Mass Incarceration Research Paper

Mass incarceration is one of very many huge problems we have here in America. But when you really look into the core of the situation, whose fault is it really. Right away you think it is the criminals fault for getting arrested in the first place right? More people should be well behaved and not end up in prison? But what a lot of people fail to notice are the ones that actual do the actual sentencing. In Paul Butlers book, Lets Get Free he writes, “I became a prosecutor because I hate bullies. I stopped being a prosecutor because I hate bullies.”

Overall, the United States prison system and society’s view of African Americans needs to change. People need to make sure that the mistakes society has made in the past do not repeat themselves. In order to fix many of the existing problems it is important to focus on reforming the prison system. Doing so would prevent many future cases of injustice and racial

Through the use of literature to inspire social change, Michelle Alexander is able to bring attention to an extremely important social issue that is very prevalent throughout our country. The issue that Alexander is writing about is the mass incarceration of black males in the United States. She describes this increase of mass incarceration in depth, and relates this modern form of social control back to an old practice of the Jim Crow laws and separate but equal segregation.

In today’s society, discrimination is an issue that is considered to be a thing of the past. In a country with such diversity it is hard to believe that people living in the “land of the free” face issues of racism. This paper will focus specifically on the social problem of mass incarceration of minority groups and how the criminal justice system targets these groups. Although this social problem can be linked to specifically African Americans, the impacts of mass incarceration can be felt by almost everyone. I have chosen three articles that focus on how the criminal justice system is masking mass imprisonment a major problem in minority communities.

Mass incarceration became a public policy issue in the United States in the early 2010s. Now in 2016, there is still much debate over the country’s incarcerated population and incarceration rate. The nation has the highest incarcerated population in the world, with 2,217,947 inmates, in front of China with 1,649,804. America incarcerates 693 inmates per 100,000 residents, only the African island nation Seychelles incarcerates at a higher rate, with 799 for every 100,000 residents. The problem of mass incarceration continues to be assessed in various contexts. Recent analyses are historian Elizabeth Hinton’s From the War on Poverty to the War on Crime, legal scholar Michelle Alexander’s The New Jim Crow, and criminologist Dr. Elizabeth Brown’s “Toward Refining the Criminology of Mass Incarceration: Group-Based Trajectories of U.S. States, 1977—2010.”

The vast societal effects from mass incarceration have caused an increasingly alienated population to form in the U.S., which can be broadly classified in the dual areas of lasting effects and impacts to the family unit. First, the lasting effects of high incarceration rates are that they impact the rights of the convict, particularly African Americans. For example, noted civil rights attorney Michelle Alexander posits that the long term effects of mass incarceration operate to deny black Americans the future right to volte, the ability to obtain public benefits, the possibility to sit on juries, and ultimately the opportunity to secure gainful employment (Steiker, 2011), Moreover, professor Alexander argues that this mass incarceration together with the prior Jim Crow laws and the past practice of slaery in the U.S. operate to ensure that black Americans remain s subordinate class of citizens defined primarily by their race (Steiker, 2011).

The trend of African American males between the ages of 25 and 29 has seen a dramatic increase of incarceration. Attention has been focusing on areas of housing, education, and healthcare but the most prominent problem for African American males is the increase in the incarceration rate. African American males between the ages of 25 and 29 incarceration rate has been thought, by many, to be caused by economic factors such as under employment or unemployment, poor housing, lack of education, and lack of healthcare. Yet, others believe it is due to the imbalance of minorities within the criminal justice system, such as judges, lawyers, and lawmakers.

The memory of incidents such as O. J. Simpson’s high profile criminal trial, the assault of Rodney King in Los Angeles in 1992, and the 2009 arrest and charging of Harvard Professor Henry Gates for racial profiling still freshly linger in the minds of many Americans. The people’s perceptions of justice in these situations continue to represent how the criminal justice system is viewed in present times, and continue defining racial disparity in America (Mauer, 2011).

The New Jim Crow is a book written by Michelle Alexander that discusses the rebirth of a caste-like system and race-related issues in the United States specific to African-American males and mass incarceration. Racial Critiques of Mass Incarceration: Beyond the New Jim Crow, is a scholarly article that examines and critiques mass incarceration as well as the analogy of the Criminal Justice system being the “new Jim Crow.”

Of the many tribulations that plague Americans today, the increase in the amount of African American men and women in prisons is unbelievable. It would be naïve to say that the increase is due to the fact that more African Americans are committing crimes now than before. Mass Incarceration is a predicament in the U.S. because in the land of the free, there are more than two million people in prison. Prisons are homes to the majority of twenty-two percent of the U.S. population. The U.S. has a massive incarceration rate, seven hundred and sixteen per every one hundred thousand. The U.S. makes five percent of the world’s population and the third country in which most people live in but number one incarcerating humans.

Mass incarceration has been an ongoing problem in America that became prevalent in the 1960s and still continues today. The reason this mass incarceration is such a crisis in our country is because it has been ripping apart the family and impacting all those involved. This epidemic affects those of every race, but more specifically, African Americans. Many researchers attribute this prison boom to police officers cracking down on crime, but only focusing on the inner city which is often times it is made up of a predominately black population. Because of this, America saw such a rise in the number of African American males in the system in at least some way; whether they were in prison, jail, or probation the numbers were astounding. When a father is removed from a home it impacts the family whether that is the wife, girlfriend, child or stepchild, it has proved to have some short and long term psychological affects on them. It is impossible to parent behind bars, so all the parenting is left up to the mother while the father is locked up. In addition, when a person goes to prison it leaves a mark on the inmate as well. Mass incarceration among African Americans is an ongoing problem impacting thousands of people, both directly and indirectly, and because of this, it is breaking apart the family structure and taking a psychological toll on the loved ones involved.

All societal groups are affected by the issue of imprisonment, but it is a far more likely occurrence among marginalized cultural groups, particularly African Americans. As the United States celebrates the nation's triumph over race with the selection of Barack Obama as the first African American male president, a majority of young black males in major American cities are locked behind bars, or categorized felons for life (Alexander, 2010, p. 1). Bonczar and Beck (1997) report that:

One major problem of prison overcrowding is the effect it has on prison organizational stability. The more prisoners and people put in jail have made it harder for prison guards and staff to monitor and control them. The entire prison system must make enormous changes in order to accommodate for the number of inmates versus the number of prison guards (O’Leary). This often results in a misclassification of offenders. Many who come through the system are classified based on the amount of space available instead of on the security level and programs that would be most suitable for them (Howard). “It is not uncommon to find inmates, classified as medium security, incarcerated in maximum security institutions, while other inmates are in medium security who were previously considered candidates for maximum security” (Howard). Misclassifying offenders often leads to “slow progress through the corrections system as well as a slow exit” (Howard). This in turn only prolongs and increases the overcrowding problem (Howard). The corrections programs should be reformed to meet the needs of the inmates rather than the inmates having to adjust to meet the requirements of the system. Offenders need to be on specific rehabilitation programs that are customized to fit their needs, such as alcohol and drug abuse programs and so forth.

Michelle Alexander’s The New Jim Crow: Mass Incarceration in the Age of Colorblindness goes into great detail on race related issues that were specific to black males, the mass incarceration, and how that lead to the development of institutionalized racism in the United States. She compares the Jim Crow with recent phenomenon of mass incarceration and points out that the mass incarceration is a network of laws, policies, customs and institutions that have been working together to warrant the subordinating status of black males. In this paper I will go into a brief examination of the range of issues that she mentions in her book that are surrounding the mass incarceration of black male populations.
