the time. A certainly important choice that was made was how our government was to be
The Bill of Rights became a very important document in the United States Constitution in order to ensure United States citizens equal protection of their rights and liberties. The main objective of the Bill of rights was to place limits on the national government creating an understanding and dividing the powers between the states and the national government. Not all the powers were granted to the national government however not all the powers were prohibited to the states. As stated by Ginsberg, Lowi, Weir & Tolbert (2015) the bill of rights consists of 10 amendments incorporated in the U.S constitution. It is important to note that each amendment contains a legal court case in which the supreme court as well as the government have ruled and have ignored or have protected the rights of the individuals involved.
The United States Constitution was recognized to Americans as a vague statement in clarifying the privileges and the rights of individuals and centralizing the power within the government itself. With the passing of the Bill of Rights and the first ten amendments, it grants the people to what is said to be their “natural rights” following additional rights that have significantly changed our society.
The Bill of Rights contains 10 amendments that were designed to protect the people and prevent an over powerful government. There are 3 amendments that are absolutely needed in order for the government to protect the people. That being said the 3 amendments that the people absolutely need are the 1st, 10th, and 2nd amendments. We need the 1st amendment because without freedom of speech, press, assembly, religion, and petition, there is no personal liberty, and without it, we wouldn’t be allowed to disagree with the government. The 10th amendment prohibits the government from becoming too large and taking over the states, and that’s important because without that, the government could easily take over the United States, and not be punished.
If I were a Supreme Court Justice during the 1800's, I would interpret that Congress intended to incorporate the Bill of Rights into privileges of national citizenship. The Bill of Rights gave citizens their civil rights and helped restrict the control of the federal government. It did not apply to states at first, but most of the State constitutions included parts of the Bill of Right and were not required to. The bill outlines multiple rights such as right to freedom of speech, religion practice along with many other issues addressed. The Bill of Rights became some of the initial documents that pronounced distinct things the Government cannot control regarding the rights of citizens. Majority of government documents leading up to the Bill
When controversy changes a nation. In today's society we pay little attention on how the past affected the creation of the Bill of Rights. The Bill of Rights was a gift from the antifederalist, they feared the centralization of power in the national government. Throughout their propaganda campaigns the anti federalist pointed out that their was no guaranties of the people's rights in the body of the constitution. In fearful defeat the federalist made sure the bill of rights were added to the constitution. If it wasn't for the antifederalist the bill of rights would have never existed. Many of the amendments have been violated throughout historical event. The fifth and the sixth amendment were violated during the salem witch trials in salem
The Bill of Rights is the accumulation of the first ten amendments made to the United States Constitution. Before ratifying the Constitution, some states required that a Bill of Rights be instituted. James Madison, the primary author of these amendments and later America’s fourth President, drafted twelve revisions. Congress passed ten of the proposed amendments, creating the Bill of Rights. While these revisions did create new guidelines for the Constitution, they did not change the original intentions of the framers.
An important provision of the Bill of Rights is the protection of freedom to publish, as provided by the First Amendment. This protection applies to all kinds of publications, even those that print unpopular opinions. In most censorship cases, every attempt is made to suppress the written word after publication, not before. Minnesota passed a law in 1925 that sought to prevent newspapers, magazines, and other publications from printing obscene, malicious, scandalous and defamatory material. This law was called the Minnesota Gag Law . This law allowed private citizens and/or public prosecutors to request a court injunction to shut down any publication that was known as a public nuisance. Publishers of newspapers had to show that they had good motives for anything they were going to print before they printed it.
“I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin, but by the content of their character.” -Dr. Martin Luther King Jr. Equality is possible by the Constitution in the following way: Bill of Rights, All 27 Amendments, and the Constitution. Also using events that were caused to have equality, ex: Civil War, Civil Rights Movement, Revolutionary War. Finally many readings that were based on the Constitution are, the Gettysburg Address, I Have A Dream, and What to a Slave is the Fourth of July. The two perspectives of the argument is,it is achievable to make society have equality based on the Constitution, or it is not achievable to make society equal based on the
On top of that, The Bill Of Rights of the United States of America (1791) written by James Madison, itself denotes that, “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized”(Madison, 1958). The Bill of Rights now unquestionably has helped in ensuring the fundamental liberties of people are taken care of for example the freedom of speech and press, non-violent rally, and a few significant indemnities to protect accused crime suspects (White, 2011). Alas, the government
The Bill of Rights is a list of limitations on the power of the government. Firstly, the Bill of Rights is successful in assuring the adoption of the Constitution. Secondly, the Bill of Rights did not address every foreseeable situation. Thirdly, the Bill of Rights has assured the safety of the people of the nation. Successes, failures, and consequences are what made the Bill of Rights what they are today.
